(631) 765-1809 Southold Town Cl------------- �'� FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF FEBRUARY 16,2023 ZBA FILE: # 7729 NAME OF APPLICANT: Kenneth & Mary Marissael PROPERTY LOCATION: 260 Founders Path, Southold,NY 1000-64.-2-24 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated September 23, 2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a 7,266 sq. ft. non-conforming parcel in an R-40 Zoning District. The property has 100.11 feet road frontage along Founders Path, then turns west for 75 feet along L'Hommedieu Lane, turning north for 100 feet, before returning 70.32 feet back to Founders Path. The property is improved with a one and one half story frame dwelling with attached garage, located in a historic neighborhood,with mixed one(1) and two(2)story homes. BASIS OF APPLICATION: Request for Variances from Article XXIII, Section 280-124; and the Building Inspector's July 18,2022 Notice of Disapproval based on an application for a pen-nit to construct roof alterations and dormer additions to an existing single-family dwelling at; 1) located less than the code required minimum front yard setback of 35 feet; 2) located less than the code required minimum secondary front yard of 20 feet; located at: 260 Founders Path, Southold,NY. SCTM No. 1000-64-2-24. RELIEF REQUESTED: The applicant requests variances for second floor dormer additions with a setback in.the primary front yard of 23 ft where a 35 ft minimum is required, and a setback in the secondary front yard of 10 ft where a minimum of 20 ft is required. ADDITIONAL INFORMATION: Testimony was given by the owners at the public hearing stating that the proposed additions would be dormers on the existing second floor of the house, which currently exists in its non-conforming location with a pre-existing Certificate of Occupancy 4 35378, dated January 5, 2012. Page 2,February 16,2023 #7729 Marissael SCTM No. 1000-64-2-24 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 2,2023 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law $267-b(3)(b)(1). Grant of the variances or will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed alterations and additions are taking place on the existing second floor of the residence. The proposed dormers are actually behind the existing setback lines of the first floor. The neighborhood is made up of small non-conforming lots with non-conforming houses, many of them historic. Since the work proposed on the second floor is within the existing gable roof which will be slightly raised with a dormer addition in order to add two bedrooms, no significant visual changes to the dwelling's architecture is proposed. Therefore the construction will not alter the character of the neighborhood. . 2. Town Law 1267-b(3)(b)(2). The benefit sought by the applicant can cannot be achieved by some method,feasible for the applicant to pursue,other than an area variance. Due to the fact that the lot is non-conforming,and the existing house is also non-conforming, any proposed additions on the second floor of the house would require variance relief. 3. Town Law§267-b(3)(b)(3). The variances granted herein are mathematically substantial. a) The primary front yard setback represents a 35 % relief from the code. b) The secondary front yard setback represents a 50%relief from the code. However,the proposed additions are dormers being proposed on the gable roof to permit habitable space on the second floor and they are to be set back behind the existing setbacks of the first floor of the existing residence. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the conditions of this board. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of second floor dormer additions while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Lehnert, seconded by Member Dantes, and duly carried,to GRANT the variances as applied for,and shown on the Architectural Plans drawn by James Lerner,Architect(Sheet No. 1 of 4 last revised July 22, 2022; Sheet No. I dated August 23, 2022; Sheets 2 of 4, 3 of 4 and 4 of 4 dated May 21, 2022; and Sheet No. 5 dated July 30, 2022) This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void Page 3,February 16,2023 #7729 Marissael SCTM No. 1000-64-2-24 That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the variance(s)granted herein as shown on the architectural drawings,site plan and/or survey cited above,such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code,other than such uses,setbacks and other features as are expressly addressed in this action. TIME LIMITS ON THIS APPROVAL: Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. Your previous appeal, ZBA 47729, granted approvals for additions and alterations to your single-family dwelling (specifically front yard setbacks for roof alterations and a dormer addition with 23.3 foot and 10 foot front yard setbacks). The concrete patio, at grade, was never before the Board since at grade patios are not considered structures and therefore do not require variance relief. The de minimus letter I issued was merely indicating to the Building Department that replacing the patio in kind was fine with the ZBA, since we had previously stamped as approved a site plan for your proposed additions and alterations showing the existing rather than a replacement patio. (The Building Department will only issue a building permit based on what the ZBA stamped as