Dear Mr. Haje:
Thank you for submitting the Federal Consistency Assessment Form (FCAF) and supporting
information regarding the proposed removal and replacement of 874 feet of bulkhead and
the dredging of 450 cubic yards of mater/al. However, the proposal, along with a related
proposal, raises certain concerns. Pursuant to 15 CFR 930.58, the following data and
information is necessary to enable the Department of State to adequately assess the coastal
zone effects of this proposed project.
In the submitted information, you describe the dredging and disposal operation as involving
450 c'.'.bic yards of dredged material, !50 cubic yards of wkich is the be placed behind the
replacement bulkhead as backfill and 300 cabic yards to be disposed of at another site. In
another application under the name of Goldsmith's Boat Shop, Inc. (F-95-509), the applicant
proposes to dispose of 1,200 cubic yards at the same site. In light of the two proposals, and
in a effort to coordinate our reviews, please elaborate on the upland dredge spoil controls
for the 1,500 cubic yards to be disposed of at the site. Discuss the method of conta/nment
and the measures to control runoff.
On your submitted FCAF and your consistency certification, you indicated that the proposed
activity w/Il affect or be located in, on, or adjacent to a state designated fish. and/or wildlife
habitat by answering "YES" to item C.2.c. Our prelim/nary review of the proposal indicates
that the site is not within the Jockey Creek Spoil Area Significant Coastal Fish and Wildlife
Habkat or the Hashamomuck Pond Significant Coastal Fish and Wildlife Habitat. While
they are nearby the dredge site and the disposal site, respectively, in your assessment of the
~)otential effects that the activity might have on Policy 7, you do not identify the potential
effects that you feel warrant an assessment of Policy 7, nor do you explain how the activity

facility. However, the Department of State (DOS) is concerned xvith various items and requests
additional information. Pursuant to 15 CFR 930.58, the following data and information is necessa~
to enable the Department of State to adequately assess the coastal zone effects of this proposed
project.
· Attached, please find a copy of your Federal Consistency Assessment Form (FCAF). Although C.
COASTAL ASSESSMENT 2.c. was checked as YES, it does not appear that the proposed
dredgingjdisposal would be located within the designated Hashamomuck Pond Significant Hah/tat.
Please review the attached habitat narrative and re~4ew the FCA~. Please return the amended FCIC'
along with your written response to this letter.
· Who ovms the underwater lands which are proposed to be dredged? Please submit a copy of a
permit/easement from the owner that authorizes the proposed dredging.
· Please elaborate on upland dredge spoil controls. For example, would a silt fence/haybale fence be
installed around the proposed area of disposal to control runoff?. Please comment.

Recently it has come to our attention that our recent approval
of a boat ramp on your property at SCTM %1000-64-3-11 may have
conferred the impression a permitted use for this structure is
for hauling a sea-plane(s).
Since the Town Code does not specifically include "Sea Plane" in
the definition of marina for the MII zone, we would ask that
you refrain from servicing any sea-plane(s) at your facility
until the Southold Town Zoning Board of Appeals could render a
determination in this matter. The Zoning Board of Appeals is
the Board with the responsibility of making interpretations of
the Southold Town Code.

The following action was taken by the Board of Town Trustees during
its regular meeting held on Thursday, October 28, 1993 regarding the
above matter:
WHEREAS, Alvah Goldsmith has applied to the Southold Town Trustees
for~a permit under the provisions of the Wetland Ordinance of the
Town of Southold, application dated July 23, 1993 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on Thursday, September 30, 1993 at. which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED that the Board of Trustees approves the application of of
Goldsmith's Boat Shop for a 14' X 40' ramp with the condition that
this be "Geoweb" construction and be in place by the beginr~ng of
Spring.
Permit will expire two years from the date it is signed. Fees must
be paid, if applicable, and permit issued within six months of the
date of this notification. Two inspections are raquired and the
Trustees are to be notified upon completion of said project.

Once again the Board, in considering this application, is ignoring
te provisions of the Southold Code. The application to
build a facility for a seaplane in an MII zone is a matter
properly subject to the regulations of the $outhold Town
Zoning Code. The MII district does not provide for the
berthing or storage of seaplanes.
In typical "ad hoc" fashion~ the Board, rather than consulting
the Code, relied on definitions of a seaplane emanating
from the floor. The thrust of these "definitions" was to
equate a seaplane with a boat. The specious reasoning advanced
was, that if a seaplane follows the maritime~'Rules of
the Road" when maneuvering, Git is~a boat.
Even were it only a question of semantics, such a conclusion is
ridiculous. Both a bicycle and an eighteen wheel tractor-
trailer are subject to traffic regulations, but the terms are
hardly synonymous or interchangeable.
On a more esoteric level, the word hippopotamus literally
means river horse. Obviously, a ponderous pachyderm hardly
transmogrifies into an elegant equine by immersion.
Were the Trustees to seek a definition of a seaplane, they
had only to consult Sec. 100 - t3B of the Southold Town
Zoning Code whicBstates:" ... Any word or term not noted
below shall be used with a meaning as defined in Webster's
Third New ~nt~rnatlonal Dictionary of the English Language,
unabridged (or latest edition)."
"Seaplane" is not defined in the Code. Marina is defined
as follows: "MARINA or BOAT BASIN - "Any premises containing
one ~1) or more piers, wharves, docks, moorings, bulkheads,
slips, basins or land under water, designed, used or intended
to be used primarily for the docking or mooring of boats,
with or without compensation.
I consulted the referenced dictionary and fou~ the following
definitions:
Seaplane "An airplane designed to rise from and light on
the the water"°
Airplane "A fixed wing aircraft heavier than ai~ that is
driven by a screw propeller or by a high-velocity jet and
supported by the dynamic reaction of the air against its wings
-commonalty used of a landptane as distinct from a seaplane".
Aircraft "weight carrying machine or structure for flight
or navigation of the air and designed to be supported by the
air either by the buoyancy of the structure or by the dynamic
action of the air against its surfaces - used of airplanes,
ball~oons, helicopters, kite balloons, orthopters and gliders
but chilly of airplanes or aerostats."
In view of the above definitions, a seaplane cannot be !egit~mately
classified as a boat and, hence, cannot be accommodated in
Southold's marinas.
It is also apparent that the Trustees misunderstood my comments
regarding the proposed use~s~of the ramp. THe application
also states that the proposed uses also include the hauling
or launching of small boats.
The Trustees have stated that no such ramp exists. The question
arises as to whether the ramp is to be used to service additional
boats on the premises, po~bly in the form of rack storage. It is
also possible that the pr6~osed ramp could be used to service
boats trailered to the premises. In either event, a survey
should be made of the parking facilities to see that they
conform to code requirements for the number of boats accommodated
on the prem£ses.

bulkhead to beach. The CAC recommends disapproval because there
is no need for the catwalk across the pond. The catwalk would
create an obstruction to wildlife and an intrusion to nesting birds
on the beach.

TEMPORARY APPROVAL of the Wetland Application of Goldsmith's
Boat Shop to install a temporary ramp made of C.C.A. pilings and 2
x 12 C.C.A. decking for the purpose of hauling and launching a
seaplane and/or small boats. Ramp to be 40' long x 14' wide and will
extend from bank to just beyond Iow tide line and will be removable.
The CAC recommends approval' only for a TEMPORARY PERMIT of
TWO YEARS. Since applicant describes the project as temporary, the
permit should reflect the approval for only a limited time. If.
after the two year period, the applicant still wishes to have the
ramp available, he would have to reapply for a permanent permit.
