The above referenced subdivision has been completed in a manner such that all required road improvements have been completed in a satisfactory manner except one. The street lights required by the Planning Board have been installed but will require some minor changes before the installation can be accepted. A Town Board resolution will also be required to accept the lights when the road dedication is accepted. A legal description detailing all roads, easements and drainage areas should also be provided. There has apparently been some miss communication between Lori Dowd and myself. The maps, as supplied by Mr Beebee, show all of the required road improvements located within fifty foot right-of-ways. These maps are accurate and all the road work has been completed within the right-of-ways as shown, but a description of these areas will also be needed. This description will avoid any confusion about what is Town property and will also clarify what easements the Town has with regard to the natural drainage area. TO: FROM: RE: DATE: MEMORANDUM TOWN CLERK TOWN ATTORNEY "THE WOODS" ROAD DEDICATION NOVEMBER 20, 1995 On August 10, 1995, William Beebe deeded several roads and associated drainage and open space areas within The Woods at Cutchogue to the town. On October 3, 1995 the Town Board consented to the laying out of these roads by the Highway Superintendent. In particular, the dedication involved Evergreen and Vineyard Drives, a Drainage Area on Lot 9, a 20 foot easement area from the road to the drainage area, and an 11.97 acre open space parcel. Evidence has now come to the town indicating that Mr. Beebe did not have title to some of these properties when he signed the deed. This means that the town did not get title to these parcels. The problem arises in regard to the drainage area and the 20 foot easement. It appears that the open space area had been deeded to the town in July 1992. However, the drainage area and easement are on Lot 9. In April 1991 Lot 9 was transferred to Vincent Urwand. The deed made no reference to the drainage area or the easement. The Planning Board did not obtain an offer of dedication of the drainage basin or the easement. This leaves the Town with no claim to use the drainage basin or the easement. The Town has several options. If Mr. Beebe is able to get the owners of Lot 9 to give the town an easement to the drainage basin and 20 foot accessway, the dedication could continue. If not, I believe the town could revoke the entire road dedication, on the basis that there was a mistake about Mr. Beebe~s ability to dedicate the drainage basin and easement, and a finding that the town doesn't want the roads without the easement and drainage basin. Or, the town could keep the roads without any access to the drainage basin or easement. We should get the recommendation of the Highway Superintendent and Town Engineer. JUDITH T. The title report indicates that title to the roads is free and clear. The documents are generally accurate in form. However, all legal descriptions of the roads simply refer to the map filed 3/23/89. The metes and bounds description in the materials is a description of the entire subdivision, rather than the roads. I checked with Jamie Richter on 8/3 and he advises me that the roads were built in the locations shown on the subdivision map and have not been changed, so it is all right to use the map reference as the road description. The documents can be finalized by Mr. Beebe. Jamie says that he needs to get the maps showing the road layout. He indicates that LILCO needs to finish connecting the street lights, than Jamle can make the final inspection so the bonds can get released and the dedication can proceed. JUDITH T.
