Dear Mr. Haje,
The following action was taken by the Board of Town Trustees
during its regular meeting held on December 22, 1994 regarding
the above matter:
WHEREAS, En-Consultants Inc. on behalf of EDGARD DEBANY
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated August 30, 1994, and
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on December 22, 1994 at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
EDGARD DEBANY to construct 100 1.f. of timber retaining wall
in line with and attached to adjacent wall to west. A 12'
return will be constructed on east side. Eroded bank ~p to 12'
landward of proposed wall location will be regraded and 75' c.y.
additional sand fill will be trucked in from upland source via
owners property and beach grass planted. An existing 3' X 15'
stairway down bluff will be removed and replaced with a 3' X 10'
stairway from wall to beach. Proposed wall will be well
landward of AHW and will correct erosion of bluff° A 10' area
landward of wall must be of non-turf area. Located 27
Watersedge Way, Southold.
Permit to construct project will expzre two years from the date
it is signed. Fees must be paid, if applicable, and permit
issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

1. The permitted site or facility, including relevant-records, is subject to in-
spection at reasonable hours and intervals by an authorized representative of
the D6part~nt of Enviro~uuntal ConservatiOn (the Department) to determine
whether the permittee is cu~pt¥ing with this permit and the ECL Such represen-
tat ive may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). A
co.py of this permit, including all referenced maps, dra~vings and special
cor4Jitions, rrust be available for inspection by the Depert~unt at all times at
the project site. Failure to produce a copy of the permit upon request by a
Deparb~unt representative is a violation of this permit.

2. The Deparb~unt reserves the righ'~ to rrodify, suspend or revoke this permit when:
a) the scope of the permitted activity is exceeded or a violation Of any
condition of the permit or provisions of the EC~ and pertinent regula-
tions is found;
b) the permit was obtained by misrepresentation or failure to disclose
re Ievant facts;
c) newmaterial info.~ution is discovered; or
d) envirom-antat conditions, relevant technology, or applicable law or
regulation have rrater iai ly changed since the permit was issued.
3. The permittee must submit a separate written appl ication to the Deparl~'e~t for
renevtai, rrodification or transfer of this permit. Such applicationmust include
any fom~, fees or supplemental infoucation the Depart~ent requiresl. Any
renewal, rrodification or transfer granted by the Departrrent must be in writing.
4. The pemnittee must sub'nit a rene~at appl ication at least:
a) 180 days before expiration of permits for State Pollutant Discharge
El imination Syste~n (SuC;ES), Hazardous V~ste Managu~'ent Faci l!ities
(W~I=), major Air Pollution Control (APE;) and Solid V~ste Managu~unt

b) 30 days before expiration of al I other permit types.
5. Unless expressly provided for by the Deper~'ent, issuance of this permit does
not modify, supersede or rescind any order or determination perviously issQed by
the Depart~¥ent or any of the terrrs, conditions or requiru~'ents contained i~ such
order or determination.

SPECIAL CONDITIONS
A permanent vegetated buffer zone shall be established in an
area extending 5' landward of the bulkhead. The vegetation
must consist of non-fertilizer dependent shrubs. No lawn
grass is permitted in this area.
2. Any debris or excess material from construction of this
project shall be completely removed from the adjacent area
(upland) and removed to an approved up~and area for
disposal. No debris is permitted in tidal wetlands and or
protected buffer areas.
3. There shall be no disturbance to vegetated tidal wetlands or
protected buffer areas as a result of the permitted
activity.
4. Ail peripheral berms, cofferdams, rock revetments, seawa~ls,
gabions, bulkheads etc. shall be completed prior to
placement of any fill material behind such structures.
5. Equipment operation below apparent high water is strictly
prohibited.
6. There shall be no discharge of runoff or other effluent over
or through any bulkhead or shoreline stabilization structure
or into any tidal wetland or adjacent area.

7. No excavation of the beach is authorized for the purposeof
obtaining fill or stone materials.
8. All fill shall consist of "clean" gravel and soil (not
asphalt, slag, flyash, broken concrete or demolition
debris).

