(631) 765-1809 � � � �Ck,_,t ' �.�A& ow FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF FEBRUARY 16, 2023 ZBA Application No.: 7742SE Applicants/Owners: Rosemarie and Robert Wagner Property Location: 8310 Soundview Ave, Southold,NY SCTM No. 1000-59-7-29.6 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without fiirther requirements under SEQRA. SUFFOLK COUNTY ADMINISTRATWE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated 12/22/22 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION:The relief,permit,or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. REQUEST MADE BY APPLICANT: The Applicant-Owner requests a Special Exception under Zoning Code Section 280-13(B)(13) to establish an Accessory Apartment in an existing accessory structure. The applicant also requests a variance for the accessory apartment square footage of 376 sf as per the verification of livable square footage form submitted by the Building Department dated 1/27/23 where 750 sf is the maximum allowed and 450 sf is the minimum allowed. PROPERTY FACTS/DESCRIPTION: The subject property is a code conforming 156,358 square foot parcel located in an R-80 zoning district. The parcel runs 108.82 feet along Soundview Ave.,949.33 feet on the north side, 161.20 feet on the east side, and 866.58 feet on the south side. The parcel is improved with a 2 story frame house and garage, a pool, a shed, a 1 story frame building and a proposed 42 X 48 detached garage under BP47852.. All is shown on a survey by Nathan Taft Corwin III L.L.S. dated April 7, 2022. ADDITIONAL INFORMATION: The"as built"accessory apartment is inside the one story frame building with an existing mini split AC/Heating system and two exterior wooden decks. The one story frame building has the benefit of a Pre-existing Certificate of Occupancy No. Z-29279 dated February 20, 2003 for a non-habitable structure. Testimony was taken that the structure was historically used as a speak easy in the 1920's. Applicant's purchased the property in 2009. Page 2, February 16,2023 7742SE, Wagner SCTM No. 1000-59-7-29.6 FINDINGS OF FACT: The Zoning Board of Appeals held a public hearing on this application on February 2, 2023 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and the surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant. In considering this application,the Board has reviewed the code requirements set forth pursuant to Article III, Section 280-13(B)(13) to establish an Accessory Apartment in an Accessory Structure and finds that the applicant complies with the requirements for the reasons noted below: 1. The Accessory Apartment unit will be located on the first floor of the accessory structure with a non- conforming area of 376 square feet of livable floor area,where the code permits a maximum of 750 square feet and a minimum requirement of 450 square feet, as described and shown on the floor plan signed by Jeff A Zahn Architect and labeled Al Sheet 2 of 2 dated 11/11/22 and as confirmed by the Building Inspector in a memorandum titled"Verification of Livable Floor Area"dated January 27,2023 and received by the Board of Appeals on January 27,2023. 2. The dwelling unit does not comply with the definition of same in §280-4 of the code and complies with all code requirements as defined in Section 280-13(B)(13) of the Zoning Code except for the size of the apartment. The owner confirms that the accessory apartment shall contain 376 square feet all on one floor with only one full bathroom. (See variance relief standards below) 3. The applicant herein, owns and resides at the property and will continue to occupy the single family residence as a principal residence in conformance with the code requirements as set forth in Article III, Section 280-13(B)(13)0, 1-4), and as documented by copies of driver's license, tax returns, utility bills, star tax exemption, and voter registration. 4. The occupants of the accessory apartment will be either a family member or a resident who is currently on the Southold Town Affordable Housing Registry, and the occupancy shall not exceed the number of persons permitted, in conformance with the code requirements as set forth in Article III, Section 280- 13(B)(13)0, 1-4). The tenant of the accessory apartment will be Robert H Wagner III, as evidenced by copies of a residential lease and birth certificate. 5. The owners' plans comply with the on-site parking requirements and provide for a total of at least 4 parking spaces, as shown on the site plan(survey) by Nathan Taft Corwin III L.L.S. dated April 7, 2022. . 6. Only one accessory apartment will be on the subject property and no Bed and Breakfast facility, as authorized by Section 280-13(B)(14) hereof shall be permitted in or on premises for which an accessory apartment is authorized or exists. 7.This conversion is/shall be subject to a building permit, inspection by the Building Inspector,and annual renewal of the Certificate of Occupancy. REASONS FOR BOARD ACTION DESCRIBED BELOW: Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant: 1) The Accessory Apartment, as applied for, is reasonable in relation to the District in which is located, adjacent use districts,and nearby adjacent residential uses. This parcel is heavily wooded and the proposed Page 3,February 16,2023 7742SE, Wagner SCTM No. 1000-59-7-29.6 accessory apartment is setback behind wooded vegetation. 2) This Accessory Apartment shall be in conjunction with the owner's residence in the principle dwelling, and as proposed will not prevent the orderly and reasonable use of districts and adjacent properties. 3) No evidence has been submitted to show that the safety,health,welfare, comfort,convenience,order of the Town would be adversely affected. 4) The special exception is authorized under the Zoning Code through the Zoning Board of Appeals as noted herein, and issuance of a Certificate of Occupancy from the Building Inspector is required by code before an Accessory Apartment may be occupied. 5)No adverse conditions were found after considering items listed under Sections 280-142 and 280-143 of the Zoning Code. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Dantes seconded by Member Lehnert, and duly carried,to GRANT a Special Exception Permit as applied for SUBJECT TO THE FOLLOWING CONDITIONS: 1. This Special Exception Permit requires an annual renewal by a Code Enforcement Officer. It is the applicant's responsibility to apply to the Building Department each year to renew the accessory apartment permit. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. 2. This Special Exception permit cannot be transferred to new owners Regarding the required VARIANCE RELIEF for an as built accessory apartment with a non-conforming 376 square foot of livable floor area, as confirmed by the Building Inspector in his memorandum dated January 27, 2023, where the code permits a maximum of 750 square feet of livable floor area and requires a minimum of 450 square feet the Board finds that: 1 Town Law §267-b(3)(b)(1). The requested relief will not adversely affect the character of the neighborhood or be a detriment to nearby properties because the accessory building was built prior to zoning. 