It is unclear and undeterminable from existing Town records whether the State of New York has ever legally released this portion of highway to the Town of Southold. Apparently, the necessary documents were not prepared immediately due to an over- sight and the transfer has been delayed somewhat. It is unclear and undeterminable from existing Town records whether the State of New York has ever legally released this portion of highway to the Town of Southold. I received a communication, copy attached, from your Regional Survey and Mapping Supervisor William P. Lamont indicating there has been a transfer of jurisdiction and a print of the appropriate contract sheet from the contract which indicates the transfer of jurisdiction, copies attached. However this sheet is dated February 1975 and on February 7, 1979 there is a Notice of Order which indicates "the old section is being turned over to the Town of Southold". This makes it evident that there was no formal abandonment in 1975. The Town Board is looking for a deed or certificate of abandonment from the State of New York formally taking this action. If you have such a document, please forward a copy so we may proceed with naming this portion of road in the interest of the residents thereon. Very truly yours, Judith T.
