They are requiring that a depdsition basin be created as a method of decreasing the amount of future maintenance dredging. The basin will be located just south of the entranceway to the Town launching ramp As instructed by the NYSDEC, we have prepared p~oject plans showing the deposition basin 40' x 65' with a depth Of -4' below ~W. The dredged material will be placed in the dune restor- ation area with any excess to be trucked away to an approved upland area. I am sure you are aware of the rapid movement of~ sand causing filling-in conditions in and around this peninsula area. Con- sequently, we feel the DEC condition to create the deposition basin has merit and Will be beneficial. For your review and consideration, I am enclosing copies of the project plans. Unfortunately, most of the waterway to be used for access has filled in to a degree that equipment passage is impossible. Consequently, we contacted the NYSDEC and Suffolk COunty Department of Public Works (SCDPW) for permission to undertake the necessary dredging in and around the County maintenance dredge area. We were successful in obtaining approvals to dredge this area (copies enclosed) and would like to conclude the permit process by obtaining authorization from your Board to allow Costello Marine Contracting Corp. and Robin's Island to undertake the dredge pursuant to the SCDPW permit transfer and NYS DEC approval. Please note that the NYS DEC required that we include a dune restoration project i-n the vicinity of the rock jetty. In addition they requested that the 45~ groin be reconstructed to help maintain and increase the beach area which is presently used by the public. Enclosed please find three sets of project plans (as approved by the NYSDEC), check in the amount of $40.00 representing the application fee and additional photographs of the areas in question. B. A copy of this permit or approval and supplementary conditions shall be available at the project site whenever authorized work is in progress. C. If project design modifications take place after permit issuence~ the permittee shall submit the appropriate plan changes for approval by the " Regional Permit Administrator prior to undertaking any such modifications. All necessary precautions shall be taken to preclude contamination of any wetlands or waterway by suspended solids, sediment, fuels, solvents, lubricants, epox~y coatings, paints, coocrets~ leachers or any other environmentally delAterious materiels associated with the project work. H. Any failure to comply precisely with all of the terms and conditions of this permit, unless authorized in writing, shall be .treated as a violation of the Environmental Conservation Law. I. As discussed during our March 8, 1994 meeting, the following permits are extended and/or modified as listed below: 10-87-1285 Mud Cr CBrookhaven) This permit is hereby extended to new expiration date April 1§, 1995. The permit is amended to allow authorized work to occur between April 15 and May 15 of 1994 only, if the following added special conditions are met. 1. Work may occur during the period April 15 to May 15 for the year 1994 only, if the permittee provides a qualified environmental monitor acceptable to the DEC to oversee the activities at the site for the presence of least terns or piping plovers. 2. The environmental monitors name, resume, or other description of qualifying edUcation and experience must be submitted to Michael Scheibel NYSDEC Bureau of Wildlife at the above address (444-0312) for approval before any activity begins or continues into April 15, 1994. 3. The monitor shall be present whenever work is underway at the spoil site and shall report to Mr. Scheibel on a weekly basis.
