You have failed to provide this office with a title search as requested in my letter of June 4, 1990 and former Board President, Frank Kujawski' s letter of August 15, 1989. To ascertain Trustee ownership/interest, if any, in the lands beneath Schoolhouse Creek and it's tributaries, the Board will need to see a title search which goes back to October 28, 1676. 2. Any Conveyance of property or abandonment of roads by the Town Board is likely a separate and unrelated matter and would only be valid for areas always existing as terra firma. 3 . The copy of the U.S. Supreme Court, decision Kaiser Aetna ET AL. V. United States you provided is interesting and I have forwarded a copy to the Town Attorney. It would seem to strengthen the idea that Trustees should not relinquish public ownership where we already may have some. In closing I might suggest you and any other property holders with underwater land interests on Schoolhouse Creek Consider negotiating a quit claim deed, or similar instrument with the Trustees which might one way or the other clear up title to underwater lands in this creek. Particularly favorable in this regard would be if you or others could transfer title to tidal wetlands in the area in exchange for a quit claim deed such that we can make a clear statement of the Public interests of such an action. Such a quit claim or transfer request should properly be the subject of a public hearing wherein our citizens may have a voice in our decision. V y truly yours, John M. The deed submitted of My father, Harry H. Tuthill dated 1926 is the end of the title search. Several parcels of land in New Suffolk are from the subdivision of the lands included this in this deed. These include my rroperty talus the lands owned by Mr. Schultheis. This deed as all deeds only describe the boundaries of the property. This deed of N.v fathers encompasses the creek and all its tributaries. In 1838 my ancestors subdivided all of New Suffolk, That deed would only mention the sourounding waters -plus the -4ckhan property. With reference to ownership,, sin the period of 1838 the Town Board also acted as the trusteed for the under waters land odfied by the Town of Southold. Therefoee it was in their rower to deed this land for the construction of a highway. The law requires such roads tdQbe built in seven years. It is also noted that the original Suffolk County Tax Maps designated this land as that of Southold Town. Uoon a review of the facts they removed the name of Southold Town. Since the Suffolk Couty Tax Mar Department is assumed knowledgeable, Your -problem of ownershir should be addressed to them, rather than me. T would also like to kote that I do not need a quit claim deed for land I already own. I thank you for your concern. This permit will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Two inspections are required and the Trustees are to be notified upon completion of said project. Please return to the Building Department for a determination on the need for any other permits which may be required for this project. Pursuant to 15 CFR Section 930.63, and based upon the project information submitted, the Department of State concurs with your consistency certification. The Department recommends that the fringe intertidal marsh at the site not be disturbed during the dredging, bulkheading and backfill activities proposed. This concurrence is without prejudice to, and does not obviate the need to obtain all other applicable licenses, permits, and approvals required under existing State statutes. The Southold Town Trustees were unable to decipher your hastily drawn sketch which was submitted on April 24, 1991 subsequent to our regular meeting on April 4, 1991. At that meeting (which you attended) we conditioned issuance of a Negative Declaration for your proposed bulkhead/retaining wall on Cutchogue Harbor on the request you reduce the height as much as possible (hopefully to 1-1 1/2 feet above the road height) and submit us a new drawing indicating the height above the road which you are prepared to maintain. As this Board will not issue the Negative Declaration or continue action on this application where we are unable to understand exactly what you are proposing, we are asking that you stake the line of the proposed bulkhead with the tops of the stakes flush with the proposed bulkhead height (or suitably marked so there is NO question what height you are proposing) . Call the clerk of the Board to request an inspection of same. For your information our next monthly field inspections are on May 30, 1991. After you have staked your proposed project, we request that you have your licensed Engineer or architect submit us a simple line drawing to an appropriate scale of 1"=20' or 1"=30' in conformity with what you propose and what we have seen in the field. In addition, Spartina alterniflora appears to be thriving at the site within the area that the applicant is planning to backfill. Please indicate the total square footage of littoral zone, shoals and mudflats, intertidal marsh and high marsh tidal wetlands that is to be eliminated. 2) The Public Notice indicates that the stated purposed for dredging and bulkheading at this site is to provide erosion control. The photos submitted show that an erosion problem does not exist at this location. Please explain the need for accomplishing the work proposed. 