RESOLVED that the Southold Town Board of Trustees APPROVE the Administrative Amendment to Wetland Permit#10359 to eliminate to proposed 8'x12' spa and to modify the dimensions and configuration of the proposed deck and swimming pool to increase the minimum wetlands setback to the proposed deck from 65 to 76 feet, resulting in a proposed 1,507sq.ft. deck (in place of existing 732sq.ft. deck), and 12'x39' swimming pool; and as depicted on the survey prepared by Kenneth M. Woychuk Land Surveying, PLLC, last dated January 25, 2024, and stamped approved on February 14, 2024. Any other activity within 100' of the wetland boundary requires a permit from this office. Our concerns regarding this situation is that we now have a structure located within what is to be covenanted buffer area. Should this structure need repair in the future,would we be in violation of the Covenants and restrictions of the property?And further,would building the pool as approved by the Board be in violation of these future covenants? We respectfully ask for the Boards guidance in this matter in how we can resolve this issue. Please consider the idea of a re-allocation of the buffer area immediately surrounding the deck to elsewhere in the property,where the resulting buffer is devoid of any structure. Please also consider the reduction of the conditioned buffer to 12' (proximate to the proposed northeastern deck corner) to allow for pass and repass between the deck and the resulting buffer space.
