Haje: The following action was taken by the Board of Town Trustees during its regular meeting held on July 28, 1994 regarding the above matter: WHEREAS, Eh-Consultants on behalf of NEW SUFFOLK SHIPYARD applied to the Southold Town Trustees for a permit under the provisions of the Wetland OrdinAnce of the Town of Southold, application dated April 11, 1994 and, WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a public hearing was held by the ToWn Trustees with respect to said application on July 28, 1994 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE BE IT RESOLVED that the Board of Trustees approves the application of Eh-Consultants on behalf of NEW SUFFOLK SHIPYARD to demolish an existing boat storage and replace with a smaller metal building with drywelts 56' back from water. Box 1179 Southold, New York 11971 RE: NEW SUFFOLK SHIPYARD Dear Trustees: At the assessment meeting the question was posed why the applicant wishes to demolish the existing wood building and replace it with a new metal storage building. The answer to this question is multi-fold. The existing wood building was built in the 1930's. Portions of it are rotten or otherwise in need of repair; needs a new roof; and the building itself is too low to accept modern equipment such as a forklift which is used to move boats in and out for service, storage, etc. Further, the existing building is too large for the shipyard's needs. The applicants have obtained estimates to renovate the building which were higher than the cost of demolition and replacement with the proposed metal building. Therefore, it would make no sense to retain that structure. Given the fact that the new structure will be further away from the water, I believe the project should be viewed favorably by your Board. The Depaxtment has no objection to your designation as lead agency. Based on a review of the subject coordination, the Department offers the following comments. However, the Department wishes to reserve its right to provide more detailed information within the comment period(s) established for this action. Also, these comments should not be construed as an implicit SCDHS approval or rejection of the project. All applications are reviewed thoroughly with reSpect to Suffolk County Sanitary Code concerns by appropriate departmental personnel when SCDHS applications are completed. Our agency has no record of an active application for development approval as required by Article VI of the SCSC. Technical comments will be made at the time an application is submitted. The plan should indicate whether plumbing or sanitary facilities will be installed in the new building. The survey should indicate existing sanitary system, water lines, wells and holding tanks if any; Letter to Albert J. Kmpski June 29, 1994 Page 2 The impacts of the proposed indnstrial activity upon groundwater quality in the area are of concern. The propnsed project must meet Article 7 and Article 12 standards for storage and discharge of restricted toxic or hazardous materials. We recommend that an analysis of the proposed uses of the site and the projected requirements related to toxic or hazardous materials be conducted prior to approval of this project. The applicant must comply with the requirements of the Suffolk County Sanitary Code and relevant consmaction standards for water supply and sewage disposal. Design and flow specifications, subsurface soil conditions, and complete site plan details are essential to the review of this project. These considerations are reviewed completely at the time of SCDHS application. SCDHS maintains jurisdiction over the £mal location of sewage disposal and water supply systems. The applicant, therefore, should not undertake the construction of either system without Health Depamnent approval. Any debris or excess material from construction of this project shall be completely removed from the adjacent area (upland) and removed to an approved upland area for disposal. No debris is permitted in tidal wetlands. 3. The storage of construction equipment and materials shall be confined to within the project work site and/or upland areas greater than 50 linear feet distant from the tidal wetland boundary. 4. Road, driveway, and/or parking areas shall be graded to direct runoff away from tidal wetlands. 5. Roof runoff shall be directed into drywells. The permit sign enclosed with the permit shall be protected from the weather and posted in a conspicuous location at the work site until all authorized work has been completed. B. The permittee shall require that any contractor, project engineer, or other parson responsible for the overall supervision of this project reads, understands, and complies with this permit and all its general, special, and supplementary special conditions. Any failure to comply precisely with all of the terms and conditions of this permit, unless authorized in writing, shall be treated as a violation of the Environmental Conservation Law. If any of the permit conditions are unclear, the permittee shall contact the Division of Regulatory Affairs at the address on page one or telephone (Si6) 444-0365. C. If project design modifications become necessary after permit issuance, the perm~ttee shall submit the appropriate plan changes for approval by the Regional Permit Administrator prior to undertaking any suc~h modifications. The permittee is advised that substantial modification may require submission of a new application for permit. D. At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion of the permitted work, the bottom potion of that form shall also be signed and returned, along with photographs of the completed work and, if required, a survey. E.
