Box 1047 Southold, NY 11971 RE: SILVER SANDS HOLDINGS I, LLC 1100 SILVERMERE ROAD, GREENPORT SCTM# 1000-47-2-14 Dear Mr. Kimack: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, March 15, 2023 regarding the above matter: WHEREAS, Michael Kimack, on behalf of SILVER SANDS HOLDINGS I, LLC applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance, application dated January 23, 2023; and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator noted that 490 sq.ft. of existing freshwater vegetation is proposed to be removed and that the area had already been cleared of freshwater wetland vegetation. The proposed application does not protect freshwater wetlands on-site, noting the lack of non-disturbance buffer areas around freshwater and tidal wetlands, and recommended that the proposed application be found Inconsistent with the LWRP, and specifically Inconsistent with the following coastal policies: Policy 6.3 Protect and restore tidal and freshwater wetlands, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on March 15, 2023, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the project, as applied for does not comply with the standards set forth in Southold Town Code Chapter 275-12. Standards for Issuance of Permit. A. Adversely affect the wetlands of the Town; L Otherwise adversely affect the health, safety and general welfare of the people of the Town; J. Adversely affect the aesthetic value of the wetland and adjacent areas; and WHEREAS, the Board has determined that the request, as applied for, will have a detrimental effect upon the health, safety and general welfare of the people of the town, and, adversely affect the tidal flow of the tidal waters of the Town. BE IT FURTHER RESOLVED that the Board of Trustees DENIES the application of SILVER SANDS HOLDINGS I, LLC for the as-built tidal wetland jurisdiction area/ground disturbance: total area: ±10,200sq.ft.; for a buffer, place approximately 92 linear foot sand walk path (±1,100sq.ft.) set back 18' at closest point to tidal wetlands line; existing sand to remain; place approximately 8 linear foot by 6' ± (40sq.ft.) sand walk path continuing from Lot 13 landward of buffer to frame building; planting plan in accordance with a portion of Planting Schedule L-4.40/4.50 attributable to Lot 14; for the storm water management system fresh water stone buffer/drain trench, remove approximately 490sq.ft. of existing freshwater wetland vegetation; construct a 180'x10' (1,800sq.ft.) drainage trench/stone buffer as located on Utility Site Plan to accommodate storm water from four (4) cottages and garage; install approximately 330 linear feet of drain lines from the four (4) cottages and garage to the drainage trench (approximately 75 linear feet of drain lines on Lot 15); for the fresh water wetland planting plan, install approximately 2,400sq.ft. of additional indigenous plantings between stone buffer and fresh water vegetation line to further protect wetland; additional planting area at approximately 5 to 1 greater than area removed; restore area from stone buffer within Trustee jurisdiction in accordance with a portion of Planting Schedule 4.40/4.50 attributable to Lot 14; and as depicted on the site plan prepared by Edmund D. How could the town allow this to happen? It was apparent that work was being hidden behind tall Black plastic "walls "that surrounded the whole place. This site should be carefully inspected and anything done that is not in compliance with natural habitat and wetland preservation be corrected. Fines should be levied and no permits given until there is transparent inspection. Silver Sands is a lovely wetland location and needs to be treated carefully. Based on my review I make the following comments: 1. The drainage plans contain no stormwater runoff calculations, are hand drawn over a professional survey of each lot and are not noted as being prepared by a licensed design professional. Therefore, as submitted, the plans do not meet the requirements of Chapter 236. 2. The drainage plans propose the removal of existing freshwater wetlands to accommodate the installation of a stone buffer/drain trench to treat stormwater runoff. This is categorically not allowed. The purpose of installing stormwater controls is to protect the wetlands from runoff. No sound drainage design should involve the destruction of the natural resource it is designed to protect. 3. The stone buffer/drain trench is proposed to be located in close proximity to the existing wetlands boundary line. This is problematic for two reasons. First and foremost, stormwater treatment practices should be installed as close to the point of origin and as far from the wetlands to be protected as possible, so that the maximum benefit is gained from the stormwater treatment practice. Second, if installed adjacent to the existing wetlands, the stone buffer/drain trench will likely be heavily impacted by phragmite and other wetland growth, significantly reducing its capacity to store and treat stormwater runoff. There is no control over the guality of stormwater being disposed of. The water levels in these systems expand and contract in area with seasons. 2. Removing natural wetland systems with naturalized species affects the function and values the wetland provides to dependent species in its current state. 3.