3) The plan drawing shows that Orchard Street lies 225 feet to the south of the project site, but the photos show a road located about 15 feet from the proposed bulkhead site. Although I am adopting ALJ O'Connell's findings regarding the functioning of the tidal wetland in question, ,the ,arguments made in the hearing concerning the applicable use guideline forthe proposed activities suggests that a short discussion of the interrelationship of the mapping and permit processes is warranted. Tidal wetlands receive their classifications as a result of the mapping process ( see 6 NYCRR 661.4(hh) ) and those classifications can only be changed by map amendment (6 NYCRR 661.27) . The principal legal significance of such classifications are reflected in the use guidelines set forth in 6 NYCRR 661.5. While the permit process cannot alter the use guidelines for particular tidal wetlands, it is both necessary and appropriate that the manner in which a tidal wetland is currently functioning be examined in the permit process further to determining whether the permit issuance standards are met. In this case, the Applicant has met his burden of proof and, provided a factual basis upon which a consolidated permit can be granted. Accordingly, this permit application and water quality certificate are approved. I hereby direct the Department Staff to issue a consolidated, permit; in accordance with the proposal submitted by the Applicant subject to the Department' s standard conditions and the specific conditions recommended in the Report to protect the water quality of School House Creek during the construction of this Project. The Project Site is located off of orchard Street on the School House Creek ( the "Site" ) , in the community of New Suffolk, Town of Southold, Suffolk County, New York. This application was filed and processed pursuant to Environmental Conservation Law ( "ECL") Article 70 (Uniform Procedures) ; Article 3 , Title 3 (General Functions) ; Article 15, Title 5 (Protection of waters) ; Article 25 (Tidal Wetlands) ; and Section 401 of Federal Clean Water Act (PL 95-217) (Water Quality Certification); and pursuant to Title 6 of the Official Compilation of Codes, Rules Regulationsof the State of. SUMMARY POSITIONS OF THE PARTIES The Applicant The Applicant contended that the Project would be compatible with the Tidal Wetlands Act (ECL Article 25) and Tidal Wetlands - Land Use Regulations ( 6 NYCRR Part 661 ) , that the Project would be reasonable and necessary, that the Project would promote the health, safety and welfare of the local community, and that the social and economic benefits of the proposed Project would outweigh the potential impacts to the wetland. Furthermore, in his closing brief, the Applicant argued that within the context of a permit hearing, the Department Staff cannot change the characterization of the tidal wetland at the Site from Littoral Zone (LZ) , as it currently appears on the map, to Intertidal Marsh ( IM) and High Marsh (HM) , based on an on-site inspection. Rather, procedures to amend tidal wetland maps are outlined in the Regulations ( Section 661.27) which are separate and distinct from permit hearings. Therefore, the Applicant contended that he has met his burden, and a tidal wetlands permit for the Project should be issued. _ Lawrence Tuthill appeared as a witness on his own behalf to 'support his permit application. j The Department Staff The Department Staff ( "Staff" ) opposed the. issuance of a . tidal wetlands permit contending that the Project would not be compatible with the public policy of the Tidal Wetlands Act. The Staff argued that the Project would adversely impact the current and potential values of this wetland which include marine food production; wildlife habitat; flood, hurricane and storm control ; cleansing of the ecosystem, and organic material absorption. in short, the Staff contended that the Project would not meet the L 6. _.. _ 3 _ permit issuance criteria outlined in 6 NYCRR Part 661 . To support its position, the Staff called Charles Hamilton, Bureau of Marine Habitat and Protection, Region Y Office, as its sole witness. Mr. John Scott Mr. Scott was granted party status and supported the issuance of a permit for this Project.: Mr. Scott has -a lease agreement with the Applicant for the rental of- four boat slips, the repair and improvements of which require approval of the subject permit application. Mr. Scott further contended that the Project would improve the safety of a commercial .enterprise,' which provides livelihood and value to community residents,: and argued in the closing brief that "the evidence presented by the Department is insufficient to establish that the impact on the wetlands is so substantial as to justify a taking of;Applicant's property.* Mr. Scott also appeared as a witness on his own behalf. FINDINGS OF FACT 1. Lawrence M. Tuthill, 1215 Inlet Lane, Greenport, New York 11944 ( "Applicant" ) , seeks approval from the Department for the Project, as described below, on lands which he owns located off of Orchard Street on School House Creek in the community of New Suffolk, Town of Southold, Suffolk County, New York ( the "Site" ) . The Project Site is approximately 1,200 square feet and would consist of the following activities: (1) construction of an 80-foot bulkhead to connect with existing bulkheads located immediately east and west of the Site; (2) dredging approximately 80 cubic yards of material from the area north (or seaward) of the proposed bulkhead location; ( 3) placing this dredged material as backfill in the area located south (or landward) behind the proposed bulkhead location; and ( 4) providing an in-kind, in-place replacement of an existing dock. 2. The Site is located within School House Creek ( the "Creek" ) , which area is a regulated Tidal Wetland as depicted on Tidal Wetland Map 712-540 Number 4. The entire Creek, including the Site, is classified as Littoral Zone (LZ) . 