ZBA APPLICATION: #7739SE APPLICANTS/OWNERS: Diane Mulvaney PROPERTY LOCATION: 225 Marion Lane, East Marion,NY SCTM: 1000-31-8-12.11 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions,without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject, non-conforming 30,448 square feet .7 acre rectangular-shaped parcel, located in the R-40 Zoning District,measures 142.99 feet along Marion Lane, a private right-of-way, then runs south 213.95 feet along the same roadway,then runs east 142.98 feet along a residentially developed lot to the south, then returns north 211.95 feet along a second residentially developed lot to the east. The property is developed with a 2-story wood-frame residence with an attached 2-car garage, an attached rear deck, a hot tub, an inground swimming pool, various sheds/chicken coop, paved driveway and a walkway as depicted on a photo copied survey submitted by the applicant. BASIS OF APPLICATION: The applicant requests a Special Exception pursuant to Article I1I, Section280-13B, subsection 14 of the Zoning Code, to operate a Bed and Breakfast within their existing single-family dwelling,accessory and incidental to their principal residential occupancy under the Building Department's Certificate of Occupancy Z-43289 dated July 26,2022. The proposed three(3)bedrooms for lodging and serving of breakfast to six(6) Bed & Breakfast casual, transient roomers in their existing one family dwelling. J � ADDITIONAL INFORMATION: The subject property is the beneficiary of two 'Zoning Board of Appeals applications: File #5651 dated January 20, 2005 granting relief for a front yard setback of 36 feet where the Code requires a minimum front yard setback of 40 feet and File#6228 dated January 22,2009 granting relief for a lot-line change and reducing lot area to the present 30,448 square feet, where a minimum of 40,000 square feet is required. Additionally, improvements on the subject parcel are covered by.the following Certificates of Occupancy: #Z-21137 Dated November 6, 1992 covering a deck addition and completion of second floor bathroom. 1 Page 2, February 16,2023 #7735SE, Mulvaney SCTM No. 1000-31-8-12.11 #Z-26709 Dated September 27, 1999 covering an accessory storage shed in a rear-yard location. #Z-43235 Dated July 9, 2022 covering an accessory in-ground swimming pool and fencing. #Z-43289 Dated July 26, 2022 covering additions and alterations to an existing three(3)-bedroom residence. The applicant provided a hand-drawn(not to scale)parking plan. Additionally,the applicant provided residential floorplans with rooms labeled for guest or owner use. These plans illustrate a first floor`study' with full bath to be used by the owner as their private quarters and a second floor`family room'with full bath to be used by B&B guests, in addition to the primary owner's suite with full bath and two additional bedrooms and shared bath, for use by B&B guests,all on the second floor of the residence. Based on Board research, documents in the record, and applicant testimony, the Board concluded that neither the second floor `family room' or the first floor `study' proposed as the owner's bedroom in association with the adjacent full bathroom in the application for three guest bedrooms, could legally be used as a bedroom since the applicant's Certificate of Occupancy #Z-43289 clearly indicates the structure is a three (3)-bedroom residence (all located on the second floor) and the applicant is required to maintain one private bedroom and bathroom for her own use. The applicant offered testimony that she lives in the house alone. As such, the applicant indicated her willingness to comply with the code and her Certificate of Occupancy and verbally amended their application to seek permission for a two(2)-bedroom B&B. The applicant has a rental permit from the Building Department, File#0694, dated July 11, 2022, erroneously granting maximum permitted occupancy of eight(8)people(two (2) per bedroom based on an application as a four (4)-bedroom residence). The applicant understood that she cannot both rent her residence and operate a B&B and stated that she wished to operate a B&B. There is,a complaint on record with the Town of Southold Code Enforcement Office against the applicant's dwelling for a violation of the rental law. (Compliant#: 2022-1149). A neighbor living nearby spoke against this application, while commenting on the fact that she knew the applicant and was sure she would run a nice B&B operation. However, the neighbor opined on her perceived issues with short term rentals and B&B's and their adverse impacts on her neighborhood including the use by guests of the local beach and the need for designated parking facilities at the proposed Bed&Breakfast. No additional member of the community or immediate neighbor spoke in favor of or against this application. