RESOLVED, that the Southold Town Board of Trustees grant an
amendment to Permit $255 for maintenance dredging to run
concurrent with the DEC Permit which expires August 23, 1998.
The Trustees also requests that spoil material be place on the
west side of Petty's Pond.

This is in response to your letter dated August 12, 1993
requesting a decision on the application of Beixedon Estate
Property Owners for a tidal wetlands permit to dredge and deposit
spoil in the Town of Southold, Suffolk County. Your letter was
received on August 16, 1993 and in accordance with the Uniform
Procedures Act, a reply is due within five (5) business days of
that date.
The permit for this facility is enclosed. Please pay
special attention to each of the conditions attached to the
permit. A failure to comply with any one of the conditions is a
violation of the Environmental Conservation Law and would be
grounds to suspend or revoke this permit. Please contact the
Bureau of Marine Habitat Protection at the Region 1 Headquarters,
phone (516) 444-0295, prior to the submission of plans required
by permit condition 19, to discuss their specific concerns.

The mechanical maintenance dredqinq of approximately 475 cubic yards of shoaled material
from the inlet to Petty's Pond, to a depth of 6 feet below mean low water, over an
irregularly shaped area with maximum dimensions of 70 feet by 50 feet. Dredge spoil is
to be deposited above wean high water in areas adjacent tn tidal-wetlands, one ~ beach tc
the west and the other on an upland area to easz of the dredge site, in accordance with
plan approval from the NYSDEC Bureau of Marine Habitat Protection, reouired before each
dredging episode.
By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance
with the ECL, all applicable regulations, the General Conditions specified (See Reverse Side) and any Special
Conditions included as part of this permit.

If project design modifications take ~lace after permit issuance, the
permittee shall submit the appropriate plan changes for approval by the
Regional Permit Administrator prior to undertaking any such
modifications. The permittee is advised that substantial modification
may require submission of a new application for permit.

Any failure to comply precisely with all of the terms and conditions of
this permit, unless authorized in writing, shall be treated as a
violation of the Environmental Conservation Law.

The permittee is advised to obtain any permits or approvals that may be
required from the U.S. Department of Army Corps of Engineers, NY
District, 26 Federal Plaza, New York, NY 10278, (Attention: Regulatory
functions Branch), prior to commencement of work authorized herein~

The granting of this permit does not relieve the permittee of the
responsibility of obtaining a grant, easement, or other necessary
approval from the Division of Land Utilization, Office of General
Services, Tower Building, Empire State Plaza, Albany, NY 12242, which
may be required for any encroachment upon State-owned lands under water.

it shall cause unreasonable obstruction to the free navigation of said
waters or flood flows or endanger the heatth, safety or welfare of
the people of the State, or cause loss or destruction of the natural
resources of the State. the owner may be ordered by the Department to
remove or alter the structural work. obstructions, or hazards caused
thereby without expense to the State. and if, upon the expiration or
revocation of this permit, the structure, fill, excavation, or other
modification of the watercourse hereby authorized shall not be
pleted, the owners, shall, without expense to the State. and to such
extent and in such time and manner as the Department of Environmental
Conservation may require, remove ai~ or any portion of the uncompleted
structure or fill and restore to it~ former condition the navigable
and flood capacity of the watercourse. No claim shall be made against
the State of New York oh account of an'/ such removat or alteration.
That the State of New York shall in no case be liable for any damage
or injury to the structure or work herein authorized which may be caused
by or result from future operations undertaken by the State for the
conservation or improvement of navigation, or for other purposes, and
no claim or right to compensation shall accrue from any such damage.
Granting of this permit does not relieve the applicant of the responsi-
bility of obtaining any other 0erm~ssion. consent or approval from
the U.S. Army Coros of Engineers. U.S. Coast Guard. New York State
Office of General Services or local government which may be required.
Ali necessary precautions shall be taken to preclude contamination
of any wetland or waterway by suspended solids, sediments, fuels.

authorized has r~t been comoleted, the appllcant shall without e~pense
to the State, and to such extent and in such time and manner as the
Department of Environmental Cor~servation may require, remove all or
any portion of the uncompleted structure or fill and restore the site
to its former condition. No claim shall be made against the State of
New York on account of any such removal or a~teration.
If granted under Articte 36. this permit does not signify in any way
that the proiect will be free from flooding,
17. If granted under 6 NYCRR Part 609,. the NYS Department of Environ-
mental Conservation hereby certifies that the subject proiect will no:
contravene effluent limitations or other limitations or standards under
Sections 301,302. 303. 306 and 307 of the Clean Water Act of 1977
(PL 95-217) provided that all of the conditions listed herein are met.

