That the Trustee Permit most be prominently displayed on the premises effected thereby during the period of irk under the permit. 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any oper- ation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold 2. That this Permit is valid for a period of 12 mos. which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that auth- orization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or -its agents, and non-compliance with the provisions of the originating application, may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there sball be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work or project herein stated without expenses to the Town of Southold 8. That the said Board will be notified by the Permittee or the completion of the work auth- orized. 9. That the Permittee will obtain all other permits and consents that may be required mp- plemental to this permit which may be subject to revoke upon failure to obtain same. (See tear off sheet.) ***Entire property bulkheaded from Westermost end to Jackson Street. Swimming platform and deck 16' x 16' supported by 20 spiles. Northern end of clubhouse island bulkheaded Ramp 35 ft. x 5' with 10 spiles --bridge 96 ft. long x 5' wide supported by 20 spiles attached to concrete 41 ft. x 59 ft. club house. Jetty 46 ft. long. Also enclosed is an additional check for $2.00 for which please mail me photocopies of 4 permits (front and back) previously issued. Three of them are in the name of The Kimogenor Point Company and one issued in 1984 is in the name of Ken W. Akeson, c/o D. Weber. Your request has been approved by resolution, adopted at this meeting, to include 285 lin. ft. of bayfront bulkheading which was repaired and extended over the life of the structure which was constructed in the 1920's. Box 728 Southold~ New York 119.71 Re: Grandfather Application Gentlemen: Kimogenor Point Company was issued Permit No. 2260 dated February 26~ 1987, covering various structures in West Creek. When applying for this permit we were apparently mistaken that Town Trustee permits were only necessary for creekfront structures and not ~ayfront structures. Consequently w~ woulO Iike to amend;~he: perm~it ~i~d ~n~ ~xtended in bhe i940's, ~50~S~, ~60's~ '?0's an~ ~$0~s. Enclosed please find a copy of a survey made in July~ 1986 by the Suffolk County Department of Public Works. This survey clearly shows the approximately 280 feet of bulkheading that is at the Westermost end of our property. Also I have enclosed 4 photographs of the bulkhead taken August 14~ 1987. I trust that the enclosed information is sufficient so that you could amend our Permit No. 2260 so as to include this bayfront bulkhead. Sincerely yours, Robert P.
