Years ago, the Board of Trustees granted you permission to place
a fence on your property up to the high water mark, subject to
review in the future.
At our October field inspections the Board took a look at your
fence in relation to the high water mark.
Please move the fence landward 20' to reflect the current high
tide, as it now reaches into the water..

Re: Application of Carol Foehr
Gentlemen:
I represent Carol Foehr with respect to the matter that is
scheduled to appear on your agenda this evening. I have just been
retained by Mrs. Foehr and she and I agree that it is important
that I be present at this hearing to present to the Board her
position with respect to the fence on her property going to the
ordinary high water mark. I am sure that after I presented Mrs.
Foehr's position with respect to this fence to the Board, we
could reach a mutually agreeable determination of this issue.
Please note for the record that this fence was erected in
1982 pursuant to a valid building permit issued by the Building
Inspector of the Town of Southold; that this building permit has
never been revoked and is still valid to this date.
Unfortunately, due to prior commitments, I am unable at this
time to be present before the Board to represent Mrs. Foehr. I
respectfully request that the Board adjourn this matter until its
next regular meeting, or such earlier time as the Board sees fit,
and I am sure I will be able to be in attendance.

Dear Mr. Foehr:
This office would like to bring to your attention the notice of
violation issued by the Southold Bay Constable on May 14, 1993
with regard to the fence you have illegally constructed within
the jurisdiction of the Town Wetland Ordinance without a Town
Wetland Permit.
Since you have not submitted an application for a waiver or
wetland permit to this office we are requesting that the
Southold Town Bay Constable cite you for additional days in
violation of the Town Code and seek prosecution and fines for
all days so noted.
We would have no objection to you erecting a temporary barrier
such as a snow fence, provided it is firmly attached to the
fence in question eliminating the current hazardous condition
and only for the time period while your permit application is
pending and under consideration by this Board.
Absent your cooperation, you should expect the full weight of
the Town Courts in a matter we believe directly relates to the
safety of those who would exercise their riparian rights of
walking along the foreshore.
If you need another application sent to you, please contact this
office.
