RAVN, DANIELLA C. RAVN, PATRICK FLANAGAN, EVA FLANAGAN & MORTON D. DUBIN II applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance, application dated January 10, 2023; and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed applications be found Inconsistent with the LWRP, and specifically Inconsistent with the following coastal policies: Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem. Policy 6.3 Protect and restore tidal and freshwater wetlands. Policy 9.3 Preserve the public interest in and use of lands and waters held in public trust by the State and Town of Southold; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on March 15, 2023, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the structure, as applied for does not comply with the standards set forth in Southold Town Code Chapter 275-12. Standards for Issuance of Permit. A. Adversely affect the wetlands of the Town; B. Cause damage from erosion, turbidity or siltation; D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vegetation or the natural habitat thereof, E. Increase the danger of flood and storm- tide damage; F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the Town; G. Change the course of any channel or the natural movement or flow of any waters; J. Adversely affect the aesthetic value of the wetland and adjacent areas; and WHEREAS, the Board has determined that the request, as applied for, will have a detrimental effect upon the health, safety and general welfare of the people of the town, and, adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the Town; and WHEREAS, the Board has determined that the request, as applied for, will have a detrimental effect upon the health, safety and general welfare of the people of the town, and BE IT FURTHER RESOLVED that the Board of Trustees DENIES based on no action the application of STEPHEN E. RAVN, DANIELLA C. RAVN, PATRICK FLANAGAN, EVA FLANAGAN & MORTON D. DUBIN II to construct a fixed docking facility consisting of a landward 4'x2.2'x2.2'x4' trapezoidal landing (8.8sq.ft.) to 4'x4' steps with four (4) treads and five (5) risers (16sq.ft.) leading to a 4'x126' fixed dock with staircase (504sq.ft.), raised a minimum of 4' above wetlands and a continuous railing set at 3' on the landward side; the decking shall be composed of Thru-Flow continuous; the first 56' of dock to be supported with 4" square green-heart pilings (24) set at 8' on-center and cross braced; the remaining 70' of walkway to be supported with 8" diameter pilings at 8' on-center; construct three (3) 4'x24' fixed docks (288sq_ft.) off of 70' section of dock using Thru-Flow decking, 39-8" diameter pilings and one five-step float aluminum dock ladders on each dock; total area of fixed dock is 792sq.ft; and as depicted on the site plan prepared by Michael A. Kimack, last dated October 8, 2022. This is not a determination from any other agency. (6) Declarant shall not apply and use synthetic pesticides and fertilizers capable of entering surface and potable water supply. (7) Declarant shall use pervious driveways to serve each lot. (8) The Declarant covenants that a 54 foot Non Disturbance/non-fertilization Vegetation buffer area is depicted on Lots 1, 2 and 3 . It is hereby understood that the 50 foot Non Disturbance/non-fertilization Vegetation buffer area is intended to preserve the existing trees and natural growth. Vegetation within this area shall remain in its natural state in perpetuity. Permitted activities within the buffer are limited to the removal of dead, diseased trees that are hazardous to life or property. Notwithstanding the above, the Non Disturbance/non-fertilization Vegetation buffer area may be supplemented with additional native vegetation subject to review and approval of the Southold Town Planning Board and Southold Town Trustees pursuant to Town Code 275-3 . (9) There shall be no disturbance of any kind (i.e. mowing, clearing, grading) within the 50 foot Non Disturbance/non- fertilization Vegetation buffer area, except as provided herein. This includes, but is not limited to, the prohibition of structures or clearing of any kind, except to establish a 4 foot wide unimproved, natural access path located within the 10 foot pedestrian access easement on Lot 3 . Pursuant to Chapter 275 Wetlands and Shorelines; the access path must be reviewed by the Southold Town Trustees and other jurisdictional agencies. No grading or changes to the natural contours of the land shall be permitted within this area. (10) Landward of the 50 foot buffer, shown on the filed map , he fir Declarant is permitted to undertake seasonal mowing (farm cut) to control seasonal growth of such noxious plants as briers and poison ivy. As stated in Clause 9 above, this 50 foot