Dear Sir:
The above referenced permit authorizes the construction
of a dock in-addition to other things. The requested and
approved width of the pier was 3 feet . This width was
selected as the Southold Town Trustees at that time had
a 3 foot restriction for all fixed piers . After
considerable complaint and urging, that restriction was
lifted, so that the new requirement is 4 feet, in keeping
with the usual standard of both the DEC and Corps of
Engineers .
Accordingly, I am requesting that this permit be modified
to allow a 41 X 50 ' fixed pier.
By copy of this letter and revised work plan I am
requesting other involved regulatory agencies to take
similar action.

The Two concerns of Mr. Goodwin can be addressed as follows:
The Dock width - As a matter of- Town policy, the Southold Town
Board of Trustees are granting dock permits with a width limit
of 31 . This is based upon the facts that docks result in
shielding of the bottom thus limiting biological productivity in
the immediate area. Permanent docks -also monopolize the creek
physically, limiting movement of other Town Residents in a Town
owned Creek. We feel safe access can be met with a 31 wide dock.
The Plantings - Without embarking on a long explanation of the
benefit of tidal wetlands, of which have been scientifically
documented and published.
I will list some of the benefit that Mr. Goodwin will readily
notice.
Storm water control - The vegetation native of Spartina
Alternaflora and Spartinia• Patens make it the best
defense against storm and wind driven waves in a marine
environment. Their stems and blades cushion the force of the
waves while the root system holds the sand and beach intact. In
.this structure erosion is minimized, especially compared to a
sand beach, which is easily washed away.
The above ground portion of the tidal wetlands provides the -
creek with a filter system. This is evident when the creek'
system experiences and the grasses filter it out and clean the
creeks. Depositions of sediment in this manner helps to
fertilize the growth and build up the marsh.

Dear Sir:
The above referenced permit authorizes the construction
of a dock in-addition to other ~hings. The requested and
approved width of the pier was 3 feet. This width was
selected as the Sou~hold Town Trustees at that time had
a 3 foot restriction for all fixed piers. After
considerable complaint and urging, that restriction was
lifted, so that the new requirement is 4 feet, in keeping
with the usual standard of both the DEC and Corps of
Engineers.
Accordingly~ I am requesting that this permit be modified
to allow a 3' X 50' fixed pier.
By copy of this letter and revised work plan I am
requesting other involved regulatory agencies to take
similar action.

WHEREAS, Eh-Consultant on behalf of RAYMOND GOODWIN applied to the
Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated December
27, 1993 and,

Conservation Advisory Council for their findings and recommendations,

Board recommends dry wells, french drains, planting plan for 10'

We were most disappointed in your response to my appeal
for relief from the special conditions of the permit.
Mr. Goodwin purchased his property recently, partly be-
cause of the open beach that gave him and his family the
ability to bathe in the waters of the creek. In addi-
tion, I have already spoken to you regarding the reduced
width of the catwalk and the lack of scientific support
therefor.
We would appreciate the opportunity to meet with the
Board again so that Mr. Goodwin can personally expand
upon his concerns.

The Two concerns of Mr. Goodwin can be addressed as follows:
The Dock width - As a matter of Town policy, the Southold Town
Board of Trustees are granting dock permits with a width limit
of 3'. This is based upon the facts that docks result in
shielding of the bottom thus limiting biological productivity in
the immediate area. Permanent docks also monopolize the creek
physically, limiting movement of other Town Residents in a Town
owned Creek. We feel safe access can be met with a 3' wide dock.
The Plantings - Without embarking on a long explanation of the
benefit of tidal wetlands, of which have been scientifically
documented and published.
t will list some of the benefit that Mr. Goodwin will readily
notice.
Storm water control - The vegetation native of Spartina
~lternaflora and Spartinia Patens make it the ~est
defense against storm and wind driven waves in a marine
environment. Their stems and blades cushion the force of the
waves while the root system holds the sand and beach intact. In
this structure, erosion is minimized, especially compared to a
sand beach, which is easily washed away.
The above ground portion of the tidal wetlands provides the
creek with a filter system. This is evident when the creek
system experiences and the grasses filter it out and clean the
creeks. Depositions of sediment in this manner helps to
fertilize the growth and build up the marsh.
Wildlife - The marsh is the nursery to many birds, finfish and
shellfish. Grasses such as Spartina Patens and Alternaflora
provide food, cover nesting and breeding places. Physical
removal of habitat decreases the ability of the creek system to
support wildlife.
It is unfortunate that you received a high estimate to have the
grasses planted in front of your house. My recommendation is to
seek out a "second opinion", as the project is small in nature,
does not involve excavation or any specialized equipment.
Transplanting grasses require only a "dibble", whioh is a
pointed stick. The dibble is jobbed into the sand at the
required spacing, the grass is inserted into the hole and
pressed in either with the planting hand or foot. I am not
familiar with the cost of plant material, however the physical
planting can be carried out by anyone, with five minutes of
training. If Mr. Goodwin decides to plant his beach front
himself, I would make myself available to train either himself
or his planters, based on my knowledge of the plant~g procedure
and my proximity to the Mr. Goodwins' house.

I advised my client of the discussion that took place at
the February 24, 1994, meeting. Mr~ Goodwin was very
upse~ to learn of two of the conditions that the Board
imposed.
First, he is of the opinion that a 3'-wide catwalk is
unsatisfactory and potentially unsafe. For a walkway
that narrow, railings must be constructed, which not only
escalates the cost but makes the structure more highly
visible. Although Mr. Goodwin is presently in good
health, he is retired and, thus, wan%s to plan for his
safe enjoyment of the structure in the future.
As I stated at the hearing, I know of no significant or
reasonable environmental argument for reducing the width
from 4' to 3' Indeed, immediately to the south a simi-
lar structure was recently approved and is now under con-
struction for Eugene Burger, which permits a 4' x 35'
fixed pier, plus ramp and float.
The second condition that is troublesome is the planting
of marsh vegetation on the beach. We have checked with
a competent landscaper who advises the cost of planting
the entire beach with high and intertidal marsh vegeta-
tion to be on the order of $1,750. Needless to say, this
is a substantial burden.

We cannot point to any other case in which such a project
has been imposed. Further, the unvegetated beach was at-
tractive to the Goodwins when they were considering pur-
chase of the parcel for its use for bathing purposes. If
this open area were now to be completely vegetated, this
amenity would be eliminated.
For these reasons, I request that you reconsider the
matter at your earliest cohvenience.
