Project Description for Belvedere Property Management LLC
The project involves two (2) parcels of land in New Suffolk, Southold, New
York, Parcel I, Suffolk County Tax Map No. 1000-117-8-19 and Parcel II,
Suffolk County Tax Map No. 1000-117-8-20.
Applicant proposes to construct a principal building (28'x 48') to be used as
an office above garage/storage area as part of a "Private Ferry Terminal".
The proposed building shall be located ± 60.12' landward of the Tidal
Wetlands Line. To install an associated sanitary system by installing ~ 176'
of concrete retaining wall and _+ 225 c.y. of clean sand. To construct ±. 123'
of rock revetment consisting of 1 ½' - 2 ½' ton rock with an 18' return at the
northern terminus. To place _+ 70 C.y. of clean sand atop revetment creating
a sand dune and planting with Amercian Cape Beachgrass ( _Ammgphilg.
._br~y_i!!gulat__a) and Rugose Rose_(R,os~a m. gos_a). The area between the
revetment/dune and parking area 'Shall be planted with American Cape
Beachgrass (~axm~ophi!a~breyiljgulata). To remove ~ 200' of jetty and
reconstruct in kind in place with vinyl and timber jetty. To install two 9-pile
marker dolphins. To reconstruct in kind in place~ 487' of timber bulkhead
with vinyl and timber bulkhead and backfilling structure with +_ 200 c.y. of
clean sand. To remove _+. 345' of dilapidated timber bulkhead and install in
kind in place +__ 345' of low profile vinyl and timber bulkhead. To construct
8'x 62' boardwalk, to maintain existing 4'x 20' ramp and 8'x 123' float
dock. to install an additional 8'x 65' float, to remove (8) existing piles, to
relocate (2) existing piles, to construct a 10'x 10' captain's/security shed, to
install a new 70'x 20' concrete and tubber ramp for landing craft. To
remove assorted debris (piles, rock, concrete slabs) from an existing +_ 60'x
+_ 140' area and then replanting area with both high marsh vegetation
(Sp. arjt_ i_~ p~e~_) and intertidal marsh vegetation CSpartina altemj~.gra_). To
expand existing sand dune located at the southern section of the property by
± 800 s.f. and planting with American Cape Beachgrass (Ammophila

FINDINGS OF FACT
PROPERTY FACTS/DESCRIPTION: The applicant's property consists of 21,407 sq. ff. (.49 acres)
total land area with 91.50 ff. frontage along the east side of First Street, New Suffolk. The property
is in the same ownership as Robins Island and is used for maintenance and transportation uses
relative to Robins Island. Existing on this lot are a dumpster pad, transformer, fencing, and a
private parking area. The zoning of the property is Marine-Il.
BASIS OF APPLICATION: Building Inspector's March 29, 2000 Notice of Disapproval denying a
permit for a 30' x 60' building because "the proposed project on a non-conforming lot in an M-II
Zone is not permitted pursuant to Article XXIV, Section 100-244B as proposed with a side yard of
6.5+- (six and one-half) feet." The Code requires a setback of 15 feet.
AREA VARIANCE RELIEF REQUESTED: Applicant initially requested a setback vadance for a ·
proposed 30' x 60' principal building for use as an office above garage/storage area as shown on
the December 15, 1999 Site Plan prepared by Barrett, Bonacci & Van Weele, P.C. (last dated
January 24, 2000). The distance to the north side property line was proposed at 6.5 feet. The
remaining yard setbacks satisfied the Code requirements. At the May 10, 2000 public headng,
applicant's attomey submitted a revised plan for a 28' x 48' building. The proposed northerly
setback remains at 6.5 feet, and the variance application is therefore unchanged by virtue of the
plan revision.
REASONS FOR BOARD ACTION, DESCRIBED BELOW:
Based on the testimony and record before the Board and personal inspection, the Board makes
the following findings:
I. Applicant testified that the location of the proposed building on the lot is influenced by a desire
to keep it as far as possible from tidal wetlands, and also by the need to allow turning room for
delivery trucks, etc., between the building and the parking area at the southerly side of the lot.
The proposed northerly setback of 6.5 feet faces open land now used for boat storage, and
zoned Marine-Il. The owner of that land made no comment in these proceedings. In view of
the fact that the proposed building will be the only structure in the area east of First Street and
south of Main Street, the nonconforming setback will have no visual impact and grant of the
requested vadance will not produce an undesirable change in the character of the
neighborhood or detriment to nearby properties.