Im general, spoil will be placed in the areas indicated on the project
plan. However, no material is to be.dredged or deposited until a survey
of beach contours and a spoil disposal plan for each dredging episode is
submitted to and approved ~n writing by the NYSDEC Bureau of Marine
Habitat Protection, SUNY Campus, Loop Road, Building 40, Stony Brook, NY
11790-2356.

A copy of this permit and any supplementary conditions or approvals
shall be available at the project site whenever authorized work is in
progress.

The enclosed permit sign or a copy of letter of approval shall be
protected from the weather and posted in a conspicuous location at the
work site until completion of authorized work.

At least 48 hours prior to commencement of the project, the permittee
shall complete.and return the top portion of the enclosed receipt form
certifying that he is fully aware of and understands all provisions and
conditions of this permit. Within one week of completion of the
permitted work, the bottom portion of that form shall also be completed
and returned.

Dear Mr. Haje:
The following special conditions were inadvertently left off
the above permit. These are routine conditions attached ~o most
dredging permits issued in Region I. Therefore, pursuan= to
Uniform Procedures, Part 621.!4(a) (1) this Department intends to
modify your permit. The permit will be modified to include these
conditions.
1)
Any debris or excess material from construction of this
project shall be completely removed from the adjacent area
(upland) and removed to an approved upland area for
disposal. No debris is permitted in tidal wetlands.
2)
The s=orage of construction equipment and materials shall be
confined to within the prcject work site and/or upland areas
grea~er than 25 linear feet distan~ from the tidal wetland
boundary.
3)
Ail dredging shall be conducted so as to leave a uniform
~c~m elevation free of ~ounds or holes.
4)
Dredging shall be undertaken no more than once in any
calendar year unless specifically authorized by the
Department.
5)
Dredging is specifically prohibited from June 1 through
September 30 each year to protect spawning shellfish.
6)
For maintenance dredging projects permittee shall yearly
submit a Notice of Commencement specifying disposal site
(updated site plan) plan) and Notice-of Completion
specifying amount of dredged material deposited on approved
disposal site.

Within 15 calendar days of the mailing of this notice of
intent, the permittee may submit a written statement to the
Department giving reasons why the permit should not be modified,
or requesting a hearing or both. Failure of submission of this
statement shall result in the modification becoming effective on
February 1t, 1994.
This letter shall serve as an amendment to the original
permit and as such, shall be posted at the job site. All other
terms and conditions remain as written in the original permit.

The following action was taken by the Board of To%m Trustees
during their regular meeting held on August 25, 1988 regarding
the above matter:
Whereas, Mary E. Travers, President, Board of Directors
for the Beixedon Estates Association, Inc. requested to amend
Permit No. 469 to construct a 33' bulkhead extending eastward
from the previously approved bulkheading of Freedman, Ilibassi &
Ball; to construct a 10+/- return and to install a set of
detachable stairs on property located ~t the foot of Arshamomaque
Ave., Southold,
WHEREAS, the Trustees conducted an on site inspection of the
property in question, and
WHEREAS, the Department of Environmental Conservation has
approved an amendment of the work proposed, and
WHEREAS, the project will not adversely affect the wetlands
of the Town nor otherwise adversely affect the health, safety and
general welfare of the people of the Town, NOW THEREFORE BE IT
RESOLVED that the Southold Town Trustees Approve the request
made by Mary E. Travers on behalf of the Beixedon Estates
Property Owners to amend Permit No. 469 to construct a 33'
bulkhead with a 10+/- return, and to install detachable stairs on
property located at the foot of Arshamomaque Ave., Southold
subject to the following conditions:
1. Dry wells are to be installed to contain run off on the
landward side of the structure. Plan for a 2" rainfall.
2. This determination is subject to any other approval or
permits that may be applicable to this project.
3. It is noted that Mr. & Mrs. Ball are in agreement to
this amendment of this application.

