ADOPTED DOC ID: 18886 THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION NO. 2023-227 WAS ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON FEBRUARY 14,2023: WHEREAS, the Town Board of the Town of Southold held a public hearing on the 14th day of February, 2023, on the question of the purchase of fee title to property owned by WW Farms, LLC, for open space preservation pursuant to the provisions of Chapter 17 (Community Preservation Fund) and Chapter 185 (Open Space Preservation) of the Town Code of the Town of Southold, at which time all interested parties were given the opportunity to be heard; and WHEREAS, said property is identified as SCTM#1000-101.-1-8.2 and 1000-101.-1-8.3. The address of the property is 15325 Middle Road (CR 48) in Cutchogue. The property is located within the Agricultural-Conservation(A-C) Zoning District. The total area of the property is 32± acres. SCTM# 1000-101.4-8.2 is approximately 24 acres of unencumbered land; SCTM# 1000- 101.4-8.3 is approximately 8 acres encumbered with a conservation easement granted to the Peconic Land Trust, Incorporated on May 15, 2006; and WHEREAS,the proposed acquisition is for the Town of Southold, in a joint 50%/50% partnership with the County of Suffolk, to acquire fee title to the entire 32± acre property for open space preservation. The exact area of the purchase is subject to survey; and WHEREAS,the purchase price for the 32± acre parcel is $2,848,000 (two million eight hundred forty-eight thousand dollars) and is the sum of the purchase price of$2,640,000 for SCTM#Lot 8.2 and$208,000 for SCTM#Lot 8.3. The purchase will be funded by the Town's Community Preservation Fund and the County of Suffolk in a 50%/50%partnership which will include the purchase price and any related acquisition costs associated with the purchase of this property; and WHEREAS,the property is listed on the Town's Community Preservation Project Plan as property that should be preserved for preservation of open space and aquifer recharge areas. The purpose of this acquisition is for open space, passive recreational purposes and-aquifer recharge preservation. Proposed uses of the property may include the establishment of a nature preserve, passive recreational area with trails and limited parking for access purposes, all subject to a Management Plan which will be developed for this property; and WHEREAS, the purchase of this property is in conformance with the provisions of Chapter 17 (Community Preservation Fund) and Chapter 185 (Open Space Preservation) of the Town Code of the Town of Southold; and Generated February 15, 2023 Page 80 Southold Town Board - Letter Board Meeting of February 14, 2023 WHEREAS, the proposed action has been reviewed pursuant to Chapter 268 (Waterfront Consistency Review) of the Town Code and the Local Waterfront Revitalization Program (LWRP) and the LWRP Coordinator has determined that this action is consistent with the LWRP; and WHEREAS, as per Chapter 117 (Transfer of Development Rights) of the Code of the Town of Southold, the Land Preservation Coordinator and the Town'Board have reviewed the acquisition and have determined that Sanitary Flow Credits may be available upon the acquisition of the property. The County of Suffolk will determine if Sanitary Flow Credits (a/k/a County Workforce Housing Development Rights) are available, and if so, the number of Sanitary Flow Credits available from the property. Any available Sanitary Flow Credits will be-divided between the County and the Town in accordance with the 50%/50% joint partnership percentage. The Seller has requested, and the Town Board has agreed, that the transfer of the Sanitary Flow Credits allotted to the Town for this project will be restricted to use of affordable housing pursuant to Chapter 117-3B. The transfer of the Sanitary Flow Credits allotted to the Town will not be finalized, and shall not occur, until the County/Town acquires title to the property, and the Town Board passes a resolution allowing the transfer into the Town Sanitary Flow Credit Bank, with all such credits to be used for-affordable housing; and WHEREAS, the Land Preservation Committee has reviewed the application for the acquisition and recommends that the Town Board acquires the property; and WHEREAS, the Town Board deems it in the best public interest that the Town of Southold purchase fee title to the subject property for the purposes of the preservation of open space, passive recreational purposes and wetland protection.; and WHEREAS the Town Board of the Town of Southold classifies this action as an Unlisted Action pursuant to the SEORA Rules and Regulations, 6NYCRR 617.1 et. Seq.; and, WHEREAS, the Town of Southold is the only involved agency pursuant to SEQRA Rules and Regulations; and, WHEREAS, the Town Board of the Town of Southold accepted the Short Environmental Form for this project that is attached hereto; now, therefore, be it RESOLVED that the Town Board of the Town of Southold hereby finds no significant impact on the environment and declares a negative declaration pursuant to SEQRA Rules and. MELISSA SPIRO : Melissa Spiro, Land Preservation Consultant . So I guess I will get started . So as stated in the hearing notice, this purchase is a 50/50 joint acquisition with the County . Once acquired, the Town and County will own property jointly and the Town will manage it for open space purchases . The current property is shown as two tax parcels . I think you can see on the map there, there is one on the south side . Kind of mustard green . And the other piece that we ' re talking about is outlined in red. In 2006 , the land owner donated a conservation easement to Peconic Land Trust to the southern most 8 acres . And that is what resulted in the two separate tax parcels . The Town and County acquisition will include both the 8 acre tax parcels and the 24 acres February 14, 2023 Regular Meeting 7 behind it . A combined total of 32 acres . The appraisal and the resulting purchase price accounted for the 8 acres being encumbered by the easement and the Peconic Land Trust . This property unlike many in Southold, except for a small 5 acre area in the middle, which has been farmed . I spoke to the land owner, it has been farmed way back . Those 5 acres . The rest is wooded and has not been farmed, which is unusual for a property in Southold. The property is also significant in that in lines up with the Town ' s water protection area . So the acquisition contributes greatly to the protection of the Town ' s aquifer . I was looking at old files and saw as far back as 2000 , probably further back, the property was nominated for the New York State DEC Open Space Plan, as being important property to preserve . Since it ' s an undeveloped wooden parcel and it ' s within the CPA aquifer area . So it ' s both New York State Open Space and of February 14, 2023 Regular Meeting 8 course our Town ' s Community Preservation Plan . As I drive by the property lately and I see two signs , thankful that the land owners gave the Town and the County the opportunity to acquire this significant property. The land owner and I have been talking about preservation in this parcel , for as long as I have been working for the Town, over 35 years . While I was working for the Town . And I am glad that the Town ' s open space and farm land programs are here to be there when the land owner was ready to sell the property. And now the land owner is ready to sell it to the Town . As stated in the notice, the Town intends to split the acquisition cost with the County, 50/50 . The Town is using community preservation funds for its share . Both the Land Preservation Committee and I support this purchase, and we recommend that the Town Board proceed . I am here to answer any questions you have . Thank you . The purpose of this acquisition is for open space and passive recreational purposes . The property is across from Town owned open space land known as Hummels Pond . Proposed uses of the February 14, 2023 Regular Meeting 12 property may include the establishment of a nature preserve and passive recreational area with trails and limited parking for access purposes , all subject to a Management Plan which will be developed for this property . The Land Preservation Coordinator has reviewed the acquisition in accordance with Chapter 117 (Transfer of Sanitary Flow Credits ) of the Code of the Town of Southold . Seventeen point five ( 17 . 5 ) Sanitary Flow Credits may be available for transfer from the property upon the Town ' s purchase of the property . So the land property is outlined on the map, which the map shows much better . It ' s in red . And the other property there that are shown in green are Town and County development rights . And then there is one property to the west , the left of the red, that has a white label on it . That is Hummel ' s Pond . That is owned by the Town of Southold in our open space program. So that is Hummel ' s Pond. It ' s known as Hummel ' s Pond across the street . Hummel ' s Pond -- probably was when it was colder, a very popular skating area . And there is a walking trail around Hummel ' s Pond. Hummel ' s Pond is also in February 14, 2023 Regular Meeting 14 the deer program. The property across the street will be a great expansion of that . And expansion in addition to that . It will allow future expansion of a walking trail and likely expansion of harbor view management area . The property was farmed, I believe , in the past . There is a nursery. The nursery was left . The Committee members and I have both walked the property . And supports the Town proceeding with the acquisition of this important property that will expand our open space . Although it is a smaller property, you can see on the map, you can see its expansion and preserved property. The Town is acquiring this property with Community Preservation Funds . I thank the land owners for giving us an opportunity to preserve this significant piece of property . And I am here to answer any questions . CAROLINE WINDMULLER: Hello . Thank you first and foremost for being here on Valentine ' s Day. Not exactly a hot date, but we ' re here . Appreciate you all being here and lending an ear . My name is Caroline Windmuller . And I live with my family on Queens Street in Greenport . We purchased our home in 2009 from the lat Agnes Dunn . A family who has a history as the first residence of Queens Street beginning from its origins in 1900 ' s , and continues to reside . Susan Valezquez is here with us February 14, 2023 Regular Meeting 23 as well . Our neighbor here . My husband and I both grew up in Southold and returned to North Fork after college to raise our family . Finding a home was quite the love story . I am going to spare you that part . But I do want to embark on that because I do find it fitting because we love our home and that is why I am standing here tonight before you all . After years of attempting to resolve our problems amicably with neighbors and the new owners of the Eastern Long Island Campground. We were finally pushed to file a full complaint on January 18th with the hopes of putting an end to the illegal activity . What was once a family run respectable campground is now becoming a trailer park amusement park, and it ' s truly a disgrace to the entire North Fork community at large . Despite our formal complaint being addressed to the Town leadership, which is you, I don ' t believe I arrived before all of you . I am not sure . Maybe you can February 14, 2023 Regular Meeting 24 clarify? I do know that I put it in Louisa ' s hands, but I am not sure who else read it . But I intended to go before you but I don ' t know if it did . Here I am. SUPERVISOR SCOTT RUSSELL : I am more than aware of the issues . And the Town ' s action . I am familiar with the ongoing problems . No doubt . MS . CAROLINE WINDMULLER : Very good . It was brought to our attention just today that there is some significant additional code violations that are under discussions currently involving the campgrounds . So that maybe taking center stage at the moment, as I understand . We greatly appreciate the investigation . Truly . We trust that all appropriate action will be taken . We believe however, that it hadn ' t come across the Town Board . So that is why we are here again to come before you and get on the same page . SUPERVISOR SCOTT RUSSELL : Of course . February 14 , 2023 Regular Meeting 25 MS . CAROLINE WINDMULLER : On behalf of everybody . They are not all here . They ' re on a hot date . But anyway, there are and have been for a very long time , people living in illegal trailers year round at this so-called seasonal transient campground. After our letter was received by the Town Attorney ' s Office , Code Enforcement was dispatched and soon after one of the three visible trailers -- illegal trailers being occupied across from our house was moved . However, it was simply relocated to the main part of the campground, which in no way resolved the issue of people living year-round inside the campground . The speeding traffic still remains and there is even a school bus stop to accommodate those living there . There are regular fuel deliveries and there has been electric run to the campers , who again, not in designated camp sites , but instead in the storage lot which is quickly becoming a junk yard from our home . There has been two February 14, 2023 Regular Meeting 26 recent fires . One involved a camper essentially located inside the campground. And the other occurred on the power lines directly in front of our home . Nearly touching our home . That raises the question to us , the amperage of those lines that is connected to the campground . The fire occurred shortly after a large entertainment stage was built nearby to host music performances . That would require a lot of additional electricity. Coincidence, maybe . But maybe not . We ' re not sure how they handle sewage from those immobile and permanent stationed campers in the lot , but correct me if I am wrong, I believe that would require some sort of permit or public hearing . There have been several instances of vulgar domestic disputes and police response . To reiterate, we have repeatedly gone to the owners with our concerns for years now and we have tried to trust their promises that it will stop, yet here we are . They push it off . First it was one February 14, ,2023 Regular Meeting 27 trailer, then two . Then three . That is just what we can see from the front door . There are several others going inside the campground and living . We ' re certainly not construction workers . After all , I don ' t believe construction work happens throughout the night . It is our understanding that the campground owners were attempting to remedy the issue by applying for night watchman permit . This appeared to us immediately as not some sort of bogus loophole to make one trailer legal , but as a completely several illegal issue from several dwellings . And it would not remedy anything . We plan to attend the meeting of the details , albeit in silence . I understand you can attend but not speak . We ' re willing to go and do that and understand the terms of that permit and what it means to us . When I called to get the generalized agenda, this past Friday, I was told that the application had been withdrawn . After the speaking with the Town Attorney, we February 14, 2023 Regular Meeting 28 learned that the meeting was not -- Executive meeting agenda and is not completely closed to the public . Hence the reason why we are here in front of you . We were told that after a complaint has been made and a warning has been issued to the defender, they have 30 days to remedy the issue before a fine occurs . We are fast approaching 30 days and the issue has not been resolved. So I am wondering and I want to ask you, has that been thrown out as a result of this derailing plan? Off the tracks with other issues? Has that taken that away that they don ' t get fined? And if there was an Executive meeting? SUPERVISOR SCOTT RUSSELL : Let me just clarify that for you . MS . CAROLINE WINDMULLER : Yes , please . SUPERVISOR SCOTT RUSSELL : The applicant was notified that he does not qualify for that particular permit . They are intended to be temporary and February 14, 2023 Regular Meeting 29 for a site that needs to be secured. Usually with construction and things like that, or they can demonstrate that there have been instances of theft or vandalism, they can come in and say we need to secure the site with a watchman, but it ' s only usually good for six months . I had explained to the owner directly that when we talk about meeting and proof with police reports, that doesn ' t mean they ' re generating . In other words, those don ' t count because those reports are -- with all due respect to him, he ' s generating -- his activity is generating those reports . There was no discussion today whatsoever . And it was actually the building inspector who called him last week and told him he does not qualify. MS . CAROLINE WINDMULLER: So there is no trailer permit on the table for him? SUPERVISOR SCOTT RUSSELL : No . He does not qualify . And I cannot envision he would qualify for any . Period . A concern not only for the neighbors but I would hope for the Town of Southold. We are concerned with the timeliness of a resolution . March 31st , I believe the season for campground opens up, and at which time, it will be hard to identify where the year round residents are . It is still by law a seasonable campground, I understand and we want to stop the year round . We of course understand that these things take time . We would also kindly ask to be kept abreast of the conversation pertaining to these concerns . If there is no ramification for their actions , meaning the campground, there is no reason to (inaudible) . Furthermore, the issues do not stop there . For good February 14, 2023 Regular Meeting 31 measure , I would like to share that the in-season problems will soon begin with very loud music . Speeding cars , recently flattening our chickens by the way . Just to give you a sense of how fast they go . Stadium lights . Definitely not dark sky compliant . And the horrible late night back drop of whatever explosive or violent film they ' re screening less than 100 yards from our home, while my children try to sleep . It seems the days of star gazing by the camp fire are over for the tourists . To quote Melissa actually, "well, you ' re the one who bought a house near a campground. " And yes , I would say to that . We absolutely made a very conscious decision to purchase a home outside of the Village and the Business Hamlet and neighboring -- a happily neighboring campground that previously valued nature and family .