2. In considering this application, the Board deems this action to be the minimum necessary and
adequate to enable the applicants to enjoy the benefit of a new principal building, while preserving

FINDINGS QF FACT
PROPERTY FACTS/DESCRIPTION: Applicant is manager for Robins Island Holdings
LLC, the owner of Robins Island, which also owns property in New Suffolk used as a
base to service the Island. The lot in question in this application comprises 21,407 sq.
ft., with 91.5 feet of frontage on First Street. The lot's easterly side is bordered by
Cutchogue Harbor, the southerly side by a public boat ramp, and the northerly side by
open land now used for boat storage. The property is zoned Marine-IL
APPLICANT'S REQUEST: The property owner wishes to vacate rented space in New
Suffolk and replace it with a building to be erected on the subject lot, to be used as a
staging area for Robins Island. Because the Island is reachable only by boat, and all
guests, deliveries, etc. must pass through the New Suffolk facility, the project is
characterized as a "private ferry terminal." Under Code section 100-121(B)(2), a ferry
terminal is a permitted use in the M-II zone by Special Exception, and applicant requests
same. Article XXVI of the Code sets forth the requirements for issuance of a Special
Exception. Applicant initially proposed a 30' x 60' building, up to 35 feet high. At the
headng on May 10, applicant presented a revised proposal for a 28' x 48' building, up to
18 feet high, and it is the revised proposal that is under consideration.
REASONS FOR BOARD ACTION, DESCRIBED BELOW:
After hearing testimony, reviewing submitted materials, and making personal inspection
of the property, the Board has considered the General Standards set forth in Zoning
Code Section 100-263, and finds and determines the following:
(A) The proposed use will not prevent the ordedy and reasonable use of
adjacent properties or of properties in the adjacent use districts (Hamlet Business across
First Street and Marine-II immediately adjacent).

The following action was taken by the Board of Town Trustees
during a Regular Meeting, held on July 19, 2000, regarding the
above matter.
WHEREAS, J.M.O. Environmental Consulting on behalf of BELVEDERE
PROPERTY MANAGEMENT LLC applied to the Southold Town Trustees
for a permit under the provisions of the Wetland Ordinance of
the Town of Southold, application dated June 21, 2000, and
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on July 19, 2000 at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the $outhold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approved thg. application of
BELVEDERE PROPERTY MANAGEMENT LLC to construct a principal
building (28'x48') to be used as an office above garage/storage
area as part of a "Private Ferry Terminal". The proposed
building shall be located +/- 60.12' landward of the Tidal
Wetlands Line. To install an associated sanitary system by
installing +/- 176'of concrete retaining wall and +/- 225
of clean sand. To construct +/- 123' of rock revetment
consisting of 1-1/2'-2-1/2'ton rock with an 18' return at the
northern terminus. To place +/- 70 c.y. of clean sand atop
revetment creating a sand dune and planting with American Cape
Beachgrass (Ammophila breviligulata) and Rugose Rose (Rosa
rugosa). The area between the revetment/dune and parking area
shall be planted with American Cape Beachgrass (Ammophila
breviligulata). To remove +/~ 200' of Jetty and reconstruct in
kind in place with vinyl and timber jetty. To install two
9-pile marker dolphins. To reconstruct in kind in place +/-
487' of timber bulkhead with vinyl and timber bulkhead and
backfilling structure with +/- 200 c.y. of clean sand. To
remove +/- 345' of dilapidated timber bulkhead and install in
kind in place +/- 345' of low profile vinyl and timber
bulkhead. To construct 8'x62' boardwalk, to maintain existing
4'x20' ramp and 8'x123' float dock, to install an additional
8'x65' float to remove (8) existing piles, to relocate (2)
existing piles, to construct a 10'x10' captain's/security shed,
to install a new 70'x20' concrete and rubber ramp for landing
craft. To remove assorted debris (piles, rock, concrete slabs)
from an existing +/-60.x+/-140'area and then replanting area
with both high marsh vegetation (Spartina patens) and intertidal
marsh vegetation (Spartina alterniflora). To expand existing
sand dune located at the southern section of the property by +/-
800 s.f. and planting with American Cape Beachgrass (Ammophila
brevilgulata) and Rugose Rose (Rosa rugosa) etc. To install a
stormwater retention system utilizing a catch basin 12'x50'
corrugated pipe with flap gate.
BE IT FURTHER RESOLVED that this determination should not be
considere~ a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