buffer is to remain in an "undisturbed buffer" , therefore mowing, clearing or grading is not a permitted activity. (11) The Declarant covenants to retain all marked existing trees on-site to comply with Section 161-44 . Street trees of the Southold Town Code, as indicated by the attached aerial, dated October 29, 2008 and agreed upon by the Declarant and the Southold Town Planning Board. The attached aerial, dated October 29, 2008 (Schedule. B) indicates the location of both individual trees and clusters of trees both on the property and along the perimeter of the property on State Route 25 and Wells Road. The trees consist of the following species : Birch, Cherry, Norway Maple, Red Cedar and Red Maple . Clearing of the trees or any action made to cause the death of the mapped trees is prohibited. The Declarant further covenants that once the existing trees naturally expire, they shall be replaced with the same or similar species to comply with the Southold Town Code Section 161 .44 . (12) Prior to issuance of a certificate of occupancy, the respective owners of lot 2 and 3 shall plant their respective portion of a "Planted Cluster" , as shown on the filed map, which is intended to mitigate the visual impacts of the new home along Wells Road. There shall be a 60 foot wide landscaped buffer planted with native vegetation located on lot 1 adjacent to New York State route 25. The buffer shall run north to south along the i western property line of Lot 1 for a distance of 150 feet in length. (13) Declarant grants the continuing right in perpetuity to the Town of Southold, any of its designated representatives or any owner of property within the subdivision to enforce the conditions and restrictions of the covenants and to take any legal action it deems necessary to enforce the conditions and restrictions of the covenants . These rights of inspection and enforcement shall be binding upon declarant, their heirs, executors, legal representatives, distributees, successors, assigns and transferees. (14) Pursuant to chapter 240-49 of the Southold Town Code, clearing of each lot shall be restricted to 350 of the total land area. (15) There shall be no further subdivision of any lots in perpetuity. (16)There shall be no changes to the lot lines without Planning Board approval. DUBIN II The proposed action is located within a New York State Department of State Significant Fish and Wildlife Habitat Area, a New York State Critical Environmental Area and a Peconic Estuary Critical Natural Resource Area. DUBIN II requests a Wetland Permit to construct a fixed docking facility consisting of a landward 4'x2.2'x2.2'x4' trapezoidal landing (8.8sq.ft.) to 4'x4' steps with four (4) treads and five (5) risers (16sq.ft.) leading to a 4'x126' fixed dock with staircase (504sq.ft.), raised a minimum of 4' above wetlands and a continuous railing set at 3' on the landward side; the decking shall be composed of Thru-Flow continuous; the first 56' of dock to be supported with 4" square green-heart pilings (24) set at 8' on-center and cross braced; the remaining 70' of walkway to be supported with 8" diameter pilings at 8' on-center; construct three (3) 4'x24' fixed docks (288sq.ft.) off of 70' section of dock using Thru-Flow decking, 39-8" diameter pilings and one five-step float aluminum dock ladders on each dock; total area of fixed dock is 792sq.ft. Located: End of 10' Right-of Way at 625 Wells Road, Peconic (Dominant), 325 Wells Road, Peconic (Servient) & 75 Wells Road, Peconic (Servient). SCTM# 1000-75-6-3.3 (Dominant), 1000-75-6-3.2 (Servient) & 1000-75-6-3.1 (Servient) The proposal includes a C&R that outlines the right for each declarant to moor TWO boats. Five declarants have singed the C&R's which means a total of TEN boats could be moored at the dock. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP. This parcel was created in the Standard Subdivision of John Scott SCTM#1000 75.-6-3 Due to the environmental sensitivity of Richmond Creek, the Planning Board required certain protective clauses (8, 9, and 10) filed in a Covenant and Restriction. The etremei shallow water in the upper reach of the creek caused the Planning Board to locate common access on Lot 3. Access to the creek does not imply that a dock should or can be constructed in the future. (8) The Declarant covenants that a 50 foot Non Disturbance/non-fertilization Vegetation buffer area is depicted on Lots 1, 2 and 3. It is hereby understood that the 50 foot Non Disturbance/non-fertilization Vegetation buffer area is intended to preserve the existing trees and natural growth. Vegetation within this area shall remain in its natural state in perpetuity. Permitted activities within the buffer are limited to the removal of