The following are our determinations: Based on our analysis of the survey submitted, the floating docks are proposed in an area that has 2.5' of water at average low water. An extreme moon tide would be much lower water. At these depths, shallow draft boats, under power, would cause significant disturbance to the creek bottom. The propeller wash from these boats would power dredge the bottom of the creek. If the slips were installed and the bottom then disturbed, the actual disturbance of the marina area may become the justification for future dredging applications. Therefore, placement of boat slips, in what is essentially unnavigable water, does not meet the standards of permit issuance as per 6NYCRR Part 661.9(a) and (b)(1)(i) and (iii). As our Bureau of Shellfisheries informed the Association in their letter of 1/15/91, a likely outcome of this proposal, if installed, would be the seasonal closure of the marina proper and the shellfish lands immediately inshore. Larger closings may be predicated on a survey of marina usage and water quality tests. This aspect of the proposal does not meet the standards of 6NYCRR Part 661.1 (b)(1)(i) and (iii). This permit denial is made without prejudice and is based on the current configuration of your proposal. Drywells to be installed are to be a minimum of (2) 8' diameter x 2' deep precast concrete drainage rings with associated berm and swale diverting as much surface runoff from the road into said drywell as practical. There will be no dredging, catwalk will be elevated over existing tidal wetland areas. This permit shall not be issued until the following covenants and restrictions to be filed with the County Clerk and running with the land in perpetuity; 2. 3. 4. The facility will be utilized only by property owners of Corey Creek Estates Homeowners Association. There shall be NO dockage of boats with heads. There shall be a sign posted stating no heads, no fuel transfer from containers and no live-a-boards. No TBT painted hulls. (although no longer likely a problem). This permit will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Two inspections are required and the Trustees are to be notified upon completio~ of said project. Please return to the Building Department for a determination on the need for any other permits which may be required for this project. Y. 11971 RE: Corey Creek Association Application #1-4738-0227/00001-0 Dear Mr. Bredemeyer: This letter is in regard to the above application and some questions that appear to surround it. The Corey Creek Association proposal is an unlisted action located in a CEA as defined in 6NYCRR Part 617 (SEQR). As such, it must be treated as a Type I action. Type I actions require a coordinated review. On 7/11/90 we sent the Town of Southold a Lead Agency Coordination Request. This request was unanswered. A negative declaration was issued by the Town of Southold, as lead agency, on 10/4/91 with no coordinated review. Department staff have been unable to make a determination of significance because the applicant continually submits plans that lack vital information (i.e. water depths at float location, etc.). We have a series of "Notices of Incomplete Application", spanning approximately 18 months, that continually ask the same questions. Our file also indicates that NYSDOS has had difficulty obtaining information from the applicant. Please note the attached letter of objection from NYSDOS dated 12/13/90. Several letters from your office have been submitted to Maureen Davidson questioning the Department's position on a shellfish closure in Corey Creek. I believe Charles deQuillfeldt made our position on this aspect of the application very clear in his 1/15/91 letter to you. I must emphasize that the shellfish concern is one of several that the appli?ant has not answered. John M. The Board of Trustees has indicated to me that they would prefer to see your agency's written response prior to considering a permit in this matter. Please convey those items of which we spoke to my Board so we can come to a more reasoned decision on this application. If the Board of Trustees acts favorably to the applicants request for a permit, I can assure your that the following conditions will be included in their local wetland permit and enforced: 1. A covenant and restriction shall be filed with the County Clerk and running with the land in perpetuity against dockage of boats with heads. Qs 2. And other such regulations appropriate by the shellfish control Town Trustees. as m~ght be deemed authority and the Southold In closing, I would hope that your agency would give very strong consideration to not imposing closures within the confines of a small (10 or less) boat facility where a no-head rule is in effect. I seriously doubt that long term operations of such a small nature would reasonably alter the quality of shellfish in a creek such as Corey Creek, which is largely un-bulkheaded, is in its aatural state and contains few boats per acre. Such regulated operations as we propose should actually pose less risk to a creek and the quality of its shellfish than an open mooring field or private docks of similar size which are unregulated and generally inaccessible. A much more rational, albeit arbitrary, approach would be to set a maximum number of "headless'~ vessels for a given enclosed body of water based on a simple density formula i.e., close when boats without heads exceeded say 4 per acre or say 40 linear feet of overall boat length per 4,000. cubic meters of water volume, whatever, etc... We hope that your agency will be able to respond promptly in writing and give consideration to our request. Very truly yours, John M. The Board of Trustees has indicated to me that they would prefer to see your agency's written response prior to considering a permit in this matter. Please convey those items of which we spoke to my Board so we can come to a more reasoned decision on this application. If the Board of Trustees acts favorably to the applicants request for a permit, I can assure your that the following conditions will be included in their local wetland permit and enforced: 1. A covenant and restriction shall be filed with the County Clerk and running with the land in Perpetuity against dockage of boats with heads. 