FINDINGS; DELIBERATIONS AND DETERMINATION— �- MEETING OF FEBRUARY 16, 2023 ZBA FILE# 7663 NAME OF APPLICANT: Peter and Gretchen Lang PROPERTY LOCATION: 865 New Suffolk Road, Cutchogue,NY 11935 SCTM 4 1000-109-7-3 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 20,750.8 square foot parcel located in an R-40 Zoning District. The parcel runs 100.00 feet along New Suffolk Road,runs 200.14 feet on the North side, Hans 107.50 feet on the East side, and runs 200.00 feet on the South side. The parcel is improved with a two-story frame dwelling, a wood pergola, a frame garage, a wood deck, planter with koi pond, and a frame barn with a wood deck. All is shown on a survey by Kenneth M. Woychuck, L.L.S. dated May 2, 2017. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124; and the Building Inspector's January 18, 2022 Notice of Disapproval based on an application for a permit to construct a front porch attached to an existing single-family dwelling; at; 1) located less than the code required minimum front yard setback of 35 feet; located at: 865 New Suffolk Road, Cutchogue,NY. SCTM No. 1000-109-7-3. RELIEF REQUESTED: The applicant requests a variance to construct a deck attached to the font part of the house that will result in a front yard setback of 32'2"where town code requires a 35 foot minimum front yard setback. ADDITIONAL INFORMATION:At the hearing,the applicant presented photographic evidence that prior to zoning, a front porch had existed in approximately this same location. The applicant has the benefit of Certificate of Occupancy No. Z8003, dated November 15, 1977 for a private one family dwelling with old barn and accessory shed; C/O No. Z9319, dated November 29, 1978 for accessory barn with deck addition; Certificate of Occupancy No. Z13663 dated July 23, 1985 for deck arbor addition to a one-family dwelling; C/O No. Z16338 for an arbor addition to an existing one family dwelling; C/O No. 40717 for additions and alterations to an existing one family Page 2,February 16,2023 #7663,Lang SCTM No. 1000-109-7-3 C/O No.42898 for a mudroom addition to an existing single family dwelling;C/O Z 31219 for installation of a wood stove in an non-habitable accessory building as applied for;and C/O No.Z29485 for deck repairs to an existing deck, attached to an existing accessory building. The applicant presented an old historic photograph as evidence that the house existed in this location with a front porch prior to zoning which came into effect in 1957. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 2, 2023 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law§267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is an older neighborhood with many historic homes that pre-date zoning. The subject house pre-exists zoning and the applicant proposes to restore a front porch that once existed as shown in photographic evidence. it is common for older houses which pre-exist zoning to have non-conforming setbacks. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The house is an older house with a pre- existing non- conforming front yard location. Any proposed front porch will require the benefit of variance relief. 3. Town Law $267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 8% relief from the code, However, historic restoration of older homes is supported by the Town of Southold Comprehensive Plan and the proposed porch will have a slightly greater front yard setback at 32.2 feet than the existing dwelling at 31.8 feet. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a front deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Dantes,seconded by Member Planamento,and duly carried, to GRANT the variance as applied for, and shown on the Architectural plans (Sheets G-001, A-101, A-102 and A- 201)prepared by Jonathan Baker, Architect, dated June 5,2021.