dead, diseased trees that are hazardous to life or property. Notwithstanding the above, the Non Disturbance/non-fertilization Vegetation buffer area may be supplemented with additional native vegetation subject to review and approval of the Southold Town Planning Board and Southold Town Trustees pursuant to Town Code 275-3. (9) There shall be no disturbance of any kind (i.e. mowing, clearing, grading) within the 50 foot Non Disturbance/non- fertilization Vegetation buffer area, except as provided herein. This includes, but is not limited to, the prohibition of structures or clearing of any kind, except to establish a 4 foot wide unimproved, natural access path located within the 10 foot pedestrian access easement on Lot 3. Pursuant to Chapter 275 Wetlands and Shorelines; the access path must be reviewed by the Southold Town Trustees and other jurisdictional agencies. No grading or changes to the natural contours of the land shall be permitted within this area. (10) Landward of the 50 foot buffer, shown on the filed map6,, he Declarant is permitted to undertake seasonal mowing (farm cut) to control seasonal growth of such noxious plants as briers and poison ivy. As stated in Clause 9 above, this 50 foot buffer is to remain in an "undisturbed buffer", therefore mowing, clearing or grading is not a permitted activity. Locating a dock in this area is INCONSISTENT with LWRP policies: Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem 6.3 Protect and restore tidal and freshwater wetlands. The proposed action is located within a New York State Critical Environmental Area. At the discretion of the Board of Trustees, any operations proposed in critical environmental areas (§ 275-2) may be subject to more stringent requirements than detailed in this section. Such requirements may include, but are not limited to, denial of certain operations, shortening or reducing the size of structures, and increasing the width of non-disturbance buffers. The water depth is shallow and will not support motorized vessels. The tidal notes shown on the plan are confusing and not calibrated to a specific location on the plan. They may be as old as 2009. The tidal period for the soundings is not identified. The proposed construction of a dock in an ecologically sensitive New York State Critical Environmental Area with no to highly restricted navigability during tidal regimes is unsupported. Siting docks in areas where water depth cannot support the use of a motorized vessel can lead to adverse impacts on benthic communities, including bottom scarring from propeller contact and species injury. Turbidity also increases in these situations. Richmond Creek water quality shows evidence of decline due to anthropogenic influences. Algal blooms that are harmful to shellfish and fish species have been known to occur in the upper reach of the water bodies more frequently. Docks alter the tidal flow, and marine species' habitat and introduce pollutants in low-flushing areas. A net loss in public use of waterways is expected as a result of a dock in/on public waterways. There is a high probability that commercially valuable shellfish species occur in the proposed location of the dock structure. These natural resources will be adversely impacted by the construction of a dock and the operation of a motorized vessel in shallow water depth areas. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of Potential adverse iris acts of the proposed use, structure, or facility on public interest in public lands underwater. The proposed dock structure has the ability to result in potential adverse impacts to high-quality tidal wetlands and marine waters by construction and use in an area with inadequate water levels to support a motorized vessel, irrespective of the tides. Richmond Creek has no definitive channel for motorized vessels. The construction of this proposed, private residential dock structure in public trust lands and/or waters would result in a net loss of public use of such waters and adverse impacts (repetitive) over long duration, due to: 1. Inadequate water depth to safely operate a vessel; 2. impact on navigation affecting other user groups (recreational) on the public waterbody; 3. impact on marine species habitat due to inadequate water depths and potential bottom scarring from the operation of a vessel; 4. impact on water quality from inadequate water depth and the potential repeated suspension of sediments through the operation of a vessel and the harming and loss of benthic marine life; 5. impact on water quality through the introduction of manmade materials; 6. impact through the interruption of tidal flow in the upper reach of this creek; and 7. Potential adverse impacts to high-quality tidal wetlands.
