Dear Board of Trustees:
I am writing to request a pre-submission inspection of my property to discuss with you
my plan to replace the pre-existing ramp and dock destroyed by last winter's storms.
As you can see in the enclosed papers, the propeay is a bayfront bulkheaded lot in New
Suffolk, at 20 Third Street, #1000-117-10-19. Both the ramp and the supporting poles
for the dock were destroyed by the April 16, 2007 nor'easter, following the ice advance
on the beach in March.
The ramp from the bulkhead to the beach was a fixed installation dating, as far as I know,
from the end of World War II, when Todd Pugsley converted the building and property to
a fishing station for his son Jim to operate (therefore named "Capt. Jim's"). The fishing
station was in operation for more than 33 years and the ramp was necessary to haul the
rowboats down to the beach and back up. It had remained intact until the recent storms.
My husband Newt Robbins converted the building to a seasonal rental cottage in 1984,
and it has been rented as such ever since.
The 1965 title search shows both the ramp and the dock. The dock may have been
permanent in the first decades of the fishing station, but my husband in recent years took
in the boards every winter to prevent storm damage. He had a system of wooden cross
pieces bolted to the poles, with long planks then bolted to those pieces. The neighbors
helped him in the process every spring and fall (and still groan at the mention of it). This
sufficed until this past winter when both end poles were broken or swept away, one by
the ice and the other by the storm, as the pictures show.
My husband died in June of this year and I am engaged in selling the property. The
prospective buyer wants me, as the current owner, to start, and if possible complete, the
process of applying for whatever replacements may be allowed. I have agreed to do so.
The enclosed papers document the age of the fixtures, their use, and the recent
destruction.

I am anxious to finalize a comract for the sale, and I would greatly appreciate your
scheduling an inspection to meet with me as soon as possible. As I realize the permit
process is involved and lengthy, I am prepared to ask En-Consultants, who helped us with
the bulkhead permits in 1996 (permit # 4698), to assist me with whatever is necessary.

Dear Mr. Robbins:
On December 3, 1996, the New York District, U.S. Army Corps
of Engineers, received a request for Department of the Army
authorization to replace 91 linear feet of timber bulkhead within
18 inches of an existing bulkhead, place 10 cubic yards of
attendant backfill to be trucked in from an upland location and
replace a 20 foot return, a 4 foot by 5 foot set of steps and a 5
foot by 12 foot inclined boat ramp. All work would occur
landward of the spring high tide line of Great Peconic Bay at New
Suffolk, Town of Southold, Suffolk County, New York.
Our review indicates that the proposed work does not appear
to include dredging or construction activities in or over any
navigable waters of the United States, the placement of any
dredged or fill material in any waters of the United States
(including coastal or inland wetlands) or the accomplishment of
any work affecting the course, location, condition or capacity of
such areas. Therefore, a Department of the Army permit will not
be required.
Care should be taken so that any fill or construction
materials, including debris, do not enter the waterway to become
a drift or pollution hazard. You are to contact appropriate
state and local government officials to ensure that the subject
work is performed in compliance with their requirements.
If any questions should arise concerning this matter, please

during its regular meeting held on Januazy 29, 1997 regar~gng
the above matter:
WHEP~AS, En-Constuttants on behalf of NEWTON ROBBINS appliedto
the Southold Town Trustees for a permit under the provisions of
the Wetland Ordinance of the Town of Southotd, ap~licatiQn dated
December 19, 1996, and,
WHEREAS, said application was relented to the Southold Town
Conservati0~ Advisory Council for their findings and
recon~endations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on January 29, 1997, at which time
all interested personswere given an opportunity'to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the s~rrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure c~mpties with the standard set forth in
Chapter 37-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not a~fect the health, safety and general welfare of the
people of the town,

RESOLVED~ that the Board of Trustees grant a Wetland Permit to
replace (within 18") 91 t.f. of timber bulkhead and backfill
with 10 c.y. of clean fill, remove and replace 20' return on
west side on to applicants propelL~, remote anti replace steps
and 5' X 12' inclined boat ramp, and,

