The board of Fire Commissioners of the Mattituck Fire District,as lead agency,has determined that the proposed action described below will not have a significant effect on the environment and a Draft Environmental Impact statement will not be prepared. Reasons Supporting This Determination: The proposed action is not anticipated to result in any adverse environmental impacts based on the following: 1. Commencing on or about November 24,2020 a preliminary meeting was held to determine the scope of the project.As a result of the meeting subsequent design plans were developed, reviewed and revised at meetings held on January 12,2001,February 2,2021 and February 23, 2021.The conceptual plans were developed to determine as to whether the existing site,if expanded and upgraded,would be sufficient to meet the needs of the fire district. 2. The resultant plans demonstrated that adequate additions and alterations to the existing facilities would be sufficient to accommodate the needs of the district. 1 I �ss 3. On or about May 11,2021 the Board of Fire Commissioners of the Mattituck Fire District issued a Part 1 Short Form Environmental Assessment Form(EAF)providing information. 4. On or about May 12,2021 the Board of Fire Commissioners of the Mattituck Fire District issued a notice of intent to declare lead agency status pursuant Title 6 NYCRR,Part 617, 617.6(b), (1),resolved to perform coordinated review and to circulate the Short Environmental Assessment form and associated plan. 5. The Town of Southold Town Board,Town of Southold Department of Planning,Town of South Engineering Department,Suffolk County Department of Planning,Town of Southold Department of Highways, Suffolk County Department of Health Services Wastewater Management Division,New York State Department of Transportation were determined to involved and interested agencies were provided a Short Environmental Assessment Review Form Part 1, site plan, floor plans and elevations. 6. On June 16,2021 the Town of Southold Planning Board responded to the referral and objected to the Board of Fire Commissioners of the Mattituck Fire District being lead agent. 7. Subsequent to said determination,applications were submitted on February 24,2022 to the Town of Southold Planning Department and Zoning Board of Appeals to commence the approval process including SEQR. 8. On March 28,2022 the Fire District met with the Southold Planning Board and it was determined that due to the limited scope of the project, and in accordance with the standing of the Fire District as a special governmental body in the State of New York,could assume Lead Agency for completion of the coordinated SEQR review with the following noted; • That any required variances would be obtained from the Southold Zoning Board of Appeals. • That site plan review and approval including any required revisions would be obtained from the Town of Southold Planning Board. • That the Fire District would prepare a Storm Water Pollution Protection Plan(SWPPP) for review and acceptance by the Town of Southold Engineering Department and would submit the required NOI with the NYSDEC as required for receipt of said permit. • The Fire District would prepare and submit applications to the NYSDOT for any work to be completed for the replacement of the existing curb cut on NYS Rt.25. 9. On April 13,2022 the Board of Fire Commissioners of the Mattituck Fire District declared itself lead agent and declared the action an unlisted action. 10. The board has the necessary powers to investigate the impacts of this Action and to provide a thorough environmental assessment of this action. 11.None of the involved or interested agencies given notification noted any omissions or requested revisions to the Environmental Assessment Form or the components of the proposed action. 2 12. The project was evaluated in terms of the responses received from involved and interested agencies and its environmental impacts in areas as set forth in the EAF including but not limited to the following: The Town of Southold Planning Board dated June 16 2021 to be mitigated as follows: • The District shall obtained from the Southold Zoning Board of Appeals. • The District shall complete site plan review and approval including any required revisions as required by the Town of Southold Planning Board. • The Fire District shall prepare a Storm Water Pollution Protection Plan(SWPPP)for review and acceptance by the Town of Southold Engineering Department and shall submit the required NOI with the NYSDEC as required for receipt of said permit. • The Fire District shall prepare and submit applications to the NYSDOT for any work to be completed for the replacement of the existing curb cut on NYS Rt.25. 13. The Board of Fire Commissioners of the Mattituck Fire District as Lead Agency under the State Environmental Quality Review Act has reviewed and otherwise undertaken a hard look at this Action, including the short Environmental Assessment Form as well as its component parts and the documents referenced herein,has compared same to the criteria for determining significance as provided in Title 6 NYCRR,part 617,617.7, and thoroughly analyzed relevant areas of environmental concern and had found that; A. The action will not produce a substantial adverse change in existing air quality,ground or surface water quality or quantity,traffic or noise levels; a substantial increase in solid waste production, a substantial increase in potential for erosion,flooding, leaching or drainage problems. The action will not involve the removal or destruction of large quantities of vegetation or fauna; substantial interference with the movement of any resident or migratory