It would appear from the Town Records on Laserfische that many of the above referenced roads have already been dedicated to the Towns Highway Road system. If you would like an accounting of these recordings please let me know. With that said, all of the roads noted above have been maintained by the Highway Department for many years. These roads are in relatively good condition and therefore should be formally recorded and dedicated to the Town as Town Highway infrastructure. If it is easier to rededicate some of these road sections along with any other road segment that may not have been formally dedicated I would understand. At this time, I would recommend acceptance of the above referenced roads. If you have any questions concerning this report, please contact my office. nc ely, ames A. Richter, R.A. The problem of access occurred when the owner of the property on the southerly corner of Central Drive and Linda Road, Mr. Katos, planted a vegetable garden and shurbs in the right-of-way. He was asked by the adjoining property owners to cease, but has continued to use the public area for a garden over the past three years. Mr . Katos will be notified in writing that he has been encroaching on public property and to discontinue doing so. Dear Mr. Pell, This letter and the attached copies are in reference to the section of Central Drive west of the intersection of Central Drive and Linda Road. When Mr. Vreeland and I bought our property in 1962 the enly access was by Central Drive. It is so marked on the survey map. Both Lilco and N.Y. Telephone brought in service along this road .At that time we had requested the Town to place hard pan on the road and this was done.It was again done when wind blown sand frmm the Carlton property to the north made the road impassable. Several years later we relocated our access road to the south end of Linda Road. .We continued to use the Central Drive access, especially in winter because it was much shorter. During two severe winters several years ago this was our only access since the other road was impassable because of ice and snow drifts. Three years ago the owner of the property to the south of Central Drive extension, Mr. Katos, began to plant a garden.on the public road . I spoke to him and told him to stop destroying public property. I reminded him that this was a public road and our access. I also began calling on Mr. Dean to isk him to take care of this problem. The next year Mr. Katos began to do extensive digging and started to build a timber retaining wall to level the entire area. He also planted trees and bushes across the entrance at Linda Road . In the spring of 1981 Mr. Katos hired a local farmer to plow the entire area with a tractor.When I told the farmer that this was public property he stopped the plowing. Mr. Katos then dug up the entire area by hand . He also cut a 3 to 4 foot wall at the west end of Central Drive (which is our property line) . He also piled up brush and small trees at both ends of Central Drive extension. The entire area was then planted with vegetables etc. My wife and I then visited Mr. Deans office again and in his absence talked with his assistant. He told us that he was aware of the problem and ,could talk to Mr. Dean. I followed up this visit with a letter, dated !.lay 21, 1981, copy attached . P2 Some time later in a Mr. Dean, he told methathe was consideringpabandoning nthe1on roadlth and giving half each to the owners to the North and South. When I reminded Mr. Dean that this road was our access and right of way for Lilco and N. Y, telephone , Mr. Dean then indicated that the road could be split in three sections. He told me the choice was mine to make.and to let him know my decision. When I called back I spoke with Mr. Dean' s assistant and told him that I was against any abandonment or splitting the property in any way. I now find that this course of action is again proposed without notifying me and was to be acted on last week without my knowledge. This action would in effect prevent my access to my own land across public property which I have used for the past eighteen years. It would ignore the right of way of Lilco and the N. Y. Telephone and it would condone the continued illegal use of public property.by Mr. Katos. Furthermore, when in the future I should decide to sell the southern portion of my property, which extends to Ruth Road , then Central Drive agAin becomes my only acess. I consequently most strongly urge and request the board to vote to maintain this road as public property and to instruct the highway department to put the road back into usable condition by resurfacing with hard pan or equivalent. Simply, we desire to use this point of access and egress, particularly during bad weather, because our private dirt road becomes impassable at such times. Since we have not had the opportunity to present either the history, the facts, and our special concerns re: the request that this public access be maintained, we request that no negative decision be made by the town without public hearing. Dear Mr. Pell, This is in reference to the matter of Captain Kidd Tsstates,He: Central Drive. From our attendance at the town board meeting on Deo. 22, there appears to be a lack of information and possible mis-information available to board members. We are therefore writing you this letter to