THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION WAS ADOPTED BY THE
SOUTHOLD TOWN BOARD AT A REGULAR MEETING HELD ON APRIL 30, 1996:
WHEREAS, Fairway Farms Association, Inc. has made application to the Town Board
of the Town of Southold to dedicate certain roads in Cutchogue, New York, known
as Fairway Drive, Tee Lane, Wood Way, Path Way, Green Way, and Case's Lane
Extension, as designated on a certain map entitled, "Map of Fairway Farms,
Cutchogue, Town of Southold, Suff. Co., N.Y.", filed in the Office of the clerk
of the County of Suffolk on February 15, 197~, as Map Number 6066; and
WHEREAS, the Southold Town Superintendent of Highways has inspected said
highways and has advised the Town Board that he determines and orders that said
highways shall be laid out in the Town; now, therefore, be it
RESOLVED that in accordance with Section 171 of the Highway Law of the State of
New York, consent be and the same is given to the Superintendent of Highways to
make an order laying out the aforesaid highways, to consist of lands described in
said application as shown on certain maps attached to said application; and be it
FURTHER RESOLVED that the Town Clerk be and she hereby is authorized and
directed to forthwith cause the dedication, release, and deed to be recorded in the,
Office of the Clerk of the County of Suffolk, New York.

TOGETHER with all right, title and interest, if any, o! the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD
the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to
the payment of the cost of the improvement before using any part of the total of the same for any other purpose.

I have reviewed the documents submitted by Fairway Farms for the road
dedication. They include a valid and executed Dedication and Release, a
Survey and a draft Deed (not executed). The documents do not include an
Abstract of Title or road plans. The applicant wanted to hold off on a
title abstract pending an OK from Public Works.
Betty Neville checked with Ray Jacobs and he is prepared to OK the roads
with the plans he currently has, therefore, the applicant should provide
the Town with an Abstract of Title certified to the Town Board by a
reputable title company, and an executed Bargain and Sale Deed. Note
also that the applicant must provide recording fees, which are not in the
papers which have been provided to me.

dedication of the roads owned b~ Fairway Farms Association
(list from above). I 'have not furnished you with the
abstract of title at this time and prefer submitting that
after such time as we know the report of the highway
superintendent to avoid expense to the association at this
time. I believe that all material necessary for the town
review are herewith and request that the procedure for review
in anticipation of dedication proceed. '
