town going to help them get that?
TRUSTEE KRUPSKI: I would be happy to speak to the DEC, how long have
you been dealing with there.
5~q. MCDD~'~'Y: Well, i've run into a stumbling block. As fs_r as, I'm
not well adverse to alt of the Dec law. I've had a problem with them,
and every time I fill out something, they want something more.

TRUSTEE KRUPSKI: Have you contacted an!m0ne there yet?
MfR. MCDUFFY: Originally, they give you a fast short stery, last
summer Chuck Hamilton was here. He was ine-roduced during the Kenney's
Beach thing. I handed him one of my little blue flyers, and said your
the thorn in my side. After the meeting he invited me t~ come in and
sit down with him and talk about it. Then he said one of our men will
write up the permit, and put it through, well he only wrote half of
it, then they come back and want something i have ne idea how to
handle. I was told a demonst_~ation, I was told i was going te be
fined a $10,000.00 a day for water other than my body, er my
registered boat. Well that's why I, Mr. Fitzgerald, ! got him
working on it, because he knows the law better t~han t do. And that's
where it stands. I attempted to do a demonstration on Orient State
Park, and I was told that this would bre~2<aua~_ ~. i was lucky enough
to b~ve it in the water in different places, fox about 8 years now.
It's never broke~n apart.
~R. FITZGF~RAL~: One of the things you can dc, if they let us, they
indicated they needed a lead agency- as a negative declaration. Even
though you may not think it's a ty!o_e, whatever it is.
TRUSTEE KI~JPSKi: Well we've been unburdened of the regulatory fiasco
that was secret, that t~he state created. Then they were hounded to us,
and then now, this past year, they have ~=Ken that back. We don't do
t!rpe 1, and type 2 anymore. Which is the reason we can give you a
pez~it now. If you would like I contact Chuck Hamilton, on your
behalf, and see if I can't see what's happening. Because the state
can be fairly cooperative sometimes. If you can get a hold of them.
MR. FITZGERALD: HOw indeed is it going to a~fect, adversely affect it.
TRUSTEE Ki{LrPSKI: Well you know, you den't know unless you try it
really. That was our feeling I t~hink. A!right. if you would like i'd
contact Mr. Hamilton, and see what he says. Well maybe Jim should
contact him.

NOTE: The term "you" and its derivatives, as used in this per~it, means the permittee or any future
transferee. The term "this office" refers to the appropriate district or division office of the Corps
of Engineers having jurisdiction over the permitted activity or the appropriate official of that office

You are authorized to perform work in accordance with the terms and conditions specified below.
Project Description:
Install two breakwaters (western and eastern) for wave abatement purposes,
consisting of floating devices, ranging in size from 8 feet by 12 feet to 12
feet by 20 feet. The western breakwater will consist of no greater than five
floating devices attached end to end with nylon rope and secured to an 8-inch
diameter pile at each end. The eastern breakwater will consist of no greater
thn, 15 floating devices attached and secured as above except that the seaward
end will be secured by bottom anchor.
All work shall be performed in accordance with the attached drawings
which are hereby made part of this permit.

General Conditions:
1. The time limit for completing the work authorized ends on J~me 11, 2001
If you find that you need more time to complete the authorized activity, submit your requsst for a time
extension to this office for consideration at least one month before the above date is reached,
2. You must maintain the activity authorized by this permit in good condition and in confo~nance with
the terms a~d conditions of this permit. You are not relieved of this requirement if you abandon the
permitted activity, although you may ~ake a good faith transfer to a third party in compliance with
Gene=al Condition % below. Should you wish to cease to maintain the authorized activity or should you
desire to a~andon it without a good faith transfer, you must obtain a modification of this permit from
this office, which may require restoration of the area·
3. If you discover any previouslyunknownhisto=ic or arcbeological remains while accomplishing the
activity authorized by this permit, you must i~mediately notify this office of what you have found.
We will initiate the Federal and state coordination required to determine if the re-mains warrant a
recovery effort or if the site is eligible for listing in the National Register of Historic Places.
4. If you sell the property associated with this per'it, you must obtain the signature of the new
owner in the space provided and forward a copy of the permit to this office to validate the transfer
of this authorization.
5. If a conditioned water quality ce=tificationhas been issued for your project, you must comply with
the conditions specified in the certification as special conditions to this permit. For your
convenience, a copy of the certification is attached if it contains such conditions.
6. You m=st allow representatives from this office to inspect the authorized activity at any time
deemed necessary to ensure that it is being or bas been accomplished in accordance with the terms and
conditions 0f your permit.