fish or wildlife species; impacts on a significant habitat area; substantial adverse impacts on a threatened or endangered species of animal or plant, or the habitat of such a species;or other significant adverse impacts to natural resources. C. The action will result not result in substantial alterations the existing site and the projects and are considered to be temporary and minor in nature. D. The action will not cause the impairment of the environmental characteristics of a Critical Environmental Area as designated pursuant to 6 NYCRR 617.14(g). E. The action will not create a material conflict with a community's current plans or goals as officially approved or adopted. F. The action will not impair the character or quality of important historical, archaeological, architectural, or aesthetic resources, or of existing community or neighborhood character G. The action will not cause a major change in the use of either the quantity or type of energy. 3 i H. The action will not create a hazard to human health. I. The action will not cause a substantial change in the use of land, including agricultural,open space or recreational resources, or in its capacity to support existing uses. The site is currently in use as a firehouse facility and will not change. J. The action will not create a material demand for other actions that would result in one of the above consequences. K. The action will not change two or more elements of the environment,no one of which has a significant impact on the environment, but when considered together result in a substantial adverse impact on the environment. L. Impacts from the action will not combine with impact of other possible independent actions in the vicinity. The lead agency finds that when considered cumulatively such combination will not create a significant adverse impact on the environment. M. The project was evaluated by applying a "hard look" review in accordance with the provisions of SEQR which has resulted in the following findings: 1) The nature and scope of the project is the construction additions and alterations to the existing firehouse facilities for the Mattituck Fire District,a special district which provides emergency and fire protection services to the residents and properties within the district. 2) The function of the land is currently and will remain firehouse use. 3) The extent of the public interest involved in this project is essential to the extent that the fire district is the primary entity that provides fire protection and emergency response services to the residents and community and the facility is required to provide said services. 4) There is no impact upon legitimate local interest's other than that of the fire district. 5) The fire district as a special governmental unit maintains the authority and responsibility for this action as lead agency. 6) There are no local legislative zoning districts which are applicable to expanding the facilities where they exist. 7) During the design phase of the project,alternatives have been reviewed and after a thorough investigation and hard look at all aspects of the project and the needs of the district,the plans developed represent the most efficient and practical alternative to providing the needed improvements. 8) Notice of a declaration of the Mattituck Fire District as Lead Agency and a determination of negative significance will be forwarded to all involved agencies. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on February 26,2004, at which time written and oral evidence were presented. Town of Beekman Planning Board New York State Department of Environmental Conservation Commissioner's Determination of Lead Agency Under Article 8 of the Environmental Conservation Law PROJECT. Proposal by the Beekman Fire District to construct a new fire training facility (Fire Training Facility or Project) on a 29.25 acre parcel of land owned by the Fire District. The project site is located on Greenhaven Road in the Town of Beekman, Dutchess County. DISPUTING AGENCIES: the Beekman Fire District (Fire District) and the Town of Beekman Planning Board (the Planning Board) I have been asked to designate a lead agency to conduct an environmental review under the New York State Environmental Quality Review Act (SEQR; Article 8 of the New York State Environmental Conservation Law [ECL], with implementing regulations at Part 617 of Title 6 of the Official Compilation of Codes, Rules and Regulations of the State of New York [6 NYCRR Part 617]). This designation of the Fire District to serve as lead agency is based on my finding that the Fire District has broader jurisdiction than the Planning Board to investigate the environmental impacts of the Project. Action And Site: The Project consists of construction of a new 2,750 +/- square foot training and storage building, a 2,500 +/- square foot burn building, concrete training pad and additional site improvements (on-site water well and sewage disposal, parking, access,'grading, landscaping and stormwater management). The Fire Training Facility will be served by a new access road from Greenhaven Road (County Route 8). The total area of site disturbance is approximately 12.1 acres. Regulatory Setting The Fire District and the Planning Board have authority to make one or more discretionary decisions concerning the Project: The Fire District is the project sponsor. The Planning Board, on the other hand, states that the Fire Training Facility is subject to its site plan review and special use permit jurisdiction. The Planning Board also identified various other local laws, administered by the Planning Board that the Fire District must comply with including the Town's