Hi we are concerned about the spacing of the dock at our home at 755 lupton point road we want to conform to the
town code but another dock is encroaching especially when 4 or more boats are parked there am not trying to cause a
problem or be a bad neighbor but if we don't correct this now before it becomes permanent I am afraid there will be a
very crowded situation . Here are pictures of the way the dock to my left is now (quite an eye sore) I am told that there
is a permit for this. Please help.

Dear Mr. Krupski:

Our office represents the owner of the above -referenced property located on Deep Hole Creek.
On October 28, 1983 the Board of Trustees issued a permit to Mssrs. Hanus, Loeffler, and
Ganshaw to install a recreational dock within the confines of a 15' Right of Way to the water. A
coy of the permit and its approved configuration is enclosed for your information. It appears that
these owners or their successors in title have installed/modified the dock in violation of the permit
conditions and plans (see survey). The dock presently extends on an angle in front of the Marten
property and appears to be longer than the structure approved. This unauthorized modification
has resulted in the inability of Mr. Marten and Mr. Murray to secure their own dock approval as
the water depths sufficient for a dock are located in this area.
I believe that both docks can be accommodated in the area if the Hanus dock had been
constructed properly.
Therefore, I would respectfully request that you investigate the non-compliance and advise our
office as to your findings.

We would like to obtain some information re: the dock off the Right of Way. This dock is

was issued, including the drawing on which it was based.

Mr. & Mrs. Jack Drobet, Box 965, Lupton's Pt., Mattituck
(Phone 298-8331) were in regarding this grandfather
permit that was approved. Mr. & Mrs. Drobet are saying
that the application that was approved was not a true
reflection of what was existing and therefore, they are
concerned that the application was misrepresented.
They are forwarding a letter and I have requested further
information and pictures supporting their claim for the
Board's information.

The map of the dock plan submitted by Mr. Hanus under the "grandfather clausd'
is a false statement. The 23 foot section at the end of the dock at right
angles to the original dock was added in 1985. The survey made by the team
of Brooks and Shalvey is accurate and is filed with the plan submitted.
We reported this 01985. A bay constable made a survey at that time.
We assumed this would be corrected,
Raw we are making a formal report. Mr. Haxnus has moored a Sea Tow
boat at this dock and proposes to run a business from a Class A residential
area, To object to this. MY. Dzenkowski, the bay warden, has told us this
is illegal and notice will be given: Mr. Hanus to remove the boat. If it is
not removed within thirty days, action will be takene We wish to be certain
this will be taken care of.