The following conditions apply to all Tidal Wetlands; Freshwater
Wetlands; Coastal Erosion Management; and Wild, Scenic, an~
Recreational Rivers Permits=
A. A copy of this permit, including all conditions and
approved plans, shall be available at the project site
whenever authorized work is in progress. The permit
sign enclosed with the permit shall be protected from
the weather and posted in a conspicuous location at the
work site until all authorized work has been completed.
B. The permittee shall require that any contractor,
project engineer, or other person responsible for the
overall supervision of this project reads, understands,
and complies with this permit and all its general,
special, and supplementary special conditions. Any
failure to comply precisely with all of the terms and
conditions of this permit, unless authorized in
writing, shall be treated as a violation of the
Environmental Conservation Law. If any of the permit
conditions are unclear, the permittee shall contact the
Division of Regulatory Affairs at the address on page
'- one or telephone (516) 444-0365°
C. If project design modifications become necessary after
permit issuance, the permittee shall submit the
appropriate plan changes for approval by the Regional
Permit Administrator prior to undertaking any such
modifications. The permittee is advised that
substantial modification may require submission of a
new application for permit.
D. At least 48 hours prior to commencement of the project,
the permittee and contractor shall sign and return the
top portion of the enclosed notification form
certifying that they are fully aware of and understand
all terms and conditions of this permit. Within 30
days of completion of the permitted work, the bottom
portion of that form shall also be signed and returned,
along with photographs of the completed work and, if
required, a survey.
E. For projects involving activities to be undertaken in
phases over a period of more than one year, the
permittee shall notify the Regional Permit
Administrator in writing at least 48 hours prior to
recommencing work in subsequent years.
F. The granting of this permit does not relieve the permittee
of the responsibility of obtaining a grant, easement, or
other necessary approval from the Division of Land
Utilization, office of General Services, Tower Building,
Empire State Plaza, Albany, NY 12242 (516) 474-2195, which
may be' required for any encroachment upon State-owned lands
underwater.

project will not have a significant effect on the environment.

considered a determination made for any other department or agency

Gentlemen:
Enclosed please find photographs documenting the loss 6f
upland in the October 1991 and December 1992 storms.
Approximately, 8-9' of horizontal upland loss occurred. Fi%l
quantities are estimated at 150 - 175 cubic yards, i
You will note that the construction of this ~all will line ~p
with that on the Northwest. Therefore, the bulkhead will be well
above MHW. The beach on either side of the property is contigUoUs
and similar in both elevation and width (seaward landward). The
groins which we assume are legal, have maintained the beach but do
not protect upland in severe storm events-when a storm surge
overtops them completely.
We trust this information will assist you to determine that
this structure merits your approval. If further information is
required please advise before the next public meeting. ~

~ITH STIPUBTIONS of the Wetland Application of BETH BLEVlNS
to relocate existing house to parallel propert~ lines, 2~ x 2~ garage on east
side, 12 x 33 deck on west side. Enlarge existing second floor, enclose
existing screened porch, full concrete foundation below' raised house
(excavation only for footings, area inside foundation to be a crawl space above
grade). Existing cesspool on west side to remain.
The CouncU recommends approval provided the following stipulations are
followed:
1. Move the cesspools to the front yard near test hole No. 2, as far away
from the wetlands as possible.
2. Restore natura~ vegetative buffer.
NOTE: Violation - land clearing should be stopped immediately~

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
~IT~ CONDITIONS of the Wetland Appticatlon of THO~ BOYLE 59-1-7 to
construct 170 +/- I.f. of stone revetment and backfiH with 2500 +/- c.y. of
clean sand to be trucked in form an upland source. Purpose of structure is to
prevent further erosion to property and concrete wal~ which is collapsing.
Letter of Non-Jurisdiction requested for construction of one-family dwelling,
sanitary system, driveway, as shown on submitted site plan.
The Council recommends approval provided the property owner maintain 50~
east of his revetment (equal to the 50' currently eroded on east side of
owner's property). This will protect his property from northeast storms and
will avoid damage to the Southold Town Beach.
The Council recommends disapproval of the request for a Letter of
Non-~ursid[ction for the single famil~ dwelling. Project needs to go t~rough
the application process.

PROJECT DESCRIPTION
Construct 100 1.f of timber retaining wall in line with
and attached ~o adjacent wall to west. A 12' return will
be constructed on east side. Eroded bank up to 12'
landward of proposed wall location will be regraded and
75 c.y. additional sand fill will be trucked in from
upland source via owners property. An existing 3' x 15'
stairway down bluff will be removed and replaced with a
3' x 10! stairway from wall to beach. Proposed wall will
be well landward of AHW and will correct erosion of
bluff.
