Dear Ms. Le Verrier:
On September 8, 1995, we received your request to modify the
subject Department of the Armynationwide general permit, issued on
August 29, 1995. This nationwide general permit authorized the
replacement of 38 linear feet of timber bulkhead in-kind and in-
place, 25 linear feet of an existing timber jetty and placement of
approximately 50 cubic yards of backfill in Tuthill Creek, Great
Peconic Bay. The site is located in New Suffolk, Town of Southold,
Suffolk County, New York.
In response to your written request, we hereby confirm that
the replacement of 38 linear feet of timber bulkhead with jetty-
type construction instead of the in-kind, in-place bulkhead
replacement authorized in our original letter is still permissible
under the nationwide general permit.
All the other original conditions to which the authorized work
was made subject shall remain in effect including the nationwide
general permit expiration date shall remain in effect.

1. Any debris or excess material from construction of this
project shall be completely removed from the adjacent area
(upland) and removed to an approved upland area for disposal. No
debris is permitted in tidal wetlands and or protected Buffer
areas.
2. There shall be no disturbance to vegetated tidal wetlands or
protected buffer areas as a result of the permitted activity.
3. All peripheral berms, cofferdams, rock revetments, seawalls,
gabions, bulkheads etc. shall be completed prior to placement of
any fill material behind such structures.

SU~-~LEMENT~RY SPECIAL CONDITI~_~S
The following conditions appl~ to all Tidal Wetlands; Freshwater
Wetlands; Coastal Erosion Management; and Wild, Scenic, and
Recreational Rivers Permits=
A. A copy of this permit, including all conditions and
approved plans, shall be available at the project site
whenever authorized work is in progress. The permit
sign enclosed with the permit shall be protected from
the weather and posted in a conspicuous location at the
work site until all authorized work has been completed.
B. The permittee shall require that any contractor,
project engineer, or other person responsible for the
overall supervision of this project reads, understands,
and complies with this permit and all its general,
special, and supplementary special conditions. Any
failure to comply precisely with all of the terms and
conditions of this permit, unless authorized in
writing, shall be treated as a violation of the
Environmental'Conservation Law. If any of the permit
conditions are unclear, the permittee shall contact the
Division of Regulatory Affairs at the address on page
one or telephone (516) 444-0365.
C. If project design modifications become necessary after
permit issuance, the permittee shall submit the
appropriate plan-changes for approval by the Regional
Permit Administrator prior to undertaking any such
modifications. The permittee is advised that
substantial modification may require submission of a
new application for permit.
D. At least 48 hours prior to commencement of the project,
the permittee and contractor shall sign and return the
top portion of the enclosed notification form
certifying that they are fully aware of and understand
all terms and conditions of this permit. Within 30
days of completion of the permitted work, the bottom
portion of that form shall also be signed and returned,
along with photographs of the completed work and, if
required, asurvey.
E. For projects involving activities to be undertaken in
phases over a period of more than one year, the
permittee shall notify the Regional Permit
Administrator in writing at least 48 hours prior to
recommencing work in subsequent years.
F. The granting of this permit does not relieve the permittee
of the responsibility of obtaining a grant, easement, or
other necessary approval from the Division of Land
Utilization, Office of General Services, Tower Building,
Empire State Plaza, Albany, NY 12242 (516) 474-2195, which
may be required for any encroachment upon State-owned lands
underwater.

Dear Mr. Ha]e:
Thank you for submitting the Federal Consistency Assessment Form (FC,a~F) and supporting
information regarding the proposed replacement of bulkhead and jetty at the applicant's parcel.
However, the Department of State (DOS) is concerned with various items and requests additional
information. Pursuant to 15 CFR 930.58, the following data and information is necessa~ to enable
the Department of State to adequately assess the coastal zone effects of this proposed project.
· Enclosed, please find a copy of your submitted Federal.Consistency Assessment Form (FCAta~.
Although the proposed project is not located within a designated significant habitat, C. COASTAL
ASSESSMENT 2.c., was checked as "YES." Please review the enclosed information and check this
items as "NO."
-Although the proposed action would not occur within a desi~ated significant habitat, information
at the Department of State indicates that the area of proposed bulkhead replacement would be Mthin
a Least Tern nesting area (as described within the Draft Long Islands' Beach-Nesting Shorebird
Habitat guide, copy of relevant sections enclosed). Therefore, in order to minimize impact to nesting
terns, please agree not to performed the proposed work during the period iVfay 15 - July 31 of any
year {n which the proposed work would occur. Please. agree to this condition within your written
response to this letter.
· Please submk a few photographs of the site and portions of the bulkhead to be replaced.
Photograp~ would enable DOS to evaluate existing conditions of the bulkhead and immediate area
of the proposed construction.
Pursuant to 15 CFR 930.60(a), the rev/ow of your consistency certification will begin after we receive
and determine that the necessary data and information is adecluate to assess coastal zone effects. Any
additional information which you believe w/Il facilitate our consistency review of this project would
be appreciated.

Thursday, September 21, 1995 the following recommendation was made:

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAl_
of the Crandfather Permit of KIMOCENOR POINT CO. (by Wilmoth Uellendahl)
116-6-2a~ to remove and replace, in kind/in place, 39 I.f. of bulkhead.
Approximately 50 c.y. of clean sand will be trucked in from an upland source
for backfill. Removed and replace, in kind/in place, 25 I.f. which will be
jetty type construction without tie rods and deadmen.
