No.debris is permitted in tidal wetlands and or protected buffer areas. There shall be no disturbance to vegetated tidal wetlands or protected buffer areas as a result of the permitted activity. All fill shall consist of "clean" gravel and soil (not asphalt, slag, flyash, broken concrete or demolition debris.). All.peripheral berms, cofferdams, rock revetments, seawalls, gabions, bulkheads etc. shall be completed prior to placement of any fill material behind such structures. Equipment operation below apparent high ~water is strictly prohibited. The new bulkhead shall be constructed within a' maximum of 18" seaward of the structure, measured from face of old sheathing to face of new sheathing (as shown on the approved x-section). Supplementary Special Conditions (A) through (F) attached DEC PERMIT NUMBER 1-4738-0094 1/00002-0 FACILITY ID NUMBER PROGRAM NUMBER Page of 5 sU1 ~EM~.NTAR¥ SP~.CIAL CONDi?IL~ ~ 'The following conditions apply to all Tidal Wetlands; Freshwater Wetlands; Coasta'l Erosion Management; and Wild, Scenic, and Recreational Rivers Permits: A copy of this permit, including all conditions and approved plans, shall be available at the project site whenever authorized work is in progress. The permit sign enclosed with the permit shall be protected from the weather and posted in a conspicuous location at the work site until all authorized work has been completed. The permittee shall require that any contractor, project engineer, or other person responsible for the overall supervision of this project reads, understands, and complies with this permit and all its general, special, and supplementary special conditions. Any failure to comply precisely with all of the terms and conditions of this permit, unless authorized in writing, shall be treated as a violation of the Environmental Conservation Law. If any of the permit conditions are unclear, the permittee shall contact the Division of Regulatory Affairs 'at the address on page one or telephone (516) 444-0365. If project design modifications become necessary after permit issuance, the permittee shall submit the appropriate plan changes for approval by the Regional Permit Administrator prior to undertaking any such modifications. The permittee is advised that substantial modification may require submission of a new application for permit. At least 48 hours prior to commencement of the project, the pe-~mittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion of the permitted work, the bottom portion of that form shall also be signed and returned, along with photographs of the completed work and, if required, a su~ey. For projects involving activities to be undertaken in phases over a period of more than one year, ~he permittee shallnotify the Regional Permit Administrator in writing at least 48 hours prior to recommencing work in subsequent years. The granting of this permit does not relieve the permittee of the responsibility of obtaining a grant, easement, or other necessary approval from the Division of Land Utilization, office of General Services~ Tower Building, Empire State Plaza, Albany, NY 12242 (516) 474-2195, which may be required for any encroachment upon State-owned lands underwater. FOR THE DiST.RICT ENGiV,'dF2.: Enclosures CENAN-OP-RE P*JBLIC NOTICE NO. 94-09770-L2 WORK The applicant, New Suffolk Shipyard, has requested Department of the Army authorization for replacement and construction of bulkheads and a pier assembly and dreAging of material from School House Creek, Shelter Island Sound, at New Suffolk, Town of Southold, Suffolk County, New York with ten years maintenance md subsequent upland disposal. The work would involve replacement and consmaction of approximately 303 linear feet of bulkhead on the southwest side of the shipyard. The work would include replacement within t8 inches of 36 linear feet, 26 linear feet, and 24 thnear feet of bulk_head on the east, north, and west sides of the travel lift slip, respect[velL and of 34 Hnear feet and 22 linear feet of bu[khead on the south and' west sides of the boat storage building, respectively. The work would also involve construction of a 103 linear foe(section of bulkhead, with the eastern 43 linear feet to be located immediately south of a one story frame office building and the western 60 linear feet to be constructed 18 - 30 inches in front of an existing but deteriorating and bulging bulkhead. The 43 linear foot section would replace a deteriorated retaining walt situated on the north side of the hame structure. The work would involve also the replacement within 18 inches of 33 linear feet and t5 linear feet of bulkhead on the westermmost end of the shipyard. The proposed project would involve dredging, with ten years maimenance, along 1!8 linear feet of bulkhead to a dist~mce of up to 10 feet seaward and to a maximum depth of 4 feet below mean low water with the approximately 100' cubic yards of dr~dged material (90% sand, 10% silt) to be used to backfiit between the old and new bulkheads and beneath the frame building. Dredging would be done using a jet pump on a barge or on shom,~ required. Su5sequent maintenance dredging woutd be conducted every 4 7 5 years with an anficip~te~I amount of J0 cubic yards of material each time, also to be disposed of in the same manner. The project would also involve the construction of a 4 foot x 4 foot platform,' a 3 foot x 20 foot hinged ramp, and a 6 foot x 6(~ foot float to be located seaward of the 103-foot bulkhead section. Located: New Suffolk Road, New Suffolk. Permit to construct project will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. From east to west: replace (within 18") 3 sides of travel lift slip, 36', 26', 34'; replace (within 18") 34' section on south side of boat storage building and 22' section on west side of boat storage building; construct 103' section, easterly 43' of which will be located immediately south of one story frame office building to replace a deteriorated retaining wall located on the north side of that structure; remaining 60' west will be built 18" - 30" in front of existing bulkhead due to bulges in present bulkhead; replace (within 18") 33' and 15' hula, head sections. Dredge an area up to 10' off 118' of bulkheading to maximum depth of 4' below MLW. Resultant 100± c.y. of spoil will be used to backfill between new and old bulkheads. Remove existing 3' X 60' of fixed walk located along southerly bulkhead. Build a 4' X 4' platform, 3' X 20' hinged ramp, 6' X 60' float.
