Krupsld, ~lr., President Southold Board of Town Trustees Town Hall Main Road Southold, NY 11971 Re: Property: Sec. 57, Blk. 1, Lot 10 Reputed owner: Michael Di Leone et ux Dear Sir: Once again, a property owner has flouted the provisions of a permit, and the regulations of the Town of Southold, with the tacit approval of the Trustees. This despite the fact that complaints have been lodged at your office and you have been addressed, personally, by letter and phone, without the courtesy of a reply. It is redundant to quote in detail the provisions of Southold's Wetlands Ordinance which is, or should be, the basis for actions by the Trustees. Succinctly, the intent of the Ordinance is to protect, preserve and properly maintain the wetlands as being essential to the health, safety and welfare of the people of Southold. Pursuant to the Town Code, Southold's Town Waters include all tidal waters extending seaward 100 ft. from the iVfHW line. The waters abutting the subject property also conform to the definition of Tidal Wetlands. Thus, the Trustees have jurisdiction over, and responsibiligyfor, any operations within 75 ft. landward of the most landward edge of such wetlands. Sec. 9%12 (5) of the Wetlands Ordinance provides for the orrdlnary and usual maintenance and repair of a presently existing bulkhead.
