SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type 11 category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated October 18, 2022stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated January 31, 2023. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is a 74,026.93 sf. as per survey by Kenneth Woychuck dated December 19, 2021 non-conforming property located in an R-80 zoning district. The property is an irregular quasi L-shaped property located at the end of Demarest Road, with the rear yard leading to the Long Island Sound. The property has an existing two story dwelling with an existing second floor deck and wood stairs with a landing. There is also an accessory frame garage located on the southeast corner of the property. BASIS OF APPLICATION: Request for a Variance from Article XXII, Section 280-116A(1) and the Building Inspector's September 6,2022 Notice of Disapproval based on an application for a permit to construct a deck addition to an existing single family dwelling; at; 1) located less than the code required 100 feet from the top of the bluff, located at: 1390 Demarest Road (Adj. to Long Island Sound), Orient,NY. SCTM No. 1000-13-2-7.7. RELIEF REQUESTED: The applicant requests a variance to re-construct an existing second floor deck located 82 ft from the top of the bluff where a minimum of 100 ft is required. Page 2, February 16, 2023 #7730 CVJB, LLC No. 1000-13-2-7.7. ADDITIONAL INFORMATION: As per applicant's agent, both oral and written testimony at the hearing of February 2, 2023; it was stated that the existing second floor deck is noted in Certificate of Occupancy# Z15123, dated November 24, 1986. The current deck is going to be demolished, and re-built to the same setback along the rear of the house. The existing stairs and landing will be removed. There is currently a Southold Trustees approval # 10090A, dated February 28, 2022. The applicant's representative supplied comparable variances granted in the neighborhood as follows: ZBA # 7561 Astely in 2021 request for a swimming pool located 61.166 ft from top of bluff, ZBA 96299 Hamilton in 2009 request for in-ground swimming pool, deck and raised patio 75 ft from top of bluff. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 2, 2023 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed deck has the same setback as the existing deck, while extending across the rear of the house. The existing stairs & landing will also be removed. With the deck being replaced in the same place, and the residence being at the end of a long road, it will not in in any way change the character of the neighborhood. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Any work to the existing deck would require a variance as it is within the 100 ft setback of the top of the bluff. And since the deck already exists, it is also consistent with the LWRP. 3. Town Law 4267-b(3)(b)(3). The variance requested is mathematically substantial, representing 18%relief from the code. However, a majority of the proposed deck will be a direct replacement of the existing deck, and will not extend closer to the top of the bluff than what already exists. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and conditions of this board. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a second-floor deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13,motion was offered by Member Lehnert,seconded by Member Planamento,and duly carried, to GRANT the variance/variances as applied for and shown on the Site Plan and Architectural Plans drawn by Fabian Bedolla, Architect, last revised August 24, 2022. The proposed second floor deck shall remain"open to above",and shall not be converted to habitable space. 2. The proposed deck shall also follow all conditions required by the Southold Town Board of Trustees. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms.
