Since I have alreedy spent so much money on these permits, and since the first time things were done wrong, in £act illegally, I would appreciate this. These £acts have costed me a contract on thls waterfront property and taking this slt into court/not only costed me a lot of money but a lot ofmtime to continue. During construction, concrete or leachate shall not escape or be discharged, nor shall washings from transit mix trucks, mixers, or other devices enter tidal wetlands and~or protected buffer areas. 2. Any debris or excess material from construction of this i project shall be completely removed from the adjacent area (upland) and removed to an approved upland area for disposal. No debris is permitted in tidal wetlands and protected buffer areas. 3. There shall be no disturbance to vegetated tidal wetlands protected buffer areas as a result of the permitted activity. 4. All areas of soil disturbance resulting from this project shall be stabilized immediately following project completibn or prior to permit expiration, whichever comes first. Temporary stabilization shall be maintained until a mature vegetative cover is established. 5. The storage of construction equipment and materials shall be confined to within the project work site and or upland areas greater than 50 linear feet from the tidal wetland boundary. 6. Ail fill shall consist of "clean" gravel and soil (not asphalt, slag, flyash, broken concrete or demolition debris). 7. All peripheral berms, cofferdams, rock revetments, seawalls, gabions, bulkheads etc. shall be completed prior to placement ofany fill material behind such structures. 8. Equipment operation below apparent high water is strictly prohibited. 9. There shall be no discharge of runoff or other effluent over or through any bulkhead or shoreline stabilization structure or into any tidal wetland or adjacent area° 10. Roof runoff shall be directed to drywells a minimum of 75 feet landward of the tidal wetland boundary for immediate on-site recharge. 11. Driveways and parking areas shall be constructed of pervious material. 12. Roads, driveways, and/or parking areas shall be graded to direct runoff away from tidal wetlands and protected buffer .areas. 13. Sanitary system (bottom of tarnk and leaching pools) shall be located a minimum o~ 2' above seasonal high groundwater. 14. The stone armoring for the bulkhead must be installed within 45 days of completion of the bulkhead. , ] 15. District 1000 , Section 4.4, Block 2 , Lot 11 , otherwise known as the properties .of Susan Tasker and her heirs, assigns or successors. This property is subject to the provisions of New York State Environmental Conservation Law (ECL) Article 25 or its successor, and the conduct of regulated activities may occur only pursuant to ECL Article 25 if prior approval is given by the New York State Department of Environmental Conservation (NYSDEC) or its successor. Regulated activities include, but are not limited to the erection of any structure(s); excavation; dredging; grading and filling; clearing of vegetation; and application of chemicals." This deed covenant shall be recorded with the Clerk of Suffolk County with 90 days of the issuance of this permit. A copy of the covenanted deed or other acceptable proof of record, along with the number assigned to this permit, sh&ll be sent within one calendar year of the issuance of this permit to: NYSDEC, Regional Manager, Bureau of Marine : Habitat Protection, SUNY Building 40, Stony Brook, New York 11790-2356. The permit sign enclosed with the permit shall be protected from the weather and posted in a conspicuous location at the work site until all authorized work has been completed. B. The permittee shall require that any contractor, project engineer, or other person responsible for the overall supervision of this project reads, understands, and complies with this permit and all its general, special, and supplementary special conditions. Any ~ failure to comply precisely with all of the terms and conditions of this permit, unless authorized in writing, shall be treated as a violation of the Environmental Conservation Law. If any of the permit conditions are unclear, the permittee shall contact the Division of Regulatory Affairs at the address on page one or telephone (516) 444-0365. C. If project design modifications become necessary after permit issuance, the permittee shall submit the appropriate plan changes for approval by the Regional Permit Administrator prior to undertaking any such modifications. The permittee is advised that substantial modification may require submission of a new application for permit. D. At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion of the permitted work, the bottom portion of that form shall also be signed and returned, along with photographs of the completed work and, if required, a survey. E. Application History, finding of facts, Determination and permit conditions. HISTORY AND FINDINGS OF FACTS: 1. An application for permits under Town Code Chapter 37 and 97 was received on September 8, 1992. 2. A notification outlining the required variances under the Coastal Hazard Area Ordinance was transmitted to the applicant on October 14, 1992. 3. Prior to the SEQHA determination the applicant modified the plans to reflect a house on pilings eliminating the need for a variance for a house on a permanent foundation. 4. On March 18, 1993 the Southold Trustees issued a conditioned negative declaration for this proposed action which is an unlisted action pursuant to NYCPR Part 617 and Town Code Chapter 44. 5. On April 29, 1993 a public hearing was held pursuant to the Coastal Erosion Hazard Area Variance requested as herein outlined. No one spoke in opposition to the Variance requested. The comments of the Conservation Advisory Council were noted for the record. 6. On April 29, 1993 the Coastal Erosion Variance request was approved subject to conditions and the determinations of the Trustees after a Town Wetland Permit public hearing. 7. On May 26, 1993 a public hearing pursuant to the Town Wetland Ordinance was held at which time persons spoke in opposition to the wetland permit. The comments of the Conservation Advisory Council were noted for the record. DETERMINATION The aforementioned variances requested are approved subject to the conditions of a Coastal Erosion Hazard Area Permit as; i. No reasonable prudent alternative site or method is available. 2. The adverse environmental impacts anticipated have been considered under the SEQRA review and are incorporated into the special conditions. 3. The variances requested are the minimum necessary to overcome the practical difficulties of siting a house in this location. 4. The proposal is reasonably safe from flood and erosion damage the lot in question not having sustained any measurable loss due to major coastal storms of December 11, 19993 and March 13, 1993. 