Application History, finding of facts, Determination and permit conditions. HISTORY AND FINDINGS OF FACTS: 1. An application for permits under Town Code Chapter 37 and 97 was received on September 8, 1992. 2. A notification outlining the required variances under the Coastal Hazard Area Ordinance was transmitted to' the applicant on October 14, 1992. 3. Prior.to the SEQRA determination the applicant modified the plans to reflect a house on pilings eliminating the need for a variance for a house on a permanent foundation. 4. On March 18, 1993 the $outhold Trustees issued a conditioned negative declaration' for this proposed action which is an unlisted action pursuant to NYCPR Part 617 and Town Code Chapter 44. 5. On April 29, 1993 a public hearing was held pursuant to the Coastal Erosion Hazard Area Variance requested as herein outlined. No one spoke in opposition to the Variance requested. The comments of the Conservation Advisory Council were noted for the record. ~ 6. On April 29, 1993 the Coastal Erosion Variance request was approved subject to conditions and the determinations of the Trustees after a Town Wetland Permit public hearing. 7. On May 26, 1993 a public hearing pursuant to the Town Wetland Ordinance was held at which time persons spoke in opposition to the wetland permit. The comments of the Conservation Advisory Council were noted for the record. DETERMINATION The aforementioned variances requested are approved subject to the conditions of a Coastal Erosion Hazard Area Permit as; 1. No reasonable prudent alternative site or method is available. 2. The adverse environmental impacts anticipated have been considered under the SEQRA review and are incorporated into the special conditions. 3. The variances requested are the minimum necessary to overcome the practical difficulties of siting a house in this location. 4. The proposal is reasonably safe from flood and erosion damage the lot in question not having sustained any measurable loss due to major coastal storms of December 1t, 19993 and March 13, 1993. 5. There are no public funds utilized for the project .SPECIAL CONDITIONS OF THE COASTAL EROSION AND WETLAND PERMITS: The following conditions are equally in effect for the Town Wetland and Coastal Erosion Hazard Area Variance permits. 1. Briefly, the Trustees are requiring the installation of a stone revetment in lieu of a timber retaining wall. The plan has been modified accordingly and copies attached herewith so that the NYSDEC application can be similarly modified. In response to your April 20, 1993, letter, I hereby re- quest variance from both the deck and house; and the sanitary system from the nearest wetland, in this case the line of apparent high water of Long Island Sound. As indicated on the attached plan, the setback of the deck will be 33'; of the house, 38'; ~f the sanitary system, 48'~ Due to the size, location, and orientation of the lot, we believe these to be the minimum necessary in order to reasonably develop this lot. The deck that we have proposed is an irregular-shaped structure following the angle of the revetment. Its easterly side is 5', while the westerly side is 10'. This makes it barely usable and cannot reasonably be expected to be reduced further. Mr. Mark Carrara - 2 - April 27, 1993 While you may feel a deck is an amenity, in a location such as this, it is a virtual necessity as the attrac- tion of this property is the waterfront, which can only be properly appreciated by persons to the north of the house who can put a lawn chair on a small structure such as this. It will be of open wood construction, which will not alter drainage patterns; will be landward of a massive stone revetment; and will be landward of a beach now used by people, and thus will not increase the degree of human activity. '~Th'e hoUsa..that .has been shown on ~ne'su~vey~m'easures 26~ by 22". I trust you will appreciate that this is very small and cannotbe reduced further without creating an unusual and unsaleable structure. Its setback from the southerly property line is 20', which barely gives enough area in which to locate the sanitary system. It, there- fore, cannot be relocated farther southward. This location is reasonable and necessary and will have no adverse effect upon the adjacent waterway in that the intervening revetment will prevent any drainage; roof runoff will be handled by drywells; and the house will be located farther away from the waterway than the existing structure immediately to the east and only slightly closer than the adj. acent structure to the west. The nearest waterway, Long Island Sound, is completely devoid of marsh vegetation in this area, and thus, we can fore- see no adverse effect upon this