Aquifer Overlay District, floodplain regulations (a small area of the project's proposed clearing and installation of wells would occur within the 100-year floodplain boundary) and stormwater pollution prevention regulations. Although other potentially involved agencies were identified by the parties, the Fire District and Planning Board are the only agencies involved in this dispute. Discussion In resolving a lead agency dispute, under 6 NYCRR Part 617.6(b) (5) (v), I am guided by the three criteria listed in order of importance as follows: 1. whether the anticipated impacts of the action being considered are primarily of statewide, regional or local significance (i.e., if such impacts are of primarily local significance, all other considerations being equal, the local agency involved will be lead agency); https://www.dec.ny.gov/permits/110612.html 1/3 5/18/221;'12:21 PM Lead Agency Dispute:Beekman Fire District v.Town of Beekman Planning Board-NYS Dept.of Environmental Conservation 2. which agency has the broadest governmental powers for investigation of the impacts of the proposed action; and 3. which agency has the greatest capability for providing the most thorough environmental assessment of the proposed action. My designation of a lead agency must be based strictly on applying these criteria to the facts of each individual case. First Criterion Potential impacts include both construction-related ones from noise, dust, and stormwater runoff. Operational impacts include noise and traffic. The environmental assessment form for the project indicates the presence of wetlands or waterbodies regulated by a federal, state or local agency on or adjacent to the site and the possible presence of threatened or endangered species. The impacts are, therefore, primarily of local significance with the caveat that potential impacts to regulated wetlands or waterbodies and threatened and endangered species can be of regional significance. Nonetheless, the Fire District and the Planning Board are both local agencies. The fact that some impacts may be of regional significance does not weigh in favor of either party. Thus, the first criterion favors neither party. Second Criterion The second criterion favors the Fire District. The Fire District, as sponsor, designer, construction overseer and the agency principally funding the proposed action, possesses through design and financing control a substantial ability to investigate impacts and then to add, modify or even eliminate project elements based on its investigation. As project sponsor, the Fire District has the full range of authority and greatest ability to modify plans to avoid or reduce impacts of the proposed action. While the Planning Board also has substantial governmental authority to investigate impacts under its site plan review and special use permit authorities its authority is less direct and therefore comparatively not as great as that of the project sponsor.1 Here, my analysis of the second criterion is in keeping with my recent determination in Tallman Fire District v. Village of Airmont Planning Board, dated September 13, 2016.2 Third Criterion The third criterion does not provide a clear distinction between the parties. The Planning Board states that it is experienced in reviewing the types of impacts that would be associated with the Fire Training Facility. The Fire District, on the other hand, states that it has access to architects, engineers and other kinds of specialists able to examine the impact of the Project. While it is true that planning boards are typically more experienced than Fire Districts in applying SEAR, the third criterion does not clearly favor either agency here. The Fire District could obtain a similar level of expertise from consulting engineers and planners in preparing the environmental assessment, and the types of impacts present are basic to almost all construction projects. Finding I conclude that the Beekman Fire District should be designated as lead agency for the SEQR review of the Fire Training Facility based on the second criterion. My determination is in keeping with the statutory direction under ECL §8-0111.6 that"[w]hen an action is to be carried out or approved by two or more agencies, the determination of whether the action may have a significant effect on the environment shall be made by the lead agency having principal responsibility for carrying out or approving such action..." Here, the Beekman Fire District has principal responsibility for carrying out the action. In designating the Fire District as lead agency for the SEQR review of this Project, this decision in no way limits the jurisdiction or responsibility of any other involved and interested agencies. The Fire District must still apply for and obtain all necessary lawfully required approvals and permits from other agencies. Village of Airmont Planning Board New York State Department of Environmental Conservation Commissioner's Determination of Lead Agency Under Article 8 of the Environmental Conservation Law PROJECT: A proposal by the Tallman Fire District to demolish an existing administrative building and garage and replace them with a new firehouse that would house its administrative operations and provide for additional reserve fire equipment storage (the Project). The Project is located on Route 59 in the Village of Airmont, Rockland County, New York. DISPUTING AGENCIES: Tallman Fire District (Fire District) and the Village of Airmont Planning Board (Planning Board). I-have been asked to designate a lead agency to conduct an environmental review of the Project under the New York State Environmental Quality Review Act (SEQR; Article 8 of the