spection at reasonable hours and intervals by an authorized representative of
the Department of Environmental Conservation (the Depari~t) to determine
v~ether the permittee is cuYplying with this permit and the EEL. Such represen-

Permit Changes and Rana~ls
2. The Departn'unt reserves the right torrodify, suspend or revoke this permit ~/~en:
a) the scope of the permitted activity is exceeded or a violation of any
condition of the permit or provisions of the B~ and pertinent regula-
tions is found;
b) the permit v~s obtained by misrepresentation or failure to disclose
relevant facts;
c) neNrmterial info,;..tion is discovered; or
d) envir~','ental conditions, relevant technology, or applicable lan or
regulation have material ly changed since the permit ~es issued.
3. The permittee rrust su[rnit a separate written application to the Deparlrnent for

6. The permittee has accepted expressly, by the execution of the application, the
full le0al responeibility for all d.~-ges, direct or indirect, of v~atever
nature and by v~ver suffered, arising out of the project described in this
permit and has agreed to indu~Hfy and save harmless the State frcm suits,
actions, da~ges and costs of every r~u and description resulting fr~n this
proj act.
7. This permit does not convey to the permittee any right to trespass upon the
lands or interfere with the riparian rights of others in order to perform the
permitted ~ork nor does it authorize the ir~ai¢¢~t of any rights, title, or
interest in reel or personal property held or vested in a person not a party to
the permi t.
8. The permittee is responsible for obtaining any other permits, approvals, lands,
easut'unts and rights-of-way that rmy be required for this project.

SPECIAL CONDITIONS
1. Any debris or excess material from construction of this
project shall be completely removed from the adjacent area
(upland) and removed to an approved upland area for
disposal. No.debris is permitted in tidal wetlands and or
protected buffer areas.
2. There shall be no disturbance to vegetated tidal wetlands or
protected buffer areas as a result of the permitted
activity.
3. Ail fill shall consist of "clean" gravel and soil (not
asphalt, slag, flyash, broken concrete or demolition
debris).
4. All .peripheral berms, cofferdams, rock revetments, seawalls,
gabions, bulkheads etc. shall be completed prior to
placement of any fill material behind such structures.
5. Equipment operation below apparent high'water is strictly
prohibited.
6. The new bulkhead shall be constructed within a'maximum of
18" seaward of the structure, measured from face of old
sheathing to face of new sheathing (as shown on the approved
x-section).

'The following conditions apply to all Tidal Wetlands; Freshwater
Wetlands; Coastal Erosion Management; and Wild, Scenic, and
Recreational Rivers Permits:
A. A copy of this permit, including all conditions and
approved plans, shall be available at the project site
whenever authorized work is in progress. The permit
sign enclosed with the permit shall be protected from
the weather and posted in a conspicuous location at the
work site until all authorized work has been completed.
B. The permittee shall require that any contractor,
project engineer, or other person responsible for the
overall supervision of this project reads, understands,
and complies with this permit and all its general,
special, and supplementary special conditions. Any
failure to comply precisely with all of the terms and
conditions of this permit, unless authorized in
writing, shall be treated as a violation of the
Environmental Conservation Law. If any of the permit
conditions are unclear, the permittee shall contact the
Division of Regulatory Affairs at the address on page
one or telephone (516) 444-0365.
C. If project design modifications become necessary after
permit issuance, the permittee shall submit the
appropriate plan changes for approval by the Regional
Permit Administrator prior to undertaking any such
modifications. The permittee is advised that
substantial modification may require submission of a
new application for permit.
D. At least 48 hours prior to commencement of the project,
the permittee and contractor shall sign and return the
top portion of the enclosed notification form
certifying that they are fully aware of and understand
all terms and conditions of this permit. Within 30
days of completion of the permitted work, the bottom
portion of that form shall also be signed and returned,
along with photographs of the completed work and, if
required, a survey.
E. For projects involving activities to be undertaken in
phases over a period of more than one year, the
permittee shall notify the Regional Permit
Administrator in writing at least 48 hours prior to
recommencing work in subsequent years.
F. The granting of this permit does not relieve the permittee
of the responsibility of obtaining a grant, easement, or
other necessary approval from the Division of Land
Utilization, office of General Services, Tower Building,
Empire State Plaza, Albany, NY 12242 (516) 474-2195, which
may be required for any encroachment upon State-owned lands
underwater.

