LWRP DETERMINATION: This applicatipn was referred for review under Chapter 268,Waterfront.Consistency review of the"Town of_Sb .- uthold Town Code and the Local Waterfront Revitalization Program (L-WRP) Policy ; Standards. The LWRP Coordinator issued drecommendation dated December 13,2021. Based upon the.information provided.o 'the LWRP.Consistency Asse'ssnient Form submitted to this department,as well as:tlie records available, it is-recommended that the proposed action is:INCONSISTENT with LWRP policy standards since the"as-:built" structure was built without obtaining required permits, and therefore is-INCONSISTENT the LWRP. Iowever, the-pioposed additions and alterations have-a less iron-conforming side yard-setback than currently exists on.the property;and a building permit has been applied for by the applicant, so therefore, existing and proposed additions . and alterations can now be considered CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is. anon-conforming 2%, 14 square foot waterfront parcel located in'an R-40 Zoning District, The parcel runs 82.11 feet along Cutchogue Harbor,:mns.65'-feet along 'Iaywater•Road, runs 288:$1 feet on the Northwest side iind.277.43 feet onthe Southeast side. `The parcel is iinproved with a two-story'frame house;-a front deck, rear deck , and an outside:shower. All is„shown on:a survey by Johri Metzger L.L.S. dated March 18,2021. BASIS OF APPLICATION:' Request.forVariances from Sections 280- 124 and the Building.Inspector's August 13, 2021 Notice of Disapproval, based on an application fora permit to construct additions and alterations and to legalize an"as-built”rear deck addition to an existing single family dwelling;at 1)located less than the code required --minimum side yard setback of 15 feet;2)located less than the code required minimum combined side yard setback of-3 5 feet; located at 785 Fisherman's Beach Road,Cutchogue,NY SCTM# 1000-1.11-1-31. Page 2,January 20, 2022 #7581, Ganley SCTM.No. 1000-111-1-31 RELIEF REQUESTED: The applicant requests variances to legalize an"as-built"rear deck and make additions and alterations which includes additions fo the second floor that will have a side yard setback of 6 feet and a combined side yard setback of 14.1 feet..Town code requires a minimum side yard setback of 15 feet and a minimum combined side yard setback of 35 feet. ADDITIONAL INFORMATION: The applicant has provided.copies of prior variances.issued to-for this property: #2139,a subdivision creating two substandard lots,and#2239 relief to constriicta dwelling, with an insufficient side yard setback. The-applicant's representative indicated two prior comparable variances issued to neighboring property owners: Appeal No. 5597 located at 6.45 Haywaters Road for 11-foot side yard setback, and Appeal No. #7174 located'at 205 Fishermans Beach Road for.3 feet side yard setback and ..6-foot?combined side yard setback. The Board questioned a 7 ft.by 4 ft.shed and a-concrete slab situated on the parcel on the western property line, and the applicant agreed to remove both or place shed(s) in a conforming.location. An outdoor shower, shown on the . site plan as attached to the dwelling in the western side yard, did not received a Notice of Disapproval from the Building Inspector: FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning-Board of Appeals held a Public hearing on this application on January 6,2022 at which time written and oral evidence were presented. Based upon all testimony, documentation;personal inspection of the property and surrounding neighborhood, and other evidence, the Zdning-Board finds the following facts to be true and relevant and makes the following.findings; 1. Town Law 4267-b(3)(b)(1). Grant of the variances will notproduce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is a waterfront neighborhood that consists of single-family waterfront homes. The neighborhood is an older neighborhood that was developed prior to zoning and is currently being re-developed. The proposed additions and alterations are for legalizing an"as-built"deck that is open to-the sky and-for a second-floor addition. There:will no change to.the character of the.neighborhood.- 2. eighborhood._2. Town Law§267-b(3Nb)(2).-The benefit sought by the applicant cannot be achieved by some.method, feasible for the applicant to pursue; other-than an area variance. The existing house has'a non-conforming side yard setback and a non-conforming combined side yard"setback. Any additions and alterations will require the benefit of variance relief.' 3. Town Law 4267-b(3)(b)(3). The variances granted:herein for the side yard setback is mathematically substantial, representing60%o relief from the code.. The variance .granted'.herein_ for'the combined-side yard_ .setback• is mathematically substantial representing 60% relief from the code. However, both first floor set_backs are.existing and the proposed second floor addition will have a very.sligbtly:greater side yardsetback 4. .Town Law &267-b(3)(b)(4). No-evidence has.been.su .initted to suggest that a variance in this residential community will have an.adverse impact.on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code: 5. Town Law §267-b(3)(b)(5).. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had' actual or constructive knowledge_ of the limitations on the use of the parcel under the Zoning Code in.effect prior to or at the time.of purchase. Page 3, January 20, 2022 #7581, Ganley SCTM No. 1000-111-1-31 6. Town Law 5267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a deck and renovated dwelling while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Dantes, seconded by Member Acampora, and duly carried, to GRANT the variances as applied for and shown on the Site Plan dated July 23,2021 (Sheet S-1)and Architectural Plans Sheets Al-A8)dated June.24,2021,prepared by Mark Schwartz,Architect SUBJECT TO THE FOLLOWING CONDITIONS: 1.