2. Signage concerning no heads, general operations: as prohibition of fuel transfer from containers shall be required and no live-a-boards. such 3. No TBT painted hulls (although no longer likely a problem). 4. A limitation on the size and number of Corey Creek Association boats permitted in the creek at large. 5. And other such regulations appropriate by the shellfish control Town Trustees. as might be deemed authority and the Southotd In closing, I would hope that your agency would give very strong consideration to not imposing closures within the confines of a small (10 or less) boat facility where a no-head rule is in effect. I seriously doubt that long term operations of such a small nature would reasonably alter the quality of shellfish in a creek such as Corey Creek, which is largely un-bulkheaded, is in its natural state and contains few boats per acre. Such regulated operations as we propose should actually pose less risk to a creek and the quality of its shellfish than an open mooring field or private docks of similar size which are unregulated and generally inaccessible. A much more rational, albeit arbitrary, approach would be to set a maximum number of "headless" vessels for a given enclosed body of water based on a simple density formula i.e., close when boats without heads exceeded say 4 per acre or say 40 linear feet of overall boat length per 4,000. cubic meters of water volume, whatever, etc... Please consider the ~ollowing comments in regard to that pro~ect. Corey Creek remains one o~ the ~ew unspoiled inlets in this area o~ Long Island. Having an abundance o~ sea grass it still retains its natural scenic beauty, and currently is the only one o~ ~our ma~or creeks on Hogs Neck not closed to clamming. The others (Town, Jockey and Goose Creeks) are o~ limits to clammers due to pollution. The proposed pier, 140 ~eet in length, would be con- structed over one o~ the most productive clam beds o~ Corey Creek. Traditionally, commercial clammers .as well as local residents have 'been harvesting that area with astonishing success. I~ con- structed, the proposed dockage would render over 7,000 square ~eet o~ clam beds inaccessible ~or this purpose. The location o~ the proposed pro~ect is near the end o~ Corey Creek, where the tidal ~lush is not so e~icient as in areas closer to the in]et. Even now an oily slime, obviously resulting ~rom the storage and usage o~ twenty boats'stored at a marina di- rectly north o~ us, can be noticed along the shore. Mussels, which are plentiful in this area but inedible due to their odor and taste o~ gasoline, are ~urther evidence of this pollution. How much!more contamination would result ~rom an additional ~ourteen boats in this confined area, and how much more can we tolerate? As we all know, these creeks are nature's nurseries for spawned fish. The ocean's harvests depend on the migration of healthy adult ~ish from these areas, so our supply o~ fish will ul- timately be determined by the conditions o~ our creeks. It is im- perative that these nurseries remain clean and productive. And, of course, a consequence o~ additional boat traffic is increased erosion. The integrity of our banks is dependent on the root system of sea-grass, as well as threadlike extensionspro- duced by mussels clinging to the grass. The banks interwoven with these fine threads are well able to withstand normal tidal move- ments, but nature was not prepared for the advent of the motor boat. Persistent shocks from the wakes of these craft cause sec- tions of sea-grass and their mussels to break-off and be removed by the tide. The unprotected under-layer becomes subject to further erosion, and the remaining sea-grass vulnerable to the next on- slaught. The end result could be a lifeless creek devoid of grass, mussels and fish. Let's prevent or at least delay this deplorable climax. Incidentally the placement of pilings in these shores would interfere with the continuity of those natural systems thereby weakening the resistance to erosion. On weekends, especially, scores of boaters can be seen cruising around this sector of Corey Creek to enjoy its pristine beauty. We residents also enjoy the serene view of water and sea grass beyond our houses. Can you envision the impact of 140 feet of dockage and 30 mooring piles on this beautiful scene? Also to be considered is the noise resulting from the proposed marina's fourteen boats. My neighbors and I, who will have this enormous structure virtually in our backyards, resent the transformation of our peaceful atmosphere. The creek at this point is not wide enough to accommodate a marina of those propor- tions. Again I thank you for your notification licitation of my comments. Given the ~llowing conditions of the project location, lack of depth, narrow,ness of creek width and being located within the Corey Creek Crit[cat Environmental Area; the area has a heightened sensitivity to impacts. The proposed project will cause prop scour of the bottom, to~ scour of the adjacent marsh island, constriction of the navigable creek, and the inadvertent discharge of pollutants by the increased number of vessels. An alternative offered by the Department would be to construct a catwalk, ramp and one float (0'x 35'). Boats could then be moored in the area and brought to the floa[ to toad and off-load. This is a sensitive issue due to the competing uses of the shoreline and near-shore waters. The closure of shellfish lands in areas of high boating activity is based on the potential for the discharge of human w~stes. Accordingly, the smaller the potential for inadvertent or illegal discharge of fecal material, the smaller the size of the closure that is necessary. This is why most closures due to boating activity are seasonal - areas are open when the threat of contamination is removed. ! cannot foresee an instance where we can guarantee that no closures of shellfish lands will occur in association with a marina or marina expansion because the potential, however small, for contamination continues to exist. I can say that, for areas with very low potential for discharge of fecal material, the effect will be limited to seasonal closures of the marina proper. The official DEC response to the proposal will be based on comments from many units within the agency and will be coordinated through the Division of Regulatory Affairs and Region 1Harine Habitat Protection. The Town of Southold's proposed restrictions on the use and occupancy of the marina will, if adhered to, minimize the amount of area that must be closed to protect public health. Given the small size of the boats and the prohibition of NSDs and live-aboards, a likely outcome would be the seasonal closure of!the marina proper and the shellfish lands immediately inshore. This would be subject to a survey of actual marina usage now and in the future. A cautionary note is that any closure of shellfish lands, however small, is viewed unfavorably by DEC. Some of the other concerns that I expect DEC will address are: Is dredging necessary? What are the shellfish, finfish and other natural resources in the area, and how will the resources and public use be affected? Will the structures be permanently installed or removed seasonally? What new construction in Tidal Wetlands is required? I am forwarding your letter to Harine Habitat Protection and DRA, I hope my comments will be helpful to you for this and other marina projects. Although I cannot advocate any construction that may lead to additional closures of shellfish lands, I recognize that boating is important to local economies and that governments are under pressure to allow development. In this regard I support and encourage the Town's efforts to minimize the impact on shellfish lands. Javits Federal Building ATTENTION: Regulatory Branch Dear Sir: Thank you for notifying me of Application No. 9d-O471-L2 for a 140 foot floating pier assembly to be constructed directly to the rear of my house located at 3520 Minnehaha Boulevard, Southold, N.Y.. Please consider the following comments in regard to that project. Corey Creek remains one of the few unspoiled inlets in this area of Long Island. Having an abundance of sea grass it still retains its natural scenic beauty, and currently is the only one of four major creeks on Hogs Neck not closed to clamming. The others (Town, Jockey and Goose Creeks) are off limits to clammers due to pollution. The proposed pier, 140 feet in length, would be con- structed over one of the most productive clam beds of Corey Creek. .Traditionally, commercial clammers .as well as local residents have been harvesting that area with astonishing success. If con- structed, ~he proposed dockage would render over 7,000 square feet of clam beds inaccessible for this purpose. The location of the proposed project is near the end of Corey Creek, where the tidal flush is not so efficient as in areas closer to the inlet. Even now an oily slime, obviously resulting from the storage and usage of twenty boats'stored at a marina di- rectly north of us, can be noticed along the shore. Mussels, which are plentiful in this area but inedible due to their odor and taste of gasoline, are further evidence of this pollution. How much more contamination would result from an additional fourteen boats in this confined area, and how much more can we tolerate? As we all know, these creeks are nature's nurseries for spawned fish. The ocean's harvests depend on the migration of healthy adult fish from these areas, so our supply of fish will ul- timately be determined by the conditions of our creeks. It is im- perative that these nurseries remain clean and productive. And, of course, a consequence of additional boat traffic is increased erosion. The integrity of our banks is dependent on the root system of sea-grass, as well as threadlike extensions pro- duced by mussels clinging to the grass. The banks interwoven with these fine threads are well able to withstand normal tidal move- ments, but nature was not prepared for the advent of the motor' boat. Persistent shocks from the wakes of these craft cause sec- tions of sea-grass and their mussels to break-off and be removed by the tide. The unprotected under-layer becomes