It is my/our understanding that we are to maintain this
structure with materials designed to endure 30 years and or
equivalent to the original approved structure and that for any
maintenance which involves more than 5% in length of this
structure we are to give prior written notice to the
administrator, waiting for their approval in all but true
emergency situation's which would seriously endanger life,
property and important coastal natural resource features such as
bluffs or wetlands. We further understand that failure to
maintain the structure could result in a requirement to post a
bond and or have the repairs ordered as a lien against the
property upon a finding by the Trustees that said lack of
maintenance would risk life, property or important natural
resources features including protected, rare or threatened
animals and plants.

Dear Mr. Krupski,
I am responding to your letter of 11/21/94. A copy is enclosed. The
denial of my application for a mooring permit was disheartening
considering that the Town has approved at least one other permit in
the same approximate location. Further, the Town granted a permit
to build a ramp and float off Cedar Beach Road and in Cedar Beach
Harbor. Enclosed are three copies of photos concerning this dock.
At this time, I am requesting an appointment with you concerning
your possible review of the denial. Also enclosed are three copies
of photos showing the location where I seek to put my boat.
Thank you for your consideration of the above and I look forward to
your call. I can be reached at 516r391-4577 between 9:00 am and
5:00 pm.

Re: Mooring in Fair Haven Inlet
Dear Mr. Frazzitta,
The following action was taken by the Board of Trustees at their
regular meeting of November 17, 1994:
RESOLVED that the Southold Town Board of Trustees deny the
application to place two stakes approximately at high tide mark
in Fair Haven Inlet for an 18' inboard/outboard, as shown on the
map submitted to the Trustees for the following reasons: 1) The
diagram submitted was not accurate; 2) Because of the width of
the channel, the boat would be contacting and damaging the marsh
fringe; 3) There is very little water there, and the boat would
most likely be on the creek bottom much of the time; and 4)
There is a question of access to the mooring in this position.

GENERAL CONDITIONS
Inspections
1. The permitted site or facility, including retevant records, is subject to inspection at reasonable hours
and intervals by an authorized representative of the Department of Environmental Conservation (the
Department) to determine whether the permittee is complying with this permit and the ECl_ Such
representative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). A copy of
this permit, including ail referenced mai}s, drawings and special conditions, must be available for
inspection by the Department at all times at the project site. Failure to produce a copy of the permit
upon request by a Department representative is & violation of this permit.
Permit Changes and Renewals
2. The Department reserves the right to modify, suspend or revoke this permit when:
a) the scope of the permitted activity is exceeded or a violation of any condition of the permit
or provisions of the ECl_ and pertinent regulations is found;
b) the permit was obtained by misrepresentation or failure to disclose relevant facts;
c) new material information is discovered; or
d) environmental conditions, relevant technology, or applicable law or regulation have materially
changed since the permit was issued.
3. The permittee must submit a separate written application to the Department for renewal, modifica-
tion or transfer of this permit. Such application must include any forms, fees or supplemental infor-
mation the Department requires. Any renewal, modification or transfer granted by the Department
must be in writing.
4. The permittee must submit a renewal application at least:

5. Unless expressly provided for by the Department, issuance of this permit does not modify, supersede
or rescind any order or determination previously issued by the Department or any of the terms, con-
ditions or requirements contained in such order or determination.
Other Legal Obligations of Permittee
6. The permittee has accepted expressly, by the execution of the application, the full legal responsibili-
ty for all damages, direct or indirect, of whatever nature and by whomever suffered, arising out of
the project described in this permit and has agreed to indemnify and save harmless the State from
suits, actions, damages and costs of every name and description resulting from this project.
7. This permit does not convey to the permittee any right to trespass upon the lands or interfere with
the riparian rights of others in order to perform the permitted work nor does it authorize the impair-
ment of any rights, title, or interest in real or personal property held or vested in a person not a party
to the permit.
8. The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-
of-way that may be required for this project.

SPECIAL CONDITIONS
1. All necessary precautions shall be taken to prevent
contamination of the tidal wetlands and/or waters of New York by
silt, sediment, fuels, Solvent, lubricants, epoxy coatings,
concrete leachate and any other pollutant associated with project
work.
2. Any debris or excess material from construction of this
project shall be completely removed from the adjacent area
(upland) and removed to an approved upland area for disposal. No
debris is permitted in tidal wetlands or in tidal waters.
3. The storage of construction equipment and materials shall be
confined to within the project work site and/or landward of the
crest of the bluff.
4. Prior to the ultimate expiration of this permit the permittee
will cause all fill and exposed faces to be vegetated to prevent
eroslon.
5. Ail fill shall consist of "clean" gravel and soil (not
asphalt, slag, flyash, broken concrete or demolition debris).
6. There shall be no temporary/long term storage of fill on the
beach.

7. NO material from the beach (sand, stone or other) may be
removed from the beach for backfill whether by dredging,
excavation or other means, landward or seaward of mean high
water.
8. Operation of equipment seaward of the existing bulkhead
location is not authorized by this permit.
9. Ail peripheral rip rap berms, cofferdams, rock revetment,
gabions, bulkhead etc. shall be completed prior to placement of
any fill material behind such structures.

The permit sig,~ enclosed with the permit or a copy of letter of
approval shall be protected from the weather and posted in a con-
spicuous location at the work site until completion of authorized work.
At least 48 hours prior to commencement of the project, the permittee
shall complete and return the top portion of the enclosed receipt form
certifying that he is fully aware of and understands all provisions and
conditions of this permit. Within one week of completion of the
permitted work, the bottom portion of that form shall also be com-
pleted a~d returned.
For projects involving activities to be accomplished over a period of
more than one year, the permittee shall notify the Regional Permit
Administrator in writing at least 48 hours prior to the commencement
of resumption of work each year.
If project design modifications take place after permit issuance, the
permittee shall submit the appropriate plan changes for approval by
the Regional Permit Administrator prior to undertaking any such modi-
fications. The permittee is advised that substantial modification
may require submission of a new application for permit.
All necessary precautions shall be taken to preclude contamination of
any wetlands or waterway by suspended so]ids, sediment, fuels,
solved]ts, lubricators, epoxy coati~gs, paints, concrete, leachate or
any other environmenta]]y deleterious materials associated with the
project
Any failure to comply precisely with all of the terms and conditions
of this permit, uuless authorized i~l writing, shall be treated as a
violation% of the Environmental Conservation Law.
The permittee is advised to obtain any permits or approvals that may
be required from the U.S. Department of Army Corps of Engineers, NY
District, 26 Federal Plaza, New York, NY 10278, (Attention: Regulatory
Functions Branch), prior to commencement of work authorized herein.
The granting of this permit does ~ot re]ieve the permittee of the
responsibility of obtaining a grant, easement, or other necessary
approval from the Division of Land Utilization, office of General
Services, Tower Building, Empire State Plaza, Albany, NY 12242, which
may be required for any encroachment upon State-owned lands underwater.