A detailed description and plans of the applicant's activity are enclosed to assist in your review.
The decision whether te issue a permit will be based on an evaluation of the probable impact,
including cumulative impacts, of the proposed activity on the public interest. That decision wilI reflect
the national concern for both protection and utilization of important resources. The benefits which
reasonably may be expected to accrue from the proposal must be balanced against its reasonably
foreseeable detriments. All factors which may be relevant to the proposal will be considered including
the cumulative effects thereof; among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, historical properties, fish ~d wildlife values, floodplain values, land
use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality,
energy needs, safety, food and fiber production, mineral needs, consideration of property ownership
and,in general the needs and welfare of the people.
The Corps of Engineers ls soliciting commants from the public; Federal, state, and local agencies
and officials; Indian Tribes; and other interested parties in order to consider and evaluate the impacts of
this proposed activity. Any comments received wi!i be considered by the Corps of Engineers to determine
whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comanents
are used tn assess impacts on endangered species, historic properties, water quality, general
environmental effects, and tZe other public interest factors listed above. Cormments are used in
preparation of an Environmental Assessment and/or mu Environmental Impact Statement pursuant to the

The applicant, New Suffolk Shipyard, has requested Department of the Army authorization for
replacement and constructinn of bulkheads and a pier assembly and dredging of material from School
House Creek, Shelter Island Sound, at New Suffolk, Town of Southold, Suffolk County, New York with
ten years maintenance and subsequent upland disposal.
q~e work would involve replacement and construction of approximately 303 linear feet of bulkhead on
the southwest side of the shipyard. The work would include replacement within Ig inches of 36 linear
feet, 26 linear feet, and 24 linear feet of bulkhead on the east, north, and west sides of the travel lift slip,
respectively, and of 34 linear feet and 22 linear feet of bulkhead on the south and west sides of the boat
storage building, respectively. The work would aisc involve construction of a 103 linear foot section of
bulkhead, with the eastern 43 linear feet to be located immediately south of a one story frame office
building and the western 60 linear feet to be constructed 18 - 30 inches in front of an existing but
deteriorating and bulging bulkhead. The 43 linear foot section would replace a deteriorated retaining wail
situated on the north side of the frame structure. The work would involve also the replacement within
18 inches of 33 linear feet and 15 linear feet of bulkhead on the westeramost end of the shipyard.
The proposed project would involve dredging, with ten years maintenance, along 1!8 linear feet of
bulkhead to a distance of up to 10 feet seaward and to a maximum depth of 4 feet below mean low water
with the approximately 100 cubic yards of dredged material (90% sand, 10% silt) to be used to backfill
between the old and new bulkheads and beneath the frame building. Dredging would be done using a
jet pump on a barge or on shore~ required. Subsequent maintenance dredging would be conducted
every 4: 5 years with an anticipatekt amount of 10 cubic yards of material each time, also to be disposed
of in the same manner.
The project would also involve the construction of a 4 foot x 4 foot platform, a 3 foot x 20 foot hinged
ramp, and a 6 foot x 60 foot float to be located seaward of the 103-foot bulkhead section.
The stated purpose of this project is to create a stabie base for the one story frame office building and
to restore water depth for boat dockage.

The following action was taken by the Board of Town Trustees
during its regular meeting held on May 25, 1995 regarding the
above matter:
WHEREAS, En-Consultants Inc., on behalf of NEW SUFFOLK
SHIPYARDapplied to the Southold Town Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated March 16, 1995, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on May 25, 1995, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code, which will be listed on
a separate page, and,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
En-Consultants Inc., on behalf of NEW SUFFOLK SHIPYARD to
replace 276 1.f. of bulkhead within 18", dredge 10' seaward of
118 1.f. of bulkhead to a max. depth of 4' below MLW and
place resultant 100 c.y. of material as backfill, remove
existing 3' X 60' of fixed walk along southerly bulkhead,
install a 4' X 4' platform, a 3' X 20' hinged ramp and a 6' X
60' floating dock, pour a new 6' X 12' concrete pad for a
gasoline dispenser to replace prior gas pump already removed,
all as per DEC approved plan dated 3/15/95. Located: New
Suffolk Road, New Suffolk.
Permit to construct project will expire two years from the date
it is signed. Fees must be paid, if applicable, and permit
issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Wetland Application 'of NEW SUFFOLK SHIPYARD 117-5-29.1 to replace
bulkheadlng on southwest side of marina/shipyard. From east to west: replace
(within 18") 3 sides of travel lift slip, 36', 26', 3~'; 3~~ section on south
side of boat storage building and 22' sec. tlon on west side of boat storage
building; construct 103' section, easterly q3~ of which will be located
immediately south of one story frame office building to replace a deteriorated
retaining wall located on the north side of that structure; remaining 60' west
will be built 18"-30" in front of existing bulkhead due to bulges in present
bulkhead; replace (within 18") 33' and 15' bulkhead sections.
Dredge an area up to 10' off 118' of bulkheadlng to maximum depth of u? below
MLW. Resultant 100 +/- c.y. of spoil will be used to backfill between new and
old bulkheads. Remove existing 3' x 60' of fixed walk located along southerly

