Box 152 Mattituck, NY 11952 RE: ANDREAS SERPANOS 19105 SOUNDVIEW AVENUE, SOUTHOLD SCTM# 1000-51-1-17 Dear Mr. Portillo: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, March 15, 2023 regarding the above matter: WHEREAS, AMP Architecture, on behalf of ANDREAS SERPANOS applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated January 6, 2023, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on March 15, 2023, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, 2 WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of ANDREAS SERPANOS to construct a 14'x35' (490sq.ft.) in-ground swimming pool with spa; install a proposed 4' x 37.6' x 19.8' x 8.10' (320sq.ft.) stone pool patio; install a proposed 8' pool drywell and pool equipment area; install 300 linear feet of pool enclosure fencing with gates; with the condition to install and perpetually maintain a 15' wide native vegetated non-turf buffer along the landward edge of the top of the bluff; and to remove the fence at top of bluff; and as depicted on the revised site plan prepared by Anthony M. Portillo, RA, dated May 19, 2023, and stamped approved on May 23, 2023. Permit to construct and complete project will expire two years from the date the permit is signed. SCTM#1000-51-1-17. The proposed construction,on this non-conforming 29,280 square foot parcel(18,129 square foot buildable land)in the Residential R-40 Zoning District is not permitted pursuant to Article XXII. Section 280-116A(1).Which states:"all buildings or structures located on lots upon which there exists a bluff landward of the shore or beach shall be set back not fewer than 100 feet from the top of such bluff." The site plan shows the construction at 71.9 feet from the top of the bluff. ADDITIONAL INFORMATION: The Zoning Board has not received any correspondence or heard any testimony from neighbors with regard to this application. The Site Plan drawings prepared by Anthony M. Portillo,Architect and dated September 30,2022, show the proposed in-ground pool located and a proposed 10-foot-wide sand buffer to be installed along the entire top of the bluff. The drawings include the location of the proposed drywell for pool dewatering, an enclosure for the proposed pool equipment on the westerly side of the home, and a 300 linear foot fence parallel to the top of the bluff. A large tree in the rear yard will have to be removed for the installation of the pool. On February 7,2023 the Board received an amended site plan from Anthony Portillo,Architect, changing the proposed 10-foot-wide sand buffer to a 10 foot wide vegetated buffer along the entire top of the bluff FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 2,2023,at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. There are other homes within the community that have in-ground pools that do not meet the code required minimum 100 foot bluff setback. . Even though this is a waterfront neighborhood, in-ground pools are not common in an alternative code conforming front yard. The rear yard where the pool is proposed is screened from other adjacent properties by a 6-foot-high solid wood fence 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method,feasible for the applicant to pursue,other than an area variance.The proposed rear yard location for the in-ground pool is the only location feasible for this parcel because a well and a large gravel driveway are located in the front yard; the westerly side yard is too narrow to locate an inground pool and the easterly side yard contains the existing septic system. Although the applicant could install a narrower lap pool or reduce the size of the existing deck to create a greater bluff setback,the as built seaward deck is located at 90.9 feet from the top of the bluff with a Certificate of Occupancy (No. Z10566 dated July 9, 1981) and the proposed pool width of 14 feet is not excessively wide for standard pool dimensions 3. Town Law✓Z267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 28.1%relief from the code. However, the toe pf the bluff is protected by a rock revetment and the topography of the rear yard slopes away from the bluff and toward the dwelling which will reduce runoff that could cause erosion of the bluff. Moreover,the applicant must abide by any conditions imposed by the Southold Town Board of Trustees to mitigate the non-conforming bluff setback. 4. Town Law V67-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town'Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an in-ground swimming pool with spa while preserving and protecting the character -of the neighborhood and the health,safety and welfare of the community.