waterway from the pro- posed structure. The sanitary system is located as far as possible from the waterway. The nearest element of the sanitary system, the septic tank, is a solid structure that does not leach, but simply collects solids. The nearest Cesspool will be 64±' from the line of apparent high water. This, too, is as far as possible from the water given the space restrictions, Health Department require- ments, etc. 63' is a considerable distance from sur- face water given the fact that nutrients are considered to be adsorbed within 2' of. the'bottom of the cesspool. Thus, while considerably below the normal 100' standard and given the fact that this property is likely to be occupied on a seasonal basis by a small number of people due to its small size, the volume of effluent generated will be small. Accordingly, we do not foresee any ad- verse effect upon Long Island Sound. I understand that you have located our check and that..the full $900 fee has now been acknowledged. Would you Mr. Mark Carrara - 3 - April 27, 1993 please process'our request further as quickly as possi- ble. Very truly yours, RLH:KD Enclosure cc: o~~u~hold Trustees Susan Tasker Roy L. In lieu of a timber retaining wall, we now propose a stone revetment that will extend no farther seaward than a line drawn between the corners of the adjacent struc- tures. The revetment will consist of 1 1/2 to 2 tons cap stone on a bed of core stone, which in turn will lie on filter cloth. The house itself will be constructed on pilings. W.ith regard to Item 3 of the "summary," it is not possi- ble to situate the sanitary system any differently than we have shown. .Only the septic tank does not lie com- pletely on the street (south) side of the proposed house as there is no room to do so. However, as this is a solid structure that does not leach effluent, I feel that this should not be a problem and should be permitted. The house will meet all applicable flood plan elevations, and the terms of Items 6 will also be met. NEGATIVE DECLARATION NOTICE OF NO SIGNIFICANT EFFECT ON THE ENVIRONMENT APPLICANT NO. 1000-44-2-11 Chapt. 97 - Wetlands NAME: Susan Tasker Chapt. 37 - Coastal Erosion DATE: April 7, 1993 RESOLVED that pursuant to Article 8 of the Environmental Conservation Law, State Environmental Quality Review and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that the Southold Town Trustees, as Lead Agency for the action described below, has determined that the project will not have a significant effect on the environment. Please take further notice that this declaration should not be considered a determination made for any other department or agency which may also have an application pending for the same or similar project. A planting survey shall be submitted prior to final approval. TYPE OF ACTION: Unlisted DESCRIPTION OF ACTION: Applicant. proposes to construct a single family dwelling, associated sanitary system, deck retaining walls, bluestone ' utilities and 265 .y. or c±ean sand fill will be trucked in. IMPACTS ON LAND Potentially large impacts are identified by filling in beach, constructing a home in a designated floodway (Coastal Erosion Hazard Area) and constructing a hard reflective structure in an area where the beach is very narrow and where selective retreat of the.house on the proposed parcel, should a major storm hit is impossible. · MITIGATION ' /A'~a' bion or stone revetment with interlocking elements is necessary to minimize future beach loss from reflected wave / energy and protect a homesite which does not provide for retreat. · /2) The revetment structure must be built to'last at least 30 . ~ / years minimum, with 1 1/2 to 2ton interlocking stone supplied i~with a geo-textile cloth underlayment. · 3) The structure can be no further seaward than bulkheads and stone retaining walls of the neighbors East & West. ~ 4) No conventional foundation is permitted. 5) Upland deposits of unconsolidated sand and gravel shall be incorporated into the revetment and or returned to the shoreline. IMPACTS ON WATER Potentially large impacts on water of constructing a bulkhead on this site are mitigated as outlined under impacts on Land-Mitigation. The potential additional impact of septic tank and water line entering the sides of the home can be mitigated. by all utilities being placed in the front yard with minimal attached retaining structures. IMPACTS ON VISUAL RESOURCES Due to the fact that fifty feet of road frontage does not provide for adequate appreciation of' the coastline at highway speeds where both sides of the proposed site are developed, a small unavoidable loss of Long Island Sound waterviews is expected. SUMMARY A conditional NEGATIVE DECLARATION is recommended which requires~ 1) A revetment of 1 1/2 to '2 ton stone built in an interlocking, lattice with a geo-textile backing which extends no further seaward at any point than the seawall and bulkhead of the East and West. 2) No bulkhead shall be built on this site. 3) Ail utilities and the entirety of the sanitary systemshall be on the street side of this house. 