Board of Trustees approved application to construct a principal
building (28'x48')to be used as an office above garage/storage
area as part of a "Private Ferry Terminal' The proposed
building shall be located +/- 60.12' landward of the Tidal
Wetlands Line. To install an associated sanitary system by
installing+/- 176' of concrete retaining wall and +/- 225 c.y.
of clean sand. To construct +/- 123' of rock revetment
consisting of 1-1/2'-2-1/2' ton rock with and 18' return at the
northern terminus. To place +/- 70 c.y. of clean sand atop
revetment creating a sand dune and planting with American Cape
Beachgrass (Ammophila breviligulata) and Rugose Rose (Rosa
rugosa). ~The area between the revetment/dune and parking area
shall be planted with American Cape Beachgrass (Ammophila
breviligulata). To remove +/-200' of jetty and reconstruct in
kind in place with vinyl and timber jetty. To install two
9-pile marker dolphins. To reconstruct in kind in place +/-
487' of timber bulkhead with vinyl and timber bulkhead and
backfilling structure with +/- 200 c.y. of clean sand. To
remove +/- 345' of dilaPidated timber bulkhead and install in
kind in place +/- 345' of low profile vinyl and timber
bulkhead. To construct 8'x62' boardwalk, to maintain existing
4'x20'ramp and 8'x123' float dock, to install an additional
8'x65' float to remove (8) existing piles, to relocate (2)
existing piles, to construct a 10'xl0' captain's/security shed,
to install a new 70'x20' concrete and rubber ramp for landing
craft. To remove assorted debris (piles, rock, concrete slabs)
from an existing +/- 60'x+/-140' area and then replanting area
with both high marsh vegetation (Spartina patens) and intertidal
marsh vegetation (Spartina alterniflora). To expand existing
sand dune located at the southern section of the property by
+/-800 s.f. and planting with American Cape Beachgrass
(Anunophila brevilgulata) and Rugose Rose (Rosa rugosa) etc. To
install a stormwater retention system utilizing a catch basin
12'x50' corrugated pipe with flap gate.

The project involves two (2) parcels of land in New Suffolk, Southold, New
York, Parcel I, Suffolk County Tax Map No. 1000-117-8-19 and Parcel II,

Applicant proposes to construct a principal building (28'x 48') to be used as
an office above garage/storage area as part of a "Private Ferry Terminal".
The proposed bttilding shall be located :t: 60.12' landward of the Tidal
Wetlands Line. To install an associated sanitary system by installing +_ 176'
of concrete retaining wall and _+ 225 c.y. of clean sand. To construct :~ 123'
of rock revetment consisting of 1 V2' - 2 ½' ton rock with an 18' return at the
northern terminus. To place _+ 70 c.y. of clean sand atop revetment creating
