The undersigned petitioners, JOHN A. BERTANI, WILLIAM WALTERS and
ANTHONY PAGOTO, c/o 1380 Oakwood Avenue, Southold, New York 11971, as
owner of"BROOK LANE" and "D~qAGE AREA", liable to be assessed for highway
taxes in the Town of Southold, hereby apply to the Town SuperinteCdent of Highways to
lay out new highways at Bayview, Town of Southold, County of Suffolk and State of New
York as follows:
The highways known as "BROOK LANE" and "DRAINAGE AREA", as
shown and designated on certain map entitled "Map of Reydon Court", situate
at Bayview, Town of Southold, Suffolk County, New york, surveyed by
Young & Young, and filed in the Office of the County o? Suffolk on
September 17, 1987 asMap No. 8395.
A map of said proposed highways has been made by Youngi& Young,
Professionai Engineers and Land Surveyors, and are annexed heretq and made a part of
the Application, together with a Release and Dedication to the Town of Southold by the
petitioners herein, over whose property said highways are to run.

NOW, THEREFORE, in consideration of One (SE00) Dollar to us in hand paid by
Raymond L. Jacobs, Superintendent of Highways of said Town of ~outhold, and in further
consideration of laying out of new highways known as "BROOK LANE" and
"DRAINAGE AREA" do hereby release and dedicate to the Town 0f Southold all the
land heretofore owned by us within said proposed highways as follows:
The highways known as "BROOK LANE" and "DRAINAGE AREA", as
shown and designated, on certain map entitled "Map of Reydon Court", situate
at Bayview, Town of Southold, Suffolk County, New YOrk, filed in the Office
of the Clerk of the County of Suffolk on September 17, 1987 as Map No.
8395.
And we do release the said Town of Southold from ail damages by reason of the
layout out of the said highways.

Any grantor or grantee failing to file a return or to pay any tax within the Daiiy compounded interest wiii be charged on the arno,., ' *
time required shall be subject to a penalty of 10% of the amount of tax due the tax due not paid within the time required.
plus an interest penalty of 2% of such amount for each month of delay or
fraction thereof after the expiration of the fimt month after such return was
required to be filed or the tax became due. However, the interest penalty
shall not exceed 25% in the aggregate.

RESOLVED that in accordance with Section 171 of the Highway Law of the
State of New York, consent be and the same is hereby given to the
Superintendent of Highways to make an order laying out the aforesaid

As per your request, 1 have completed the final inspection of the above referenced
subdivision. Brook Lane consists cfa short road that begins on the south side of Reydon
Drive. This road has a fifty (50') foot Right-of-Way and it eXtends approximately two
hundred fifty (250') feet in a southerly direction terminating in a Cul-De-Sac.
The drainage for the road consists of catch basins, leaching pools and drainage
pipes that divert overflow runoff into a drainage area within the existing open space, As
per my last inspection, the only remaining item required for dedication was the guarantee
that the necessary easements for maintenance of the drainage pipe and sump area were
in place. This item has now been submitted by the applicant and the required easements
are in the process of being filed with the County.
At this time, all road improvements have been completed in a satisfactory manner
and Brook Lane meets the minimum requirements listed in the Highway' Specifications.

Inspector have reviewed the papers for the Reydon Court road dedication,
and there are several items that ~ust be addressed:
1. The dedication includes both Br(~ok Lane and Drainage Area as
shown on the map. However, the title search is only for Brook Lane, there
is no reference to who has title to the drainage area. Superintendent of
Highways Jacobs has advised me he wishes the drainage area to be
dedicated to the Town, therefore, we must have an updated title search.
2. Between Brook Lane and the Drainage Are~ there should be
easements across Lots 5 and 6.
3. Engineering Inspector Richter has requested a Final Road and
Drainage Plan. He found a copy in the Planning Board office, listed under
Bayview Grove, surveyed by Young & Young. If you have a question on
this, please contact Jamie Richter at 765-3070.

I have reviewed the papers submitted for this road dedication. The following
issues need to be addressed before I can approve these papers.
1 ) The town usually leaves the drainage basins located in common area in the
ownership and under the maintenance of the property owners association. I've
asked Jamie Richter to review the survey and decide if the town wishes to have
any interest in the drainage basin, and if so, whether it should be an easement
or fee tit~e.
2) The dedication includes both Brook Lane and Drainage Area as shown on the
map. The title search is only for Brook Lane, showing Pagato, Bertani and
Walters as owners. The title report doesn't show and I don't know who has title
to the drainage area. If the drainage area is to be deeded, I need a title report for
that area.

3) There is no drainage area designated on the Reydon Court map. There is a
designation for "grading and drainage easement for storm water overflow." This
suggests that only an easement, not fee title, should be conveyed. It is also
unclear what area should be covered, just the drainage basin or the access or
both.
Depending on whether the town wishes to take title to the drainage easement,
either need revised documents dedicating only the road, or a revised survey and
title report clearly indicating the drainage area to be dedicated.

Dear Ray:
As per your request, I have completed the final inspection of the above referenced
subdivision. Brook Lane consists of a short road that begins on the south side of Reydon
Drive. This road has a fifty (50') foot Right-of-Way and it extends approximately two
hundred fifty (250') feet in a southerly direction terminating in a Cul-De-Sac.
The drainage for the road consists of catch basins, leaching pools and drainage
pipes that divert overflow runoff into a drainage area within the existing open space. As
per my last inspection, the only remaining item required for dedication was the guarantee
that the necessary easements for maintenance of the drainage pipe and sump area were
in place. This item has now been submitted by the applicant and the required easements
are in the process of being filed with the County.
At this time, all road improvements have been completed in a satisfactory manner
and Brook Lane meets the minimum requirements listed in the Highway Specifications.

Dear Mr. Bruer:
Enclosed please find an executed RP-5217 (Real Property Transfer
Report) and TP-584 (Combined Real Estate Transfer Tax Return and Credit Line
Mortgage Certificate) for the above-referenced parcel with respect to a ten (10)
ft. easement from Brook Lane to the specified drainage area.
The above-referenced documents were executed by Jean W. Cochran as
Supervisor and I believe they are necessary for filing of the easement from
Ernest V. Lazio Jr. and Carmela Lazio to the Town of Southold. I also enclose a
certified copy of the resolution of the Town Board of the Town of Southold
whereby the Town accepts said drainage easement from the Lazios as well as a
copy of the deed granting the easement. I believe the original deed is still in your
possession for filing. Once the deed is filed, please forward a copy of the
recorded deed.