4) No conventional foundation is permitted; any retaining structures required for the 'sanitary system shall be the minimum, required and not part of the house proper. 5) The house must meet all applicable flood plain elevations. · Unconsolidated beach materials to a depth of 2 feet on the /proposed site lying landward of a line connecting the bulkhead and seawall on properties West and East shall be returned to the coastal zone and or incorporated as fill for the spaces in the revetment. SEQR · State Environmental Quality Review FULL ENVIRONMENTAL ASSESSMENT FORM "' Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly'manner whether a pr6ject or. action may be significant. The question of whether a~ ;action may be significant is not always easy to answer· Frequent- ly0 there are aspects of a project that are subjective or unmeasureabte., It is also' understood that those who determine significance may have little or no formal knowledge of the environment or may be technically expert in environmental analysis. In addition~ many who have knowJedg~iin one particular' area may not be aware of the broader concerns affecting the question of significance. The fu]] EAF is intended.to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature, yet flexible to al'low introduction of'information to fit a project or action. Fut! EAF Components: The fuji EAF is. comprlsed of three parts: Part 1: Provides'sbjective data and-inf0rmation about a given proiect' and its site. By identifying~ basic project dat~, it assists a revie~ver in the analysis that takes place in Parts 2 and 3. ?art 2: :ocuses on identifying, the range of possible impacts that may occur from a project or action. It provides ~:,.uidance as to whether an impact is I[kely to be considered small to moderate or whether it is a .potentially- large impact. On. a motion by Bruce Loucka, seconded by Robert Keith, it was RESOLVED to r~commend to the Southold Town Trustees d_isapproval of Wetland Application NO. 44-.22-11 of Susan Tasker. to construct a house. The Council recommends disapproval because: 1." The project is too close to the wetlands. 2. The project is too close to the beach. 3. The property is too small for a house, cesspools, etc. · 4. The bulkhead' is too high. 5. The plan is not accurate. (As shown on the plan, at p~esent :~ the retaining wall:would be in the water at high tide. 6. The Council recommends approval provided the applicant leaves a third (1/3) of the waterway reserved as "open water", that is, the float and boat must not take up more than one-third '(1/3) of the waterway. This would leave the waterway open for navigation. · 685 Dawn Drive, Greenport~ Vote of Council: Ayes: All Motion carried. ENVIRONMENTAL SERVICES 1329 NORTH SEA ROAD, SOUTHAMPTON, NEW YORK 11968 516-283-6360 FAX NO. 516-283-6136 November 4, 1992 Mr. John M. Bredemeyer III, President Town of Southold Board of Trustees 53095 Main Road Southold, New York 11971 RE: SUSAN TASKER - SCTM No. 1000-44-1-11 Dear Mr. Bredemeyer: This letter iSin response to yours of October 14, 1992. The project as'applied for is dictated by the constraints of the parcel. It, as are most of the lots in this vicinity,, is quite small. Unlike. the other lots, how- ever, it is undeveloped. Our proposal simply seeks permission to erect a structure that conforms to the character of the neighborhood. If you have determined that construction upon a concrete slab is not permissible, my client will agree to con- struction on pilings. However, there is no room to re- locate the proposed house. As erosion of the upland is evident, construction of a home on the upland without proper shoreline stabilization would be imprudent to say the least. We are not seeking to recapture a significant portion of the property that has been lost but have placed the proposed retaining wall in a location that will not serve as an energy or debris trap. It is no farther seaward than the existing struc- ture to the.west and will be armored to better disperse wave energy. .While the area to be backfilled may techni- cally be termed "beach," it was not so until the upland eroded. Mr. John M. Bredemeyer III - 2 - November 4, 1992 In summary, I request that the application proceed as there are no other actionSthat the applicant can take to place it more in conformity with the Town's Coastal Ero- sion Hazard Act.
