BEING AND INTENDED TO BE a portion of the premises conveyed by deed dated
May 11, 1989, and recorded in the Office of the Clerk of the County of
Suffolk on May 17, 1989, in Liber 10858 at page 278.

roads abutting the above described premises to the center lines thereof,
TO(IET[IER with the appurtenances and all the estate and rights of the party of the first part in and to
mid premises,

successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

CONSENT
WE, the undersigned, being a majority of the Town Board of the Town of
Southold, Suffolk County, State of New York, having duly met at a regular
meeting of said Town Board on the 16th day of September, 1997, and having
duly considered the application o Neil Rego, dated the 14th day of May, 1997,
for the laying out of new highways in Southold, Town of Southold, to be known
as Chablis Path, Chardonnay Drive and Burgandy Court, and designated on a
certain map entitled "Map of Chardonnay Woods at Southold" situated at
Southold, Town of Southold, Suffolk County, New York, surveyed by Edward
A. I~ullock, Jr., Professional Land Surveyor and Engineer, and filed in the
Office of the Clerk of the County of Suffolk pursuant to Real Property Law
Section 335, do hereby consent that such laying out be made in accordance with
said petitioner.

Now therefore, in consideration of One Dollar ($1.00)
to us in hand paid by Raymond L. Jacobs, Superintendent of
Highways of said Town of Southold, and in further consideration
of laying out of the new highways known as Chablis Path,
Chardonnay Drive and Burgandy Court, do hereby release and
dedicate to the Town of Southold all the land heretofore
owned by us within said proposed highways as follows:
1. The highways are known as CHABLIS PATH, CHARDONNAY
DRIVE AND BURGANDY COURT, as shown and designated on a certain
map entitled "Map of Chardonnay Woods at Southold" situated
at North Southold, Town of Southold, Suffolk County, New York,
filed in the Office of the Clerk of County of Suffolk om
Septeraber 28,1989, as map ~ 8822.
2. And I do release the said Town of Southold from all
damages by reason of the layout of the said highways.

WRITTEN application having been duly made to me, the Town
Superintendent of Highways for the Town of Southold, Suffolk County, New
York, for the laying out of Town Highways in the said Town of Southold by Neil
Rego, liable to be assessed for Highway taxes in said Town, and a dedication
and release from damage have been executed, acknowledged and delivered by
the owners of the land through which the proposed highways are proposed to
be laid out, a copy of which is annexed hereto, and nothing having been paid
to any claim for such damages;
NOW THEREFORE, I, the Town Superintendent of Highways of the Town
of Southold, Suffolk County, New York, DO HEREBY DETERMINE AND ORDER
that the Town highways be and the same are hereby laid out at Southold, in
the Town of Southold as follows:

WHEREAS, Neil Rego has made application to the Town Board of the Town of
Southold to dedicate a certain road in Southold, known as Chablis Path, Chardonnay
Drive and Burgandy Court, designated on a certain map entitled "Map of Chardonnay
Woods at Southold", filed in the Office of the Clerk of the County of Suffolk on
September 28, 1989, as Map #8822; and
WHEREAS, the Southold Town Superintendent of Highways has inspected said
highways and has advised the Town Board that he determines and orders that said
highways shall be laid out in the Town; now, therefore, be it
RESOLVED that in accordance with Section 171 of the Highway Law of the State of
New York, consent be and the same is given to the Superintendent of Highways to
make an order laying out the aforesaid highways, to consist of lands described in
said application as shown on certain maps attached to said application and be it
FURTHER RESOLVED that the Town Clerk be and she hereby is authorized and
directed to forthwith cause the dedication, release, and deed to be recorded in the
Office of the Clerk of the County of Suffolk, New York.

papers are in order.
However, the deed is still unacceptable, since it transfers title to the open space,
as well as the roads. The Town normally requires the association to retain title to
and responsibility for the open space area, and no reason has been given why
this property should be treated differently. I suggest the deed be redone,
transferring title to the roads only. I assume you have been provided with the
appropriate recording fees.
Upon receipt of a revised deed, the papers could be forwarded to the Town

I have reviewed the documents submitted for the Chardonnay Woods road
dedication.
The title report is dated December 1996, and is thus somewhat out of date. If the
papers are not finalized within six months of the report, I believe we should have
an updated title report.
The title report indicates that title to the road is held by thirteen people, plus an
interest held by several mortgagees.

The application proposes to dedicate the open space owned by the Chardonnay
Woods Homeowners Association. In the past, the Town Board has declined to
accept the open space of a private subdivision. If the applicant wishes to pursue
the dedication, he should include a letter to the Town Board explaining why the
Town should accept ownership of the open space.
The deed proposes to transfer not only the roads, but the open space. Unless
the Town Board is persuaded to accept the open space, the deed will have to be
revised to eliminate those properties.
The application does not include the recording fees for the multiple dedication
and releases.
I suggest that these issues be addressed by the applicant before I forward the
papers to the Town Engineer for review.

ALL those pieces or parcels of land situate, lying and being at North Southold, Town of Southold,
County of Suffolk, State of New York shown as streets, roads, and/or road widenings on the
Described Map of Chardonnay Woods at Southold, filed in the Office of the Clerk of Suffolk County
on 28 September 1989 as Map No. 8822, being more particularly bounded and described as follows:
PARCEL 1 - ROAD WIDENING FOR SOUND VIEW AVENUE
BEGINNING at a point on the southerly boundary of Sound View Avenue, said point being 91.47 feet
westerly from the northwesterly terminus of the curve connecting the westerly boundary of Chablis
Path with the aforementioned southerly boundary of Sound View Avenue having a radius of 20.00
feet and an arc length of 31.42 feet, as shown of the aforementioned Described Map of Chardonnay
Woods at Southold.
THENCE from said point of beginning, westerly, continuing along the last mentioned boundary, as
widened, along the arc of a curve to the left having a radius of 987.00 feet, a chord beadng of
N. 78o46'50" W. and a chord distance of 282.43 feet for an arc length of 283.45 feet to a point.
THENCE easterly, along the last mentioned boundary, the following two (2) courses and distances:
1. S. 87°10'40" E., 142.75 feet to a point; and
2. S. 70023'00'' E., 142.75 feet to the point or place of beginning.
Containing 990 square feet or 0.023 acres.
PARCEL 2 - CHABUS PATH. CHARDONNAY DRIVE AND BURGANDY COURT
BEGINNING at a point on the Southerly boundary of Sound View Avenue, at the northwesterly
terminus of the curve connecting the westerly boundary of Chablis Path with the aforementioned
southerly boundary of Sound View Avenue as shown of the aforementioned Described Map of
Chardonnay Woods at Southold.
THENCE S. 70°23'00" E., from said point of beginning, along the last mentioned boundary as
extended across the aforementioned Chablis Path, 90.00 feet to a point at the northeasterly terminus
of the curve connecting the southerly boundary of Sound View Avenue with the easterly boundary

feet to a point of compound curvature at the northwesterly terminus of the curve connecting
the aforementioned easterly boundary with the northerly boundary of Chardonnay Ddve.
THENCE southeasterly along the arc of a curve to the left having a radius of 20.00 feet for an arc
length of 32.69 feet to a point of tangency on the last mentioned boundary.
THENCE easterly, along the last mentioned boundary, the following three [3] courses and distances:
