CONSERVATION ADVISORY COUNCIL
At the Southold Town Conservation Advisory Council meeting held Wednesday,'
November 13, 1996 the following recommendation was made:

Moved by Scott Hilary, seconded by Bruce Loucka, it was
RESOLVED to recommend to the Southold Town Board of Trustees
APPROVAL WITH PROVISIONS of the request for a Grandfather Permit of
IOHN FRANCO 90-1-25 to remove 108'+ of timber bulkhead and reconstruct
bulkhead 5' landward and to backfill structure with 10 +/- c.y. of clean sand
to be trucked in from an upland site.

The CAC are unsure why this project is a Grandfather Permit. The project is
not in kind/in place so it appears that it would require a Wetland Permit.
However, if it is correct to issue a Grandfather Permit for the project then
the CAC recommends approval if the bulkhead is placed in line with the
neighbor to the east.

spection at reasonable hours and intervals by an authorized representative of
the Deparl~rent of Enviro.~=ntal Conservation (the Deparb,=nt) to deten'nine

a) the scope of the permitted activity is exceeded or a violation of any

order or determination.
Legal Cb ligations of Permittee
The permittee has accepted expressly, by the execut ion of the application, the
full legal responsibility for all d~eges, direct or indirect, of v~atever
nature and by v~o'~ever suffered, arising out of the project described in this
permit and has agreed to indu~nify and save harmless .the State fro"n suits,
actions, da'~uges and costs of every n~'u and description resulting from this
project.
This penmit does not convey to the permittee any right to trespass upon the
lands or interfere with the riparian rights of others in order to perform the
permitted v~rk nor does it authorize the irrpai,~ent of any rights, title, or
interest in reel or personal property held or vested in a person not a party to
the pen"nit.
8. The permittee is responsible for obtaining any other permits, approvals, I'ands,
eas~rants and rights-of-way that may be required for this project.

SPECIAL CONDITIONS
25 Tidal Wetland
Ail repairs to existing structures are confined to
replacement of existing structural elements with no
change in design, dimension or materials unless specif-
ically authorized herein.
Any bulkhead constructed directly adjacent to vegetated
tidal wetlands must be jetted in with minimal distur-
bance to'tidal wetlands. Trenching is strictly prohib-
ited.
Construction of bulkhead and return walls must be
completed prior to placement of any fill materials
behind such structures.
Ail fill must consist of clean rock, gravel, sand and
soil. Use of asphalt, slag, fly ash, broken concrete
or demolition debris is prohibited.
Ail fill must be graded to match the elevation of the
land immediately adjacent to the bulkhead.
Any debris or excess material from construction of this
project must be ~mmediately and oompletely removed from
the adjaoent area and disposed of at an upland.site.
Disposal of debris in tidal wetlands is prohibited.
Dred~in~
Dredged materials must be placed directly behind the
bulkhead or into the conveyance vehicle. Side-casting
or temporary storage of dredge materials is prohibited.
Dredged material not used as backfill must be disposed
of at an upland site, and suitably retained to prevent
it from reentering any water body or tidal wetland.

The ground area cleared for construction of a path or
board walk is limited to a maximum width of six (6)
feet. The path or boardwalk itself is limited to a
maximum width of four (4) feet.
12. Cover material used for footpath is limited to natural
wood/bark chips, stone, gravel or sand.

The following conditions apply to all Tidal Wetlands;
Netlands; Coastal Erosion Management; and Wild, Scenic,
Recreational Rive~s Permits=
A copy of this per, it, including all conditions and
approved plans, shall be available at the project site
whenever authorized work is in pro~=ess. The permit
sign enclosed with the permit shall be protected from
the weather and posted in a conspicuous location at the
work site until all authorized work has been complet~dl
The permittee shall require T-hat any contractor,
project engineer' or other person responsible for the
overall supervision of this project reads, understandS,.
and complies with this peL-mit and all its general,
special, and supplementary special conditions. Any
failure to comply precisely wi~ all of the terms and
conditions of this permit, uanless au~-horized in
writing, shall be treated as a violation of the
Environmental Conservation Law. If any of the permit
conditions are unclear, the permittee shall contact the
Division of Regulatory Affairs at the address on page
one or telephone (516) 444-0365.
If project design modifications become necessary after
permit issuance, the permittee shall submit the
appropriate plan changes for approval by the Regional
Permit Administrator prior to u~der~aking any such
modifications. The permittee is advised that
substantial modification may require submission cf a
new application for permit.

the permittee and con~ractor shall sign and return the
top portion of the enclosed notification form
certifying that they are fully aware of and understated
all terms and conditions of T-his permit. Within 30
days of completion of the pe_~itted work, the bottom
portion of that form shall al~o be signed and retux~ed,
along with photographs of t_he completed work and, if
required, a survey.
For projects involving activities to be undertaken in
phases over a period of more ~--han one year, the
permittee shall notify the Regional Permit
Administrator in writing at least 48 hours prior to
recommencing work in subsequent years.

timber bulkhead 5 feet landward of the present bulkhead, to
backfill the structure with 10 cubic yards of clean fill (sand)
from an upland source, and to remove the present bulkhead in Hog
Neck Bay, Little Peconic Bay at the Village/Town of Southold,
Suffolk County, New York.
Our review indicates that since the proposed work does not
appear to include dredging or construction activities in or over
any navigable waters of the United States, the placement of any
dredged or fill material in any waters of the United States
(including coastal or inland wetlands) or the accomplishment of
any work affecting the course, location, condition or capacity of
such areas, a Department of the Army permit, in accordance with
33 CFR 320-330, will not be required provided the proposed work
is executed in accordance with the referenced material.
Care should be taken so that any fill or construction
materials, including debris, do not enter the waterway to become
a drift or pollution hazard. You are to contact appropriate
state and local government officials to ensure that the subject
work is performed in compliance with their requirements.