approved; thus the need for a de minimus letter fi•om the ZBA). If you now wish to construct a new elevated and attached wood deck instead of replacing your concrete patio, the proposed deck structure will require variance relief, as explained by the Building Department, because it will be located approximately 14 feet from your front property line, which is not conforming to the code. They are correct in informing you that this does not qualify as a de minimus change. Of course, the choice is yours, but if you decide to construct the attached deck rather than replacing your patio,you will need to bring a Notice of Disapproval from the Building Department to the ZBA office and apply for and receive variance relief in order to do so. Ms.Weisman, we are currently undergoing renovations and by request of de minimus approval you had graciously granted us the right to replace an old concrete patio with a new one of the same material and size. We recently submitted plans to the Building Department to replace the patio with a deck instead of the concrete. We were told by the Building Department that they are rejecting the plans as it does not meet the de minimus approval criteria. The deck will be of the same size and consist of the highest quality composite decking available. It will look similar to our neighbor's entrances at 255 Founder's Path and the front porch at 660 Town Harbor Lane. Now that construction has come far enough along we believe that aesthetically the deck will be a better fit. I have attached the original plan with the concrete porch,the proposed plans for the deck and a copy of the original letter where we were granted approval for this small change. I'm hoping we can get permission for this change without going through the arduous task of filing a new appeal. Thank you for your time and consideration of this matter. BASIS OF APPLICATION: The applicant requests Variances under Sections 280-10 and 280-124, based on the Building Inspector's April 12, 2007 Notice of Disapproval concerning a proposed deck addition which: (1) will be less than 10 feet on a single side yard; (2) will be less than 35 feet total side yard setbacks; and (3) will exceed the code limitation of 20% lot coverage. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on August 2, 2007 and September 13, 2007, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Requested is a deck addition on the western side of the applicant's home, as shown on the survey map prepared by Peconic Surveyors, P.C. and date stamped by ZBA June 22, 2007. The map shows a proposed setback of three (3) feet from the westerly lot line, 14.4 feet from the southerly front lot line, and with lot coverage proposed at 36%. The dimensions of the deck extend, as shown on the map, 20 feet from the west side of the house at its widest measurement, and 32 linear feet on the north/south axis. The shed also is located less than the required three ft. setback from the property line and exceeds the code maximum lot coverage requirement of 20%. ADDITIONAL INFORMATION: During the August 2, 2007 hearing, the applicant offered to increase the setback to five feet and to remove the 49.5 sq, ft. shed, reducing the variances requested for lot coverage, and to submit a drawing that would show the new construction at grade. The Board concluded the hearing on August 2, 2007, subject to receiving the revised drawing. On August 16, 2007, the agent for the applicant submitted a revised drawing (wooden deck with concrete footings, flush girders and steps from the house) for the ZBA record with a cover memo. On August 30, 2007 the Building Inspector received and reviewed the specifications/drawing and noted that the Notice of Disapproval remains, without change in the appeal procedure that was pending before the ZBA. AMENDED VARIANCE RELIEF: After reviewing the revised drawing on August 16, 2007, Board Members stated that they wanted, to consider and discuss the revised drawing, and on the Board's own motion re-opened the hearing with a date of September 13, 2007. During the September 13, 2007 hearing, there were discussions concerning the code allowances for structures at grade without footings, and those proposed with footings at grade. The applicant proposed footings for the deck construction, but offered to go directly to the Building Inspector and furnish specifications and information to meet code for at-grade construction. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections,the Board makes the following findings: 1. Town Law §267 b(3)(b)(3)(1) Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The lot size is 7,266 square feet, much the same as adjoining properties. The lot coverage is excessive with the addition of the deck. The present lot coverage with the shed is 28%. With the addition of the deck, the lot coverage will be at least 33% (as revised). 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant can be achieved b some method feasible for the applicant to pursue, other than an area variance.• The applicant is furnishing specifications to the Building Inspector (as offered) to meet code and what is determined acceptable construction`at grade.' 3. Town Law §267-b(3)(b)(3). The variance as requested is substantial as the maximum lot coverage is 20% per code, and with the deck addition, the lot coverage would be 33% or more, almost 100% variance. 4. Town Law 4267-b(3)(b)(5).