5. There are no public funds utilized for the project SPECIAL CONDITI©NS OF THE COASTAL EROSION AND WETLAND PERMITS: The following conditions are equally in effect for the Town Wetland and Coastal Erosion Hazard Area Variance permits. 1. A licensed survey consistent with the plan of En-Consultants dated May 13, 1993 shall be submitted to the Trustees office prior to permit issuance. (Licensed survey date May 18~ 1993 received May 26, 1993). 2. This permit shall expire two years from the issuance date. 3. All construction shall comply with the requirements of the Federal Emergency Management Agency for the V-9 (EL 13'0~) flood zone. The house shall be constructed on open timber or concrete pilings properly jetted or driven into the ground. 4. The aforesaid pilings shall be designed according to accepted engineering practice and constructed such that they have a 30 year useful life expectancy. 5. There shall be no conventional foundation or concrete slab anywhere on this lot including but not limited to house steps and walkways. 6. Retaining walls and the concrete elements required by the sanitary system shall be the minimum necessary for a Suffolk County Department of Health approval. 7. All deck construction shall be on open pilings and be of wood. 8. The site shall employ native salt tolerant vegetation to the maximum extend practical. 9. Dr~wells shall be provided for roof-runoff. i0. The driveway shall be of a pervious surface. 11. All provisions of your Tidal Wetlands ECL permit are equally in effect for this permit, the more stringent or protective interpretations prevailing. 12. Revetment employing 1 1/2 to 2 ton cap stone shall be the only acceptable erosion control structure for this site. 13. Native unconsolidated beach materials up to a depth of 2 feet on the site which might otherwise become entombed by upland derived fill are to be removed and stockpiled for use to nourish the beach in front of the revetment and bulkheads of the adjoining neighbors. No such stockpiled material shall leave the site or be used under the revetment. 14. Construction shall be of continuous operation. 15. Two inspections shall be required: The first to confirm that the beach materials are being saved as per condition $13, the second after final grading has been completed. i6. Briefly, the Trustees are requiring the installation of a stone revetment in lieu of a timber retaining wall. The plan has been modified accordingly and copies attached herewith so that the NYSDEC application can be similarly modified. In response to your April 20, 1993, letter, I hereby re- quest variance from both the deck and house; and the sanitary system from the nearest wetland, in this case the line of apparent high water of Long Island Sound. As indicated on the attached plan, the setback of the deck will be 33'; of the house, 38'; bf the sanitary system, 48'° Due to the size, location, and orientation of the lot, we believe these to be the minimum necessary in order to reasonably develop this lot. The deck that we have proposed is an irregular-shaped structure following the angle of the revetment. Its easterly side is 5', while the westerly side is 10'. This makes it barely usable and cannot reasonably be expected to be reduced further. Mr. Mark Carrara - 2 - April 27, 1993 While you may feel a deck is an amenity, in a location such as this, it is a virtual necessity as the attrac- tion of this property is the waterfront, which can only be properly appreciated by persons to the north of the house who can put a lawn chair on a small structure such as this. It will be of open wood construction, which will not alter drainage patterns; will be landward of a massive stone revetment; and will be landward of a beach now used by people, and thus will not increase the degree of human activity. ~The hoUse, that has been shown on ~e survey measures 26, by 22'. I trust you will appreciate that this is very small and cannotbe reduced further without creating an unusual and unsaleable structure. Its setback from the southerly property line is 20', which barely gives enough area in which to locate the sanitary system. It, there- fore, cannot be relocated farther southward. This location is reasonable and necessary and will have no adverse effect upon the adjacent waterway in that the intervening revetment will prevent any drainage; roof runoff will be handled by drywells; and the house will be located farther away from the waterway than the existing structure immediately to the east and only slightly closer than the adjacent structure to the west. The nearest waterway, Long Island Sound, is completely devoid of marsh vegetation in this area, and thus, we can fore- see no adverse effect upon this waterway from the pro- posed structure. The sanitary system is located as far as possible from the waterway. The nearest element of the sanitary system, the septic tank, is a solid structure that does not leach, but simply collects solids. The nearest Cesspool will be 64±' from the line of apparent high water. This, too, is as far as possible from the water given the space restrictions, Health Department require- ments, etc. 63' is a considerable distance from sur- face water given the fact that nutrients are considered to be adsorbed within 2' of the bottom of the cesspool. The potential additional impact of septic tank and water line entering the sides of the home can be mitigated by all utilities being placed in the front yard with minimal attached retaining structures. IMPACTS ON VISUAL RESOURCES Due to the fact that fifty feet of road frontage does not provide for adequate appreciation of the coastline at highway speeds where both sides of the proposed site are developed, a small unavoidable loss of Long Island Sound waterviews is expected. The CAC recommends disapproval of the bulkhead because no need is shown. The house and bluff are not endangered, the bluff is following the natural process. The Council recommends approval provided the applicant leaves a third (1/3) of the waterway reserved as "open water", that is, the float and boat must not take up more than one-third (1/3) of the waterway. Our proposal simply seeks permission to erect a structure that conforms to the character of the neighborhood. If you have determined that construction upon a concrete slab is not permissible, my client will agree to con- struction on pilings. However, there is no room to re- locate the proposed house. As erosion of the upland is evident, construction of a home on the upland without proper shoreline stabilization would be imprudent to say the least. We are not seeking to recapture a significant portion of the property that has been lost but have placed the proposed retaining wall in a location that will not serve as an energy or debris trap. It is no farther seaward than the existing struc- ture to the west and will be armored to better disperse wave energy. While the area to be backfilled may techni- cally be termed "beach," it was not so until the upland eroded. Mr. John M.