2. Town Law§267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because the building is a pre-existing non- conforming building and is located in a non-conforming front yard location. Any addition to the structure would require the benefit of variance relief. 3. Town Law 067-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 14%relief from the code. However,the building is pre-existing non-conforming to zoning. 4.Town Law§267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law X267-b(3)(b)(5). The difficulty has not been self-created. The building was constructed prior to zoning and is legally established. The special exception permit is for a change of the permitted use. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a 376 square foot accessory apartment in an accessory structure RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes seconded by Member Lehert, and duly carried,to GRANT the variance as applied for and shown on the Survey prepared by Nathan Taft Corwin, III, L.L.S. dated April 7,2022 and Architectural Drawings prepared by Jeff A.Zahn, Architect, and labeled Al Sheet 2 of 2 dated November 11, 2022. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision, may result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. In the event that this is a special permit subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Any violations of the conditions, occupancy or other requirements described herein, may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. PROPERTY FACTS/DESCRIPTION: The applicants' 156,358 sq. ft. parcel has 108.82 ff. frontage . along Soundview Avenue in Southold, and is improved with a two-story, single-family dwelling, a .one-story accessory building, a one-story shed, and gazebo as shown on the September 11, 2002 ..:..survey prepared by Sohn C. Ehlers, L.S. The dwelling has 348 feet from the front property line along Sound View Avenue and side yards at 33 feet and 64 feet, at-its closest points. The applicant acquired title to the property on September 20, 2002. BASIS OF APPLICATION: Building Department's February 11, 2003 Notice ofDisapproval, citing Section 100-31A and 100-33, in its denial of a building permit for: (a)living space in a non-habitabie accessory building, with a proposed addition; (b) proposed additions/alterations to a non-habitable accessory building, and (c)"as built'accessory shed located in an area other than the code required rear yard, FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on June 19,2003 and July 10, .2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The 9p{icant requests area variances: (a)to authorize .a conversion to living area in an existing 408+- sq. ft. one-story accessory building for habitable occupancy by family members, (b)to authorize an 18'x 24' addition to the accessory building, and (c)to authorize the yard location of an accessory storage shed in the front yard, as built, rather than a code-required rear yard location. The applicant requests conversion of the existing 408* sqft., one-story building to residential use for the applicant's family, indicating that the building is presently occupied by Mrs. Coyne's mother. The applicant also requests'an 18'x'existing one-story building,and authorization to convert the addition as habits IGM REASONS FOR BOARD ACTION: -'On the basis of testimony presented, materials submitted and personal inspection,the Board makes the following findings: 1. A brie€statement was subrrt'itted bythe applicant's attorney indicating that the small building was . Used many years ago, for a period of time as early as 1952, by a small group of Polish and •American potato farmers who called themselves 'The Rinky Dinks' and used this as asocial club or ;farmer's bar in 1952 (ref. statement signed by Steve J. Doroski dated 1213102). The property consisted of 15.984 acres during this time and was shown on the County Tax Maps as Parcel 29, -2. :Information' of record indicates that the 408+- sq. ft., one-story building existed as the sole .building on the former 15.984 acre parcel. Subsequently, on June 21, 1976, a former owner (Bayley) obtained minor subdivision approval from the Town Planning Board to create four(4) lots, and this building remained in its present location,on a newly created 3.67 acre parcel, shown as Lot #2 on the Minor Subdivision Map. 3. Oh May 11, 1978, a Town Bui{ding Permit was issued fora new ti"'1646miiy dwelling behind the* detached one-story building. It is noted that the Zoning Code provision in effect since 1957, limited the number of single-family dwellings to'one dwelling per lot, and has been unchanged. The applicant furnished a copy of a Certificate of Occupancy #Z-9315, issued November 27, 1978 to Robert and Schiela Schur,for a newly constructed "Private One Family Dwelling." On February 20, 2003, preexisting Certificate of Occupancy #29279 was issued by the Building Inspector for this building as an"Accessory Non-Habitable Structure." A. Although there is no question that small one-story building remasned in'the same yard location; . without the deck and without new electric, plumbing and heating, since as early as 1952, no factual information was made available by the applicant to the building department to show that the building was a preexisting, nonconforming dwelling. The applicant's attorney submitted an affidavit from the builder in 1978 for the new dwelling stating that the Schur family occupied the small building, and that the Building Department did not make the Schur family remove or abandon the residential cottage as a condition of issuing the Certificate of Occupancy for the new residence. The issuance of a Certificate of Occupancy for a new dwelling does not establish a legal nonconforming use for ahy other building that existed on the premises. A building permit and certificate of occupancy were also not obtained by the owner for new electric, plumbing and heating done in the one-story building. .it is found that the applicant did not furnish sufficient information to show that the building was an authorized residential use when it existed on the 15.9-acre parcel prior to 1976. It is also found ..that there is no evidence, as required under Section 100-241, to indicate that the residential use was legally established, and further that it was not discontinued for a period of two (2) years. Factually, the building had existed on the former 15.9-acre parcel prior to 1976, and its use was not legally estabiished as a nonconforming use at any time. Without furnishing this evidence to the Building Inspector, a Preexisting Certificate of Occupancy for a nonconforming residence within this .'building may not be issued.