subject to further erosion, and the remaining sea-grass vulnerable to the next on- slaught. The end result could be a lifeless creek devoid of grass, mussels and fish. Let's prevent or at least delay this deplorable climax. Incidentally the placement of pilings in these shores would interfere with the continuity of those natural systems thereby weakening the resistance to erosion. On weekends, especially, scores of boaters can be seen cruising around this sector of Corey Creek to enjoy its pristine beauty. We residents also enjoy the serene view of water and Sea grass beyond our houses. Can you envision the impact of 140 feet of dockage and 30 mooring piles on this beautiful scene? Also to be considered is the noise resulting from the proposed marina's fourteen boats. My neighbors and I, who will have this enormous structure virtually in our backyards, resent the transformation of our peaceful atmosphere. We purchased our property located at 1580 Corey Creek Lane as our families' final home and retirement residence. We chose this location solely because of its serene, quiet, inactive natural environment with a wonderful waterfront view and nearby fishing and swimming accesses. Therefore, if a pier were to be built in front of our house it would compromise and degrade what the area is. A docking faqility or a marina of this size will no doubt spill added fuel and wastes into the water in addition to a drastic increase of activity in such a small creekl This would not help to preserve the existing fish and shell fish in the water, or the shore and wildlife wetlands, or clean swimming conditions. We also believe that the floating docks will be stored for the winter and off seasons in the wetlands area diagonally across the street from our house. This would cause adverse effects to the wetland nesting areas of the presently existing turtles, swans, ducks, and geese. As for our home, we paid a premium for our land because of its environment and attributes listed above. We, as a result of this beautiful area, designed and custom built our home with these facts as a theme and basis. The construction of this pier would block the view that we have and most definitely greatly decrease the largest basis of our property value. In addition, Corey Creek Lane~ which is a private dead end street, would now incur increased usage and traffic to access this marina facility. We would also, no longer be able to fish or swim in ~ront of our house for fear that we may ill from eating the fish or swimming in the unclean water. As well as, we have been told that, under the law, no fishing or swimming Is permitted within five hundred feet of the pier. We would also like to site~ that the residents of Corey Creek Lane have joint ownership and access to the wetlands and Corey Creek. At the time the properties were bought, all the applicants were aware of specific restrictions regarding the use of water rights and the intent to preserve the area and its environment. The construction of this pier is not within standing of these restrictions. Knowing that the area could not be changed is one of the reasons that we bought the property. Why try to change the very reasons and conditions that was the basis that we bought our homes on? There~ is, an existing pier that we all can use. I feel that a certain few, want something that will not benefit the many. The waters of the Peconic Bays had been plagued with the "Brown Tide" in recent years. The water quality of the bays and Creeks has improved with its disappearance. We finally see some hope for the return of the once abundant mussel, scallop, oyster and crab populations in those bays and creeks .... not to mention the chance to once again harvest edible hard clams. However, it is my understanding that Goose, Jockey and Town Creeks, to name just a few, have been closed to shell fishing and that Corey Creekiis one of the few still open and unpolluted. The application appears to indicate that the floats and fingers will accommodate up to 14.boats. These 14 boats would be moored at the head of Corey Creek .... at one of its narrowest points i which has the least flushing action possible from tide changes. There is no doubt that boating activity creates pollution. I believe that 14 additional boats certainly cannot help but be detrimental to the delicate balance that keeps Corey Creek open to shell fishing. In my opinion, the approval of this project would set an undesirable precedent in Corey Creek. Specifically, the US Army Corps and the town of Southhold would be hard pressed to deny Laughing Waters request for a project to accommodate its residents boating needs. Laughing Waters shore line is at least 50 times that of Corey Creek Estates so conceivable they could request a similar project in the Creek, but their request would surly be for a larger one relative to its size and population. Fortunately~ in lieu of putting in an extensive float and finger system to accommodate all of their homeowners, they choose to maintain a boat slip waiting list. I'm not suggesting a total rejection of the application, everyone has the right, within reasonable perimeters, to enjoy public waterways. What I am suggesting is that the project be scaled down, say by 50%, in size and length. If this requires the residents to develop a boat slip waiting list, so be it. Perhaps this is a small step in reducing pollution, b~t a lot of small steps make for what amounts to a giant leap in a very worthwhile direction. ~'Michael F.