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on February 2, 2023 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,and upon review of the code requirements set forth pursuant to Article III, Section 280-13B (14) to establish.an Accessory Bed and Breakfast, the Board finds that the applicant complies with the requirements for the reasons noted below: 1. Diane Mulvaney, the applicant herein, is the owners of the property located at 225 Marion Lane, East Marion,NY 11939. It is improved with a 3-bedroom residence as described in Certificate of Occupancy #Z-43289 dated July 26, 2022. The owner/applicant will continue to occupy same as their principal residence while the Accessory Bed and Breakfast facility is managed and operated. The applicant has submitted the following proof that the subject premises is their principal dwelling: redacted Federal tax return, utility bills, driver's license, voter registration, STAR Exemption, Town of Southold tax bill, copy of the property deed, and copy of a recent bank appraisal for the subject property. The applicant's plans comply with the on-site parking requirements and provide for four(4)parking spaces, two (2) for the principal single-family use and.one (1) for each of the Accessory Bed and Breakfast bedroom(s). as shown on a hand-drawn (not to scale) parking plan submitted by the applicant on a survey by John T. Metzger and stamped approved by the Planning Board of the Town of Southold dated August 11,2009 in connection with a lot line change granted by the ZBA in File#6228 dated January 22,2009 3. The applicant complies with the requirements of a dwelling unit as defined in Section 280-4 of the Zoning Code 4. The Accessory Bed and Breakfast, as applied for, is reasonable in relation to the district in which it is located, adjacent use districts, and nearby and adjacent residential uses. 5. The Special Exception is accessory to the principal use and will not prevent the orderly and reasonable use of adjacent properties. 6. This accessory Bed and Breakfast will not prevent the orderly and reasonable uses proposed or existing in adjacent use districts. 7. No evidence has been submitted to show that the safety, health, welfare, comfort, convenience or the order of the town will not be adversely affected. 8. This zoning use is authorized by the Zoning Code through the Zoning Board of Appeals as noted herein,and issuance of a Certificate of Occupancy from the Building Inspector is required by code before an Accessory use may be occupied. 9. No adverse conditions were found after considering items listed under Section 280-142 and 280- 143 of the Southold Town Zoning Code. 10. Submission of a Certificate of Compliance or similar document will be necessary for issuance by the Building Inspector certifying that the premises conforms to Chapter'280 of the Zoning Code for an Accessory Bed and Breakfast use. RESOLUTION OF THE BOARD: In considering all of the above factors, motion was offered by Member Planamento, seconded by Member Lehnert, and duly carried to GRANT the Special Exception permit as amended for an Accessory Bed and Breakfast for two (2) guest bedrooms rooms, to be used only in conjunction with the applicant-owner's residence, as applied for and shown on the survey,floor plans,pages 5 of 7 and 6 of 7,designed by Eileen Santora,Residential Designer, last dated October 26, 2004 submitted with the application. SUBJECT TO THE FOLLOWING CONDITIONS: 1.This Special Exception Permit requires an operating permit and inspection by a Building Inspector from the Building Department that must be renewed annually. It is the applicant's responsibility to contact the Building Department each year to schedule the required inspection.Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. 2.This Special Exception permit cannot be transferred to new owners. 3.The applicant is to provide the Board with an updated survey or site plan,dated and stamped by a licensed design professional illustrating the on-site parking requirements for two spaces for the principal dwelling and a minimum of two spaces for B&B guests,prior to the issuance of the B&B permit 4.The applicant shall install paved or permeable parking on the subject property for guest parking in accordance with the updated survey or site plan prior to the issuance of a Bed and Breakfast permit Page 4, February 16, 2023 #7735SE, Mulvaney SCTM No. 1000-31-8-12.11 5.Based on floorplans submitted, the second-floor owner's suite and full bath are to be designated for the applicant's sole use with the two additional second floor bedrooms and shared bath to be designated for B&B use 6.The Second floor`family room' may only be used by the owner and/or guests as a sitting room and may not be used at any time as a bedroom. The laundry room attached to the "family room" may only be used by the owner applicant who shall post a sign on the door labeled "private owner use". 7.The first floor`study' shall be used only by the owner applicant as an office/study and may not be used as a bedroom for the applicant or for B&B guests 8.The applicant may,within 24 months from the date of this decision, increase the number of guest rooms (not to exceed five for a maximum occupancy of 10 persons, as permitted by Code — maintaining a separate owner's suite w/full bath provided they do so with a valid Town of Southold building permit/Certificate of Occupancy and Suffolk County Board of Health approval. Copy of the updated Certificate of Occupancy and the Suffolk County Board of Health approval, for the bedroom count expansion,is to be provided to the Board's satisfaction prior to use of the bedrooms as additional B&B guestrooms. The applicant may not appeal for an extension to this condition. If the applicant wishes to expand the number of beds for the Bed & Breakfast guests in the future beyond this time frame, she must reapply to the Zoning Board of Appeals with a new Special Exception application for a Bed &Breakfast. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings, cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. In the event that this is a specialpermit subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Any violations of the conditions, occupancy or other,requirements�described herein, may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception permit as granted herein.
