De~rR6b, The Southold Town Board of Trustees reviewed the survey dated and received in our office on July 1, 1998 and determined that your proposal to construct a house and retaining wall to be out of the Trustee Wetland jurisdiction under Chapter 97 of the Town Code. However, any activity within 75' of the Wetland line requires a permit from this office. This determination is not a determination from any other agency. NON-JURISDICTION REQUEST As we discussed, please find enclosed (2) Prints of the site plan for Fred Rapp, which indicates the break between the existing concrete wall and the proposed timber wall at its southerly terminus. Specifically, the proposed wall will be located approximately 95' from the existing bulkhead/AHW. Therefore, I expect that a letter of non-iUrisdiction can be issued promptly for the proposed upland work. Thank you for your attention to this matter. Robert E. For your reference I have included photographs of the property including the upland work site and the bulkhead. By way of this correspondence, I respectfully request that you issue a letter of non- jurisdiction for the project.
