Th~ Southold Town Board of Trustees received your letter dated
and received in our office on March 3, 1998 requesting what, if
any, permits are required to replace, inkind/inplace, stairs
that were destroyed or washed away. It is the Trustees policy
that if an applicant has a previous permit for the project and
that project is destroyed or gone, and they want to replace it
the same way it was originally permitted for, then you do not
need a new permit. Just a written letter to the Trustees
stating that the work will be inkind/inplace as indicated on the
original permit, is required.
Since we have your letter already, and we have Mr. McGreev~'s
permit number and description on file, we do not need any
further letter or request from you.

I am writing on behalf of the Honeysuckle Hills Proper~y
Owners Association~ Inc~, the record owner of the above noted
property. We are proposing to repair our existing stai~-ay for
access to the beach property that our Association owns.
Enclosed herewith please find copies of the most recent
bulkhead permit application to the N.Y.S.D.E.C. by Ronald McGreevy,
an adjoining landowner, that indicates the existing stairway~ ~a
topographical map and subdivision survey showing the location Of
the propcsed wcrk~ and three photos of the top of the existing
stairway.
AS this is an ~'in-kind, in-place~ repair of existing stai~s
that were originally constructed in the mid-i980~s and repaired
again in the early 1990~s, and inasmuch as this area has since been
bulkheaded pursuant to pe_rmits obtained by both of the adjoining
landowners, kindly advise me of what~ if any, perm~its or
applications are required to do the proposed repair. The work is
to be performed by James H. Rambo, inc. of Southampton, New York,
and I have also included a copy of their proposal to the
Association so that you can see the exact nature of what we are
seeking to do.

SPECIAL CONDITIONS
Any debris or excess material from cohstruction of this
project shall be completely removed from the adjacent area
(upland) and removed to an approved UPland area for
disposal. No debris is per2aitted in tidal wetlands and or.
protected buffer areas.
The storage of construction equipment and materials shall bi
confined to within the project work site and or upland areas
greater than 50 linear feet from the tidal wetland boundaryi.
All fill shall consist of "clean" gravel and soil (not
asphalt, slag, flyash, broken concrete or d~molition
debris).
No excavation of the beach is authorized for the purpose
obtaining fill or stone material~.
All peripheral berms, cofferdams, rock revetments, seawalls;
gabiens, bulkheads etc. shall be completed prior to
placement of any fill material behind such structures.
Equipment operation below apparent high water is strictly
prohibited.

The f°llowing renditions apply to a!l Tidal Wetlands; ~reshwa~er
Wetlands; Coastal Erosion Mamagmmmmt; and Wild, Scenic, and
Recreational Rivers ~er~its:
A copy of this permit, including all conditions and
approved plans, shall be available at the project site
whenever authorized work is in progress. The permit
~ign enclosed with the permit shall be protected from
the weather and posted in a conspicuous location at the
work site until all authorized work has been completed.
The permittee shall require that any contractor,
project engineer, or other person responsible for ~he
overall supervision of this proje== reads, ~dersta~ds,
and complies wish this permit and all its general,
special, and supplementary special conditions. Any
failure to comply precisely with all cf the te~us and
conditions of this permit, unless authorized in
writing, shall be treated as a violation of the
Environmental Conservation Law. if any of the permit
conditions are unclear, the permittee shall contact the
Division of Regulatory Affairs at t-he address on page
one or telephone (516) 444-0365.
If project design modifications become necessary after
permit issuance, the permittee shall submit the
appropriate plan changes for approval by the Regional
Permit Administrator prior =o undertaking _any such
modifications. The permittee is advised that
substantial modification may require submission of a
new application for permit.
At least 48 hours prior to comumencement of the project,
the permittee and contrao=or shall sign and return
top portion of the enclosed no=ification form
certifying '~hat they are fully aware of and understand
all terms and conditions of this permit. Within 30
days of completion of the permitted work, the bottom
per=ion of that form mhall also be sighed and
along with photographs of the comp!etad work and, if
required, a survey.
For projects involving activities to be undertaken in
phases over a period of mere than one year, the
permittee shall notify the Regional Pel-mit
Administrator in writing at leas~ 48 hours p~ior ~o
racom~encing work in subsequent years.
The granting of this permi= does no= relieve t. he per~t~ee
of the responsibility of obtaining a gran~, easement, or
other necessary approval from ~he Division of Land
Utilization, Office of General Services, Tower Building,
Empire State Plaza, Albany, NY 12242 (5!6) 474-2195, which
may be required for any encroacb~ent upon State-owned lands
underwater.

The bluff has been severely eroded at the toe of its slope,
especially during storms occurring in 10/91, 12/92, and 3/94.
As a result, the bluff face-and vegetation located thereon has
sloughed and an overhanging lip has developed at the crest.
Before the face can be stabilized thru further vegetative plan
such as Rugosa rose, bayberry, and beach plum, the toe of the
must first be stabilized as part of an attempt to return the

It is expected that this result will be achieved thru construc
of the proposed bulkhead and backfill. Evidence for this can

The following action was taken by the Board of Town Trustees
during its regular meeting held on January 26, 1995 regarding
the above matter:
WHEREAS, Eh-Consultants INc., on behalf of RONALD MC
GREEVY applied to the Southold Town Trustees for a permit
under the provisions of the Wetland Ordianance of the Town of
Southold, application dated October 26, 1994, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on January 26, 1995, at which time
&ll interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and ar~
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code, which will be listed on

MCCREEVY 99-3-~.5 to construct 155 +/- l.f. of timber bulkhead to be
tied into adjacent bulkhead to east. Construct-'a .15 +/-~ return at west
· end of bulkhead and backfill with 250 c.y. of bank run sand to be
trucked in from approved upland source.
Also, to construct a ~ x lU2 section of fixed walk to tie into
existing stairs down bluff; construct ~' wide steps to beach.
The Council recommends approval provided the applicant follow the
Trusteesz policy for bulkheading along the Sound by placing the bulkhead
at the toe of the bluff to tie in with the neighbor's return and that the
bulkhead is buried and maintained. The Council suggests the Trustees
also require the applicant to address the runoff at the top of the bluff
by constructing a berm or sloping the top away from the bluff.

The CAC recommends approval with the stipulations that the pathway
be allowed to human foot access only; that the pathway be restored and
llmited to a 3~ width; and the dike be repaired. The Council has concerns
of the "conditional" nature of Hallocks Bay and the threat of h6rses, and
therefore suggest that no horses be allowed over the dike to the Hallocks
Bay section.
The Council also suggests the Trustees levy a fine for actions taken
without obtaining permits.

Dear Mr. Chiarella:
Based upon our telephone conversation of this date, it is
my understanding that you met on-site with Mr. McGreevy
this week and will issue your approval of the proposed
bulkhead with modifications.
I understand these modifications to be the shortening of
the bulkhead in conjunction with use of an angled return
to be armored in front. Further, you require that
approximately twenty feet of the west end of the bulkhead
be similarly armored.
In accordance with your requests, I have revised the
project plans and enclose four copies herewith.
By copy of this letter and revised plans, I am requesting
other involved agencies to similarly amend our
application. Thank you for your cooperation and prompt
attention to Mr. McGreevy's erosion problem.

PROJECT DESCRIPTION
Construct 142 ± 1.f. of timber bulkhead to be tied into
adjacent bulkhead to east. Construct a 15 ±' angled
return at west end of bulkhead. Place 100 lb. - 300 lb.
stone armor in front of return and westerly-most 20 ±' of
bulkhead. Backfill with 250 c.y. of bank run sand to be
trucked in from approved upland source.
Construct 4' x 14' section of fixed walk to tie into
existing stairs down bluff; construct 4' wide steps to
beach.