3. The Creek was dredged between 1929 and 1930 in order to create slips for fishing boats. At that time, intermittent lengths of -the shoreline of the Creek are bulkheaded and there are approximately 150 boat slips located in the Creek. The Creek is currently zoned for commercial marina use by the Town of Southold. 4 . Tidal wetland vegetation is present on the Site and includes: low marsh cordgrass (Spartina alterniflora) and 'salt meadow grass ( Spartina ap [ens) . Specimens of the former wetland plant species are characteristic of tidal wetlands referred to as Intertidal Marsh ( IM) and those of 'the latter plant species are characteristic of High Marsh (HM) areas . 4 - 5. Department Staff testified that the benefits of this tidal wetland are those characteristic of Intertidal Marsh (im) , and include marine food production; flood, hurricane and storm control; absorption of silts and other organic material, and cleansing of the ecosystem. 6. Pursuant to a Notice to All Shellfish Harvesters (Exhibit 6) issued by the Department and dated Stony Brook, New York, January 1, 1988, School House Creek is an uncertified area regarding the harvest of shellfish. 7. John Scott ( Intervenor) leases four boat slips from the Applicant and uses the dock space associated with the Site in conjunction with his shellfishing business. Mr. Scott testified that the Project would contribute the following social and economic benefits to the community: ( 1) it would allow fishing boats to be loaded and unloaded. more easily; (2) it would improve the safety of the Site as a workplace; and ( 3) it would provide an economic benefit to the local fishing industry by allowing this business to remain in the area, and that these benefits demonstrate a need for the Project. _ 8 . School House Creek is primarily utilized as a marina area with slips rented out mostly to local individuals thereby providing a social benefit to the community. Because of the location and configuration of the Creek, it provides safe harbor on a year round basis in all weather conditions, and consequently an economic benefit to those individuals who utilize this facility as a harbor. 9 . Mr. Tuthill indicated that there are no alternatives to the proposed Project in view of the size and configuration of the channel in School House Creek. In addition, the no-action alternative and the alternatives presented by the Department Staff which are off-site are not acceptable in Mr. Tuthill's opinion because of the detrimental effect that these alternatives would have on Mr. Scott' s shellfishing business. 10. Mr. Tuthill holds a Bachelor's Degree in Civil Engineering and is a licensed Professional Engineer in New York State. Additionally, the Applicant has owned and operated a marine engineering and construction firm for over 30 years, and has served as marine engineeringconsultant to the Town of Southold Planning Board for 20 years. 11. The Department "Staff did not present testimony and offer evidence to indicate that the Project would detrimentally affect the public health and welfare of the people of the State of New York. - 5 - DISCUSSION Although a formal Issues Conference was not held, the _focus of the adjudicatory hearing centered on the standards for the issuance of a Tidal Wetland permit. However, two of these standards were not raised as issues by any of the Parties. They included: ( 1) a determination as to whether or not the Project would be compatible with the public health and welfare [Section 661 .10(b) (1) ( ii) ] ; and (2) a determination as to whether or not the Project would comply with the development restrictions contained in Section 661.6 (Section 661.1O(b)(1) ( iv) ] . Similarly the Parties did not 'raise any issues regarding: - ( 1) the permit standard for a Protection of Waters permit which requires a determination as to whether or not the Project would endanger the health, safety and welfare of the people of the State of New York (Section 608. (b) ] ; -and (2) any effluent limitations, water quality standards and thermal discharge criteria set 'forth in Parts 700 et seq for a Water Quality Certification pursuant to Section 608.7.— ALJ Irving did not articulate concerns regarding these standards, or otherwise indicate that said standards should be issues for adjudication. Consequently, the Applicant has no further burden , to demonstrate that the Project would meet these criteria for permit issuance and water quality certification. Finally, the Applicant' s position that a ermit hearing is not the appropriate forum to amend a tidal wetlands map is accepted. Pursuant to Part 661 (Tidal Wetlands - Land Use Regulations) , standards for the issuance of a permit are listed (Section 661 .10) ; also contained within the instant regulations is the precedure to be used to amend final tidal wetlands maps ( Section 661.27) . The subject of the instant proceeding was the issuance of a Tidal Wetlands permit, not the amendment of a tidal wetlands map. Therefore, in reviewing and applying the Use Guidelines [Section 661.5(b) ] to the Project, a consideration of which is a permit issuance standard, the appropriate tidal wetland area or classification to consider for this application is the littoral zone (LZ) as it is indicated on the final