DISAPPROVAL of the Wetland Application of ARNOLD BLAIR AND KAREN
BLAIR 37-7-10.2 to construct a six foot chain link fence to mark the boundary
lines of applicant's property as shown on survey.
The CAC recommends disapproval because the fence would deny access to the
beach and it appears from the survey provided that the fence is going across
Beach Court which does not appear to be the applicant's property. Also the
proposed fence could possibly destroy beach vegetation.

westerly bank of Pettys Pond. 3) catwalk and dock as per submitted plans.
1) The CAC recommends APPROVAL OF THE SINGLE FAMILY DWELLINC.
2) The CAC recommends DISAPPROVAL OF THE BULKHEAD. There is no
demonstrated need for the bulkhead. The area is well stabilized; there is no
erosion problem; and the house is far enough back so that it is not in danger.
Since there is no need for the bulkhead then there is also no need for bring in
clean fill and/or sand to 'backfill.
3) The CAC recommends APPROVAL OF THE DOCK AND THE CATWALK IF
OF AN APPROPRIATE LENCTH TO REACH UPLAND.

Replace all bulkheading on southwest side of
marina/shipyard. From east to west: replace (within
18") 3 sides of travel lift slip, 36', 26', 34'; replace
(within 18") 34' section on south side of boat storage
building and 22' section on west side of boat storage
building; construct 103' section, easterly 43' of which
will be located immediately south of one story frame
office building to replace a deteriorated retaining wall
located on the north side of that structure; remaining
60' west will be built 18" - 30" in front of existing
bulkhead due to bulges in present bulkhead; replace
(within 18") 33' and 15' bulk~head sections.
Dredge an area up to 10' off 118' of bulkheading to
maximum depth of 4' below MLW. Resultant 100± o.y. of
spoil will be used to backfill between new and old
bulkheads. Remove existing 3' X 60' of fixed walk
located along southerly bulkhead. Build a 4' X 4'
platform, 3' X 20' hinged ramp, 6' X 60' float. Pour a
new 6' X 12' concrete pad for a gasoline dispenser which
will replace a prior gas pump which was removed.
Existing tank buried in upland will be retained and used.
Purpose of project is to create a stable base for one
story frame office building now suspended over the water
on locust posts. These and deteriorated bulkhead at
north side of building are allowing building to settle
and crack. As new foundation cannot be installed under
building without moving it, we believe this to be the
only method to correct problem.

Dear Mr. Haje:
Pursuant to 15 CFR 930.58, the following data mad information is necessary to enable the
Department of Stare to adequately assess the coastal zone effects of tiffs proposed project.
I Enclosed, please find a copy of your Federal Consistency Assessment Form (FCAF).
Although you have checked C. COASTAL ASSESSMENT. 2.c. in the ~rmative, it
does not appear that the proposed activity would occur within a designated significant
habitat. Please amend this item and return the corrected FCAF to DOS.
2. DOS is opposed to the fillLng of tidal wetlands for non-water dependent uses. Fillimg
of this section of the Schoolhouse Creek in order ro suppo~ a non-water dependent
office is not compatible with the goals of Policy #44. Therefore, please move the
non-water building to an upland position. In tiffs manner, the build/ng wilt be
structurally supported concurrent with preservation of littoral zone. Furthermore,
tiffs area created by the relocation of the office could then be utilized for true water
dependent uses.
3. Please identify the location of disposal of excavated material such as the gas pump
pad and deteriorated bulkhead. If a disposal site has not yet been identified, please
agree to the following condition within your written response ro this letter:
All excavated materials shall be disposed in an approved upland facility or shall be
placed so as not to reenter coastal waters nor negatively affect coastal fish and
wildlife habitats and wetlands.
