Meyer: Please excuse our delay in responding to your August 10, 1995 inquiry. Please be aware that Department of the Army permit #14178, was issued for this project and remains valid through June 4, 1996. Our purpose in filing at this time is to insure that a new permit will be issued which will allow this continuing maintenance procedure to occur following the expiration date of the current permit. We ere unsure whether the land underwater in the area of the proposed dredging belongs to the Southold Town Trustees or the State of New York es administered by the office of General Services. This area has been modified by man many times, so that it is difficult to ascertain where the original shoreline was located without an extensive and expensive historical investigation. I would hope that this would not be necessary, especially in light of the fact that this channel has been maintenance dredged many times and is necessary for continued public access to the marina. spoil can be placed on the applicant's adjacent upland and retained by earthen berms using on site soil. Once the dredged spoil has drie,d the area will be regraded to blend into existing contours. --1-- November'10, 1995 page 2 As this upland is used for boat storage, it cannot be planted but is expected to revegetate naturally. Please note that a 75' buffer area between the dredged spoil and the line of mean high water will be observed. As this method has been used in the past with no runoff into the adjacent waterway, we feel confident that it can be imployed in future as well. An alternative construction design is steel which is economically ~nfeasible for the appl~cant'and less aesthetically pleasing to the eye. Installation of a rock gabiOn was ruled out as a less effective method of stabilizing the commercial upland which has experienced a significant eroBional pattern over recent years. From a health .and safety perspectivew gabions have a tendency to attract rodents which are very destructive and are known carriers of communicable disease. The Mill 'Creek Inn Restaurant abutts the property on the northern end of the east property line theraby increasing the probability of inf'estation. Mitigative measures include pulling the bulkhead landward 15' on the northern end and f0' landward on the southern end! resulting in installation above the level of mean high water in most instances. This slight variation in penetration is Costello Marine ( ~tracting Corp. ~e 2 Mr. Larry Enoch April 4~ 1986 ~to two factors. The first is the convoluted configuration of the existing shoreline and the second is that in order to maintain a long term bulkhead the design cannot bow.~ The immediate area seaward of the proposed bulkhead will not be dredgedr rather left "as is" to act as a buffer zone between the dredged channel thereby minimizing the effects of scouring and additional erosion while providing protection to the Spartina establishing itself along the northern parameters of th~ high water mark. Butkheading is the prefered method of construction in this instance because of its low maintenance and long term stabilityo Superio~ in its ability to contain dredged material the bulkhead will eliminate the possibility of seepage and reentry into the waterway. The bulkheading will provide a less penitrative therefore more r~etensive method of erosion control on a moderately utilized man made channel. The work involves the replacement of approximately 145 linear feet of timber bulkhead in-kind and in-place along the eastern section of the applicant's west boat basin and replacement of 25 timber pilings that secure floating piers within the basin. Also proposed is the construction of approximately 415 feet of timber bulkhead generally along the line of mean high water on the western side of the east boat basin. An existing channel offshore of the proposed bulkhead 25 feet wide and approximately 415 feet long would be dredged to 6 feet below mean low water. The resulting approximately 1250 cubic yards of dredged material would be placed behind the bulkhead as backfill. The area between the proposed bulkhead and dredging, with an average width of approximately 25 feet, would remain untouched, allowing for the formation of a natural slope.
