Merger. A nonconforming lot shall merge with an adjacent conforming or nonconforming lot, which has been held in common ownership with the first lot at any time after July 1, 1983. An adjacent lot is one which abuts with the parcel for a common course of fifty(50) feet or more in distance. Nonconforming lots shall merge until the total lot size conforms to the current bulk schedule requirements," and, "C. Exceptions. Lots which are recognized under § 100-24 and meet any of the following categories shall be exempt from the merger provision set forth above and shall not be deemed merged by operation of this chapter:" "(5) Each lot is currently developed with a one-family dwelling with a minimum 850 square feet which falls within the existing lot lines and which has a certificate of occupancy or would qualify for one." Although both lots are currently developed, the subject lot has a house that measures a total of+/- 350 square feet. The applicant intends to address this issue by adding a second story to the existing dwelling, which is not permitted pursuant to Article XXIV Section 100-242A, which states; "Nothing in this article shall be deemed to prevent the remodeling, reconstruction or enlargement of a non-conforming building containing a conforming use, provided that such action does not create any new non-conformance or increase the degree of non-conformance with regard to the regulations pertaining to such buildings." The existing single-family dwelling has an existing front yard setback of+/- 10 feet, an existing single side yard setback of+/- 7.8 feet and an existing rear yard setback of+/- 20 feet. According to the applicant, the new construction will have a front yard setback of 13.7 feet and will maintain the existing front and side yard setbacks. Therefore, the proposed addition is not permitted pursuant to Article XXVI Section 100-244,which states that non-conforming lots, measuring less than 20,000 square feet in total size, require a minimum single side yard setback of 10 feet, a minimum front yard setback of 35 feet and a minimum rear yard setback of 35 feet.