Ail repairs to existing structures are confined to
replacement o~ existing structural elements with no
change in design, dimension or materials unless specif-
ically authorized herein.
Any bulkhead constructed directly adjacent to vegetated
tidal wetlands must be jetted in with minimal distur-
bance to tidal wetlsL~ds. Trenching is strictly prohib-
ited.
Construction of bulk/mead and return walls must be
completed prior to placement of any fill materials
behind such structures.
The new bulkhead shall be constructed within a maximum
of 18" seaward of the st~--ucture, measured from face of
old sheathing to face of new sheathing (as shown on the
approved x-section).
All fill must consist of clean rock,
soil. Use of asphalt, slag, fly ash,
or demolition debris is prohibited.'

Ail fill must be graded to match the elevation of the
land immediately adjacent to the bulkhead.
Any debris or excess material from construction of this
project must be immediately and completely removed from
the adjacent area and disposed of at an upland site.
Disposal of debris in tidal wetlands is prohibited.
Dredging
Dredged materials must be placed directly behind the
bulkhead or into the conveyance vehicle. Side-casting
or temporary storage of dredge materials is prohibited.
Uredged material not used as backfill must be disposed
of at an upland site, and suitably retained to prevent
it from reentering any waterbody.

(b) be placed so that docked boats extend over property

board walk is limited to a maximum width of six (6)
feet. The path or boardwalk itself is limited to a
maximum width of four (4) feet.

Recreational Rivers Permits:
A copy of this permit, including all conditions and
approved plans, shall be available aC the project site
whenever authorized work is in progress. The per,:it
sign enclosed with t. he permit shall be protected from
the weather and posted in a conspicuous location aC the
work site until all authorized work has been completed.
The permittee shall require that any contractor,
project engineer, or other person responsible for the
overall supervision of this project reads, L~ndersta/~dS,.
and complies wi~h this permit and all its general,
special, and supplementa_~y special conditions. Any
,failure to comply precisely with all of the eel-ms and
conditions of this permit, unless authorized in
writing, shall be treated as a violation of the
Environmental Consel~ration Law. If any of the pel-mit
conditions are unclear, the pe_~mit~ee shall contact the
Division of Regulatory Affm~rs a= the address on page
one or telephone (5!6) 444-0365.
'If project design modifications become necessary after
permit issuance, ~he permit~ee shall submit the
appropriate plan changes for approval by the Regional
Permit Administrator prior ~0 under~aking any such
modifications. The pe_~-mittee is advised that
substantial modification may require submission of a
new application for permit.
At least 48 hours prior to commencement of the project,
the permittee and contractor shall sign and return the
top portion of the enclosed notification form
certifying that they are fully aware of and u/%derst~nd
all terms and conditions of this permit. Within 30
days of completion of t.he peL-mitted work, the bottom
portion of that form shall also be signed and returned,
along with photographs of the completed work and, if
required, a survey.
For projects involving activities to be undertaken in
phases over a period of more than one year, the
permittee shall notify the Regional Permit
Administrator in writing at least 48 hours prior to
reco~enoing work in subsequent years.
The granting of this permit does not relieve the permittee
of ~he responsibility of obtaining a grant, easement, or
other necessary approval from ~_he Division of Land
Utilization,' office of General Se-~-vices, Tower Building,
E~pire State Plaza, Albany, t~Y 12242 (5!~) 474-2195, which
may be required for any encroacb_~ent upon State-owned lands
underwater.

Conservation Advisory'Council held Friday. January 17, 7997:

WITH STIPULATIONS of the Wetland Application of NEYfrON ROBBINS
117-10-19 replace (within 18") 91 linear feet of timber bulkhead and backfill
with 10 cubic yards of clean fill to be trucked inform upland source; remove
and replace 20' return on west side; construct new 20' return on east side;
removed and replace L~' x 5' steps and 5~ x 12~ inclined boat ramp.
The Council recommends approval with the stipulation that there be a 10'
non-turf buffer behind the bulkhead.