give as much detailed information as possible. First as to the description and status of the road_ in question: We bought this property in 1962. Our access was over Central Drive to a right-sof-way' that began at the Wills property line. Mr. Dean did extensive work, at our request, on Central Drive from the point at which it becomes a dirt road to the point at which it became a private right of way at the Wills property line. Our deeds, and our title insurance describe this road. Our survey maps show it clearly as a public road. The L.I.Lighting Co. and telephone company lines and easements are along this road, across the public portion to the Wills and Vreeland properties. This road was our only access to our properties for several years. We then decided to change our primary road to come off Linda using Central Drive only in the winter time, as the shortest distance to the main cleared roads. When we originally met with Mr. Dean, two years ago, he chocked his maps and said that this section of Central Drive was a town road. In October of this year, we checked with the Assessors Office of Southold and Mr. Jack Sherwood, with Mr. Gordon present, showed us the towns legal deed to Central Drive with its meets and bounds described. The records show that it was deeded to, and accepted by, the town of Southold, and is a legal road. The assessors indicated --to us that the town has a responsibility for, and must maintain all such public roads, presumeably upon request. At this same meeting, we asked the assessors if a town could give away or sell such a legally deeded road. The answer was that it would be a very difficult process, with legal notices necessary, eta. It was pointed out to us that town property belongs, not to the town, but to its people. Now, as to the current problem: Central Drive remained our primary access for fire, ambulance, and utility service vehicles, as well as a convenient entrance and exit when we wished to use it. Three years ago a neighbor planted a small garden ginhke Central Drive road y next to his house. His neighbors spoke to him, without any positive results, about his use of this public property. We decided, since his little garden was already in, to be good neighbors,to wait until the fall to do anything about it. In the fall we spoke to Mr. Dean. Mr. Dean assured us that (a) it was a public road, (b) that this man had no right to plant a garden on it, and (c) assured us that the highway department would see to it that the road was inspected and made useable as. soon as his equipment was available to do it. By spring, there had been no action, and this neighbor was again making gardening preparations. We again spoke to Mr. Dean's office and were again told that it would be talo oars of. That summer the entire roadway was turned into an extensive garden. He excavated 3 to 4 feet at the west end, regraded, planted trees and shrubs across Central Drive, and then added a fence, completely blocking off Central Drive. We again, as good neighbors, waited till after his harvest to again !granouyspeak to Mr. Dean. Weavers told that his highway dept. could take t the trees and brush with no difficulty, that Mr. %a.tos would be notified, and that the road would be put back into useable condition before the snows came. In the spring of 1981 we called Mr. Dean's office . We were becoming, obviously, more and more concerned that this problem had gone on so long without resolution. In May, 1981, we wrote a long letter to Mr. Dean.. We received no answer. In October, 1981, we went to see him in person. He again indicated that the work would be done soon. On Oct. 22, we called Mr, Dean, and were given the first ImAkeation (over this long period of several years) that there could be problems. He said that it would have to be referred to the Highway Committee. We informed Mr. Dean that we would take this matter to the office of the town supervisor, which we did on Oct. 23, where we were told that it . 'would be taken under advisement. We attended the town board meeting on Dec. 22, and were shocked to hear that the Board had plans for abandonment of this public road. We asked the Board to reconsider. We wish to re-iterate our position: 1. Central Drive has been in continuous use by us in the winter- time up to the point at which .it was appropriated for private use . 2. We need to use it so that we can walk over to our properties, and can park our cars on Central Drive in the winter. 3. We need it for protection- fire and ambulance- particularly since Mrs. Vreeland has multiple sclerosis and Mr. Vreeland has a heart condition. Central Drive is our closest entrance and exit, even though we have a long private dirt road as well off Linda, which becomes impassable in winter storms. 4. It is a legal road, surrounded completely by residences, and them providing the required 100 foot frontage on a road for one of her 5. The road now does require extensive work, but only because each season of delay has made matters worse. 6. Finally, it is not fair to us, as taxpayers, to lose the use of Central Drive as a legal road, because one person had decided to appropriate public property for private gain. We shall use whatever means are available to us to see that all due consider- ation is given to our interests and concerns, to see that our rights in this matter are preserved.