New York State Environmental Conservation Law [ECL], with implementing regulations at Part 617 of Title 6 of the Official Compilation of Codes, Rules and Regulations of the State of New York [6 NYCRR Part 617]). This designation of the Fire District to serve as lead agency is based on my finding that the Fire District has the broadest governmental powers for investigation of the impacts of the proposed action. Action and Site The Fire District presently operates out of two buildings. One building is used for administrative purposes only. The other building is used to house fire equipment and apparatus but is located on an adjoining tax map parcel. The Project would incorporate administrative operations and additional equipment storage into a one story substation where the administration building currently exists. The fire apparatus will exit onto the adjacent parcel where the current fire station/apparatus building exists and not directly onto the street. There will be no additional entrances or exits to the street. Additional work at the site as part of this project includes: construction of stormwater management structures; addition of an oil/water separator; parking improvements including additional paved/concrete areas and construction of six additional parking spaces; and grading and landscaping. The Fire District proposes to demolish the two existing buildings (administrative offices and a garage) on the parcel. Regulatory Setting The Fire District and the Planning Board were each identified as having one or more discretionary decisions that could affect one or more components of the proposed action. The Fire District is the sponsor for the Project and owner of the land where the Project is proposed. The Planning Board states that the Project will require site plan approval; a building/demolition permit; and variances from the Village of Airmont Zoning Board of Appeals. Discussion In resolving a lead agency dispute, under 6 NYCRR Part 617.6(b)(5)(v), I am guided by the three criteria listed in order of importance as follows: https://www.dec.ny.gov/permits/1 07732.html 1/3 5/20/22,3:32 PM Lead Agency Dispute:Tallman Fire District v.Village of Airmont Planning Board-NYS Dept.of Environmental Conservation 1. whether the anticipated impacts of the action being considered are primarily of statewide, regional or local significance (i.e., if such impacts are of primarily local significance, all other considerations being equal, the local agency involved will be lead agency); 2. which agency has the broadest governmental powers for investigation of the impacts of the proposed action; and 3. which agency has the greatest capability for providing the most thorough environmental assessment of the proposed action. My designation of a lead agency must be based strictly on applying these criteria to the facts of each individual case. First Criterion The Fire District identified potential issues that include stormwater pollution prevention and potential impacts to cultural resources (archeological area of sensitivity). Both the Fire District and the Planning Board are local agencies and the identified impacts are of local significance only. Accordingly, the first criterion favors neither agency. Second Criterion Here, I find distinctions between the disputing agencies that favors the Fire District. The Fire District, as sponsor, designer, construction overseer and the agency principally funding the proposed action, possesses through design and financing control a substantial ability to add, modify or even eliminate project elements. This becomes especially important if design changes would be needed to avoid or minimize project impacts. By contrast, the Planning Board's responsibilities under site plan review are limited to approval of the site layout and design for the new firehouse, which are substantial responsibilities, but not as great as that of the Fire District's abilities, as project sponsor, to investigate impacts of the Project and to then influence its design. Third Criterion The Planning Board contends that it has greater experience with the SEQR process and expertise to conduct the environmental review of the Project than does the Fire District. The Fire District, on the other hand, states that it has access to engineers, architects, surveyors, attorneys, and all other specialists able to examine the impact of the proposed project. While it is true that planning boards are typically more experienced than Fire Districts in applying SEQR and assessing stormwater pollution and archeological impacts from building construction, the third criterion does not favor either agency here as the Fire District could obtain a similar level of expertise from consulting engineers and planners and the types of impacts present here are basic to almost all construction projects. Finding Given the broad range of authority of the Fire District as the project sponsor to investigate impacts and to avoid or mitigate them through its complete control of all aspects of the project funding, design, construction and operational decisions, I conclude that the Tallman Fire District should be lead agency for the review of the Project. In designating the Fire District to serve as lead agency, I expect that the environmental review will be more than a "needs analysis" concerning the provision of fire protection but will also reflect consideration and analysis of issues and concerns raised during the lead agency coordination process. This decision in no way limits the jurisdiction or responsibility of any other involved agencies. The Fire District must still apply for and obtain all necessary approvals and permits from other agencies.
