tremendous la& of knowledge, experience, and educatioa in design and comtm~on of groins, principally
by go~rnmemal agencies, who prohibit the oonmction of groins. Since 1970, ~ have not be~z able to
build ext~rimental groins, With over 20 major variables effecting the design of groins, rye must nmke
further stu~es as mentioned ia my article. This generation ggm~-am<tat officials bas been
by the environmantal educators that groins are nO good, The7 have published oreO' data on groins that
have not been effected and have never made any sludies on groins that have been eff-ecti~ arat working.

Dear Mr. Geideman:
Pursuant to 15 CFR 930.58, the following data and information is necessary to enable t~e
Depmhnent of State to adequately assess the coastal zone effects of this proposed project.
Please provide photographs which document existing site conditions and upon wh/ch the
location of the groins is outlined. Please compare the length of the proposed groh~s to those
along the adjacent shore. New groins exceeding the length of existing groins are lilly to
starve downdrLft areas of sand. In accordance with New York State Coastal Management
Program Policy #14 (policies enclosed), please discuss and analyze the effects, if any, of the
proposed groin replacements upon the ~/ttoral transport of sediment to adjacent shorelands.
For example, the submitted drawing indicates that the updrift cells of the groins aright need
to be filled. You should provide information indicating what effect tiffs filling might have
on the adjacent shorel/ne and how much material would be required to fill_ these cells. Also
please describe the extent of the erosion that has occurred in the last two years during which
the groins were not functional.
Pursuant to 15 CFR 930.60(a), the review of your consistency cen/ficafion will begh~ afte~

Dear Mr. Geideman:
We have reviewed the additional information you submitted on
April 3, 1996, which includes a second application under the name
of John Manning. We have determined that since t~'~ pr6~ects
would be appropriate to treat both as one permit action.
The proposed work appears permissible under Department of the
Army Nationwide Permit No. 3 based upon your representation that
storm damage has occurred within the past two years. However,
since you indicate some of the damage occurred greater than one
year ago; project-specific Coastal Zone Management (CZM)
concurrences will be necessary from the New York State Department
of State (NYSDOS). This is beCause they have imposed a regional
condition on Nationwide Permit No. 3 which limits repairs from
storm damage to that which has occurred within one year of the date
of'~such event. It is therefore recommended that you submit a
completed Federal Consistency Assessment Form to NYSDOS.
Once NYSDOS concurs that the proposals are consistent with the
CZM Program of the State of New York, we expect to be able to
confirm nationwide permit applicability. By copy of this letter,
we are informing NYSDOS of our intentions in this matter. If you

Dear Mr. Geideman:
The following action was taken by the Board of Town Trustees
during its regular meeting held on May 22, 1996 regarding the
above matter:
WHEREAS, John Geideman on behalf of JAMES MANNING applied to the
Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated
March 25, 1996, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on May 22, i996, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board me~ers have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considared all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as'proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW TFIEREEOREBE IT,
RESOLVED, that the Board of Trustees grant a Wetland Permit to
replace 2 existing 110' groins as per drawing 5/14/96, and,
BE IT FURT~EKRESOLVED that this determination should not be
considered a determination made for any other Department or
-Agency which may alse have an application pending for the same
or similar project.
Permit to construct project will expire two years from the date
it is signed. Fees must be paid, if applics]~le, and permit
issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified
upon completion of said pro~ect.

construct a timber dock consisting of a 3' x 95' fixed elevated (~' above grade
of marsh) walk; 32" x 20' hinged ramp; 6' x 20' float secured by (2) 2 pile
dolphins.
The Council recommends approval provided the dock does not exceed the
neighbor's dock to the west nor interfere with navigation.

storms, removing same and construction four new ones each 110' long from foot
of upland bank.
The Council normally does not recommend approval of groins however, it
recommends approval for this project because it is an improvement over the
current situation:
1. The high profile groins are being replaced by ~ow profile groins.
2. Reducing the number of groins from five (5) to four (~).