Tidal Wetlands maps ( see Conclusion Nos. 6 and 7 below) . CONCLUSIONS 1. Pursuant to 6 NYCRR Section 661 .10(a) , the Applicant has the burden- of establishing that the proposed Project meets each of l the applicable standards for issuance of permits as set forth in 6 NYCRR Section 661.10(b) J 2. In considering the reasonable development of the State, and the social and economic benefits as identified in Finding Nos. 7, 8 and 9 which may be derived from the proposed Project, the Applicant has adequately demonstrated that this Project is compatible with the public policy of the Tidal Wetlands Act pursuant to Section 661 .10(b) ( 1 ) ( i ) . - 6 3. As indicated in Finding No. 11, and the Discussion above, the question of whether or not the Project is compatible with the public health and welfare of the State is not at issue in this hearing. 4. In considering reasonable alternatives to the Project (Finding No. 9) and based on the education and work experience of Mr. Tuthill (Finding No. 10) , the Applicant has met his burden to show that the Project is reasonable and necessary and no other reasonable alternatives to the Project exist. Furthermore, Finding No. 7 demonstrates need for the project. 5. The development restrictions contained in 6 NYCRR Section 661.6 are not at issue in this hearing. 6. Although it is inferred that the benefits of tidal wetlands are a function of the vegetative species present, this inference cannot be accepted in considering this matter based on the size of the Site (1,200 square feet) and the relatively poor water quality of School House Creek (Finding No. 6 ) . Therefore, at the present time the Site does not function or provide the benefits of Intertidal Marsh (IM) and/or High Marsh (HM) , from: the biological perspective. The Site functions as Littoral Zone (W . 7. The Site is mapped as Littoral Zone (LZ) and regardless of how the tidal wetland functions, for regulatory purposes, it cannot be considred to be intertidal Marsh ( IM) or High Marsh (HM) absent a map amendment. Although the way in which the wetlands functions must be taken into account when evaluating permit issuance criteria, the burden of overcoming the presumptively incompatible status is not applicable where such status would only be appropriate for IM or HM designations. 8. Pursuant to Section 661.5 (use guidelines) , the construction of bulkheads (#29) is a generally compatible use in the LZ. Dredging (#27) , and the disposal of dredged material as fill (#31 ) are presumptively incompatible uses in the LZ. ordinary maintenance and repair of existing functional structures such as docks (#21 ) are uses which do not require a permit or notification letter of approval. 9. Pursuant to Section 661.10(b) (1) (v) , the Applicant must overcome the presumption of incompatibility with regard to the dredging portion (activity2) of the Project and the use of this dredged material as fill (activity 3 ) . The Applicant has succeeded in overcoming the presumption of the incompatibility for these activities by demonstrating that the Project would have a de minimus effect and in no way would impair the functions and - ene its associated with the tidal wetland (School House Creek) . Therefore the Project would be compatible with the preservation of the present and potential value of the tidal wetland. - 7 10. Section 608.6 outlines the standards for the issuance of a permit;pursuant to ECL Article 15, Title 5 (Protection of Waters) . Accordingly, based on Finding No. 7 the Applicant has met his burden to demonstrate that the Project is necessary, and absent any other alternatives (Finding No. 9) , the Project is reasonable pursuant to Section 608.6(a) . il. As indicated in the Discussion above the question of whether or not the Project would endanger the health, safety and welfare of the people of the State of New York (Section 608.6(b) ) is not at issue in this hearing. 12. Pursuant to Section 608.6(c) , the Applicant must demonstrate that the Project would not cause unreasonable, uncontrolled or unnecessary, damage to the natural resources of the State, including soil, forests, water, fish, and aquatic and land-related environment. The Applicant has met this standard by demonstrating that the impacts are de minimus, and the Project would not cause unreasonable, uncontroll-e3 or unnecessary damage to the natural resources associated with School House Creek because of the limited area of the Site. RECOMMENDATIONS After reviewing the entire record and based on the foregoing Findings of Fact and Conclusions, it is recommended that: (1) the subject permit application submitted by L.M. Tuthill for Tidal Wetlands and Protection of Waters Permit, and Water Quality Certification be approved, and that a consolidated permit be issued for the Project as proposed by the Applicant. ( 2 ) this permit should contain the following Special Conditions: (a) Permitted work may only be done in accordance with specifications and at locations indicated on plans prepared by J.H. Geideman dated December 13, 1987 (Appendix A of this Report) . (b) Bulkheads must be constructed and sealed prior to placing fill so that erodible materials cannot erode into State waters. (c) if concrete is used, concrete mix shall not be allowed to flow into State waters during construction. _ (d) All excess dredged materials not needed as backfill shall be removed to an upland site farther than 300 feet from any regulated tidal 'wetland boundary and farther than 100 feet from any regulated freshwater wetland boundary.