Gentlemen:
The Beixedon Estates Association, inc., is seeking
approval of an amendment ~o Permit Application #575 and Wet-
lands Permit #469, filed with the Town of Southold on
August 26, 1987, for the construction of a timber retaining
wall, entirely above the line of mhw, at the beach encrance
on Arshamomaque Avenue.
The bulkhead would be continuous with the one in
the process of being constructed along the properties of
Freedman, Ilibassi and Ball and would extend across the foot
of Arshamomaque Avenue from the east side of the Ball prop-
erty to the west side of the Lewis property with a~ten-foot
return. Permission has been received from the owners of the
properties involved.
The need is due to a serious erosion and washout
problem that has undermined the area at that point and
which prevents access to the beach by the residents of the
community.
The New York State Department of Environmental
Conservation is reviewing our application and is expected
to respond within the next several days.
Attached are the survey of the area made by
Peconic Surveyors, P.C., Southold, New York, and the
proposed contract for the job from James T. Rambo, Inc.,
Southampton, New York.

WHEREAS, En-Consultants, Inc. on behalf of the Beixedon E~tate
Property Owners applied to the Southold Town Trustees for a
permit under the provisions of the Wetland Ordinance of the Town
of Southold, application dated October 2, t985 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations
and,
WHEREAS, a public hearing was held by the town Trustees with
respect to said application on December 26, 1985 at which time ail~
interested persons were given an opportunity to be heard,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area; and
WHEREAS, the Board considered all testimony and documentation
submitted concerning this application; and it is noted for the
record that there has been no public opposition; and
WHEREAS, the Board has determined that the p%oject as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW~ THEREFORE, BE IT
RESOLVED that En-Consultatnts, Inc. on behalf of Beixedon Estate

The decision whether to issue a permit will be based on an evaluation of
the probable i~pact including cumulative impacts of the activity on the
public interest. That decision will reflect the national concern for both
protection and utilization of important resources. The benefit which
reasonably may be expected to accrue from the activity must be balanced
against its reasonably foreseeable detriments. All factors which may be
relevant to the activity will be considered including the cumulative
effects thereof; among those are comservation, economics, aesthetics,
general environmental concerns, wetlands, cultural values, fish and
wildlife values, flood hazards, flood plain values, land use, navigation,
shoreline erosion and accretion, recreaglon, water supply and conservation,

The applicant, Beixedon Estate Property Owners, requests Department of
the Army authorization to dredge with ten years maintenance with disposal
in the inlet of Petty's Pond, Shelter Island Sound, at Southold, Suffolk
County, New York.
The work involves the dredging of an area approximately 600 feet by 50
feet to 6 feet below mean low water, removing approximately 6500 cubic
yards of dredged material. The applicant proposes to deposit all dredged
material on the adjacent downdrift beach to the west as beach nourishment.
The spoil would be pumped hydraulically to an area on the beach from above
mean high water to approximately mean low water, and then graded into
the beach. The applicant estimates dredging of approximately the same

Dear Mr. Greene:
Attached please find applications and associated information relating
to the project referenced above. In times past, this type of project
would have been undertaken by a public agency (i.eo SCDPW) as it
benefits many residents. However, budgeting and other restraints
have made it necessary for the residents themselves to do the proJect.
qlue inlet was first dredged in the 1940's to make it a navigable
waterway in conjunction ~ith the Be~-~n Estates subdivision. While
it may have been dredged subsequently, we have thus far been unable to
locate specifics.
The operation will be done by a ~ydratulic dredge and the spoil used
as beach nourishment on the adjacent downdrift beach. The dredged
material consists of sand and gravel~ as does the receivirg beach. From
the presentations given by personnel of the Vicksburg Waterways Center
of the COE at a recent semfl_uar, the effects of spoil of similar con-
stitution on the indigenou~ ~ i'auna of the spoil site is minimal and
transitory. Therefore, we feel it is appropriate to place the material
fr~n 20 +-' above MHW to RK~ without the necessity of diking. Further,
the work will be done durin~ the winter or early spring if permits
are issued promptly to loosen shy ~mpact.