The Department of State has completed its evaluation of your Federal Consistency Assessment Form and
certification that the above proposed permk activity complies with New York State's approved Coastal
Management Program, and will be conducted in a m~nner consistent with this program. This consistency
decision is based on the revised plan received from the Army Corps of Engineers on February 1 i, 1998. 'Fne
proposed installation and monitoring of the wave abatement devices are temporary in that their installation and
monitoring will only be over a twelve month period. At the end of that period the data cotlected will be
evaluated by the involved federal, state and local agencies. The monitoring and collection of data will be in
accordance to the guidelines that you provided to us on November 20, I997.
Pursuant.:te 15 CFR Section 930.63, and based upon the project information submitted, the Department of State
concurs with your consistency certification. This concurrence is made with the understanding that there is no
dredging associated with this project. Additionally, this concurrence is without prejudice to, and does not
obviate the need to obtain alt other applicable licenses, permits, mud approvals required under ~s~ng State
statutes.

Following up on our telephone discussion of a few weeks ago. We had additional concerns relating to the
monitoring and collection of data relating to the placement of the proposed wave abatement system. I had
forwarded a memo dated December 8, 1997 from Mr. Fred Anders of this office to you. In that memo Mr.
?mders suggested additional monitoring means and methods to insure the accuracy and reliability of the data
collected. In our conversation you conveyed that you would acknowledge the comments contained in that
memo, and prepare a written response. As of this date, I have not received a response from you.
The requested response is necessary m enable the Department of State to adequately assess the effects of this
proposed project on the coastal area. Please provide the information requested above to the Department of
State within thirty days from the date of this letter. Pursuant to 15 CFR 930.64 (d), if the necessary data and
information is nor provided, the Department of State may object to your consistency certification on the
grounds of insufficient information.

A detailed description and plans of the applicant's activity are enclosed to assist in your'review.
The decision whether to issue a permit will be based on an evaluation of the probable impact,
including cumulative impacts, of the proposed activity On the public interest. That decision will reflect
the national concern for both protection and 'utilization of important resources. The benefits which
reasonably may be expected to accrue from the proposal must be balanced against its reasonably
foreseeable detriments. Ail factors which may be relevant to the proposal will be considered including
the cumulative effects thereof; among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, historical properties, fish and wildlife values, floodplain values, land
use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality,
energy needs, safety, food and fiber production, mineral needs,'consideration of property ownership and,
in general, the needs and welfare of the people.
The Corps of Engineers is soliciting comments from the public; Fed. eral, state, and local agencies
and officials; Indian Tribes; and other intexestedpanies in order to consider and evaluate the impacts of
this proposed activity. Any comments received will be considered by the Corps of Engineers to determine
whether to issue, modify, condition or deny apemit for this proposal. To make this decision, comments
are used to assess impacts on endangered species, historic properties, water quality, general
environmental effects, and the other public interest factors listed above. Comments are used iii
preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the
National Environmental Policy .act. Comments are also used to determine the need for a public hearing
and to determine the overall public interest of the proposed activity.

FULL ENVIRONMENTAL ASSESSMENT FORM

Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a proiect
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
Iy, there are aspects of a project that are subjective or unmeasureable. ]t is also understood that those who determine
significance may have little or no formal knowiedge of the environment or may not be technically expert in environmental
analysis, in addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting
the question Qf significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured tha, t the determination
process has been orderly, comprehensive in nature, yet flexible enough to allow introduction of information to fit a project
or action.
Full EAF Components: The full. FAF is comprised of three parts:
Part 1~ Provides objective data and information about a given project and its site. By identifying basic project
data, it assists a reviewer in the analysis that takes place in Parts 2 and 3.
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action, it provides
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially-
large impact. The form also identifies whether an impact can be mitigated or reduced.
Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the
impact is actually important.

Proposed Floating Breakwaters
We have preliminarily regiewed the above application for a Tidal
Wetlands and Protection of Waters permit to install [2) floating
wave abatement breakwaters offshore of Budds Pond in Port of Egypt
and find the application deficient for the following
items/information.
A completed Part I of the long environmnetal assessment form
(enclosed). The project will be reviewed pursuant to the State
environmnetal Quality review Act (SEQRA). A designation of'~Lead~
Agenc~ and a determination of significance, are necessary before
your application Can be considered complete.
2. You must submit written permission from the underwater
landowner, which is New York State (Office of General Services).
The cross section submitted does not show apparent high water or
apparent low water. This information must be shown to scale on
the cross section. We must have a plan that shows the proposed
depth of the structure.
4. You must demonstrate in writing that the proposed structure will
not be a navigation hazard.
This application will remain incomplete until all the above items
are adequately addressed and/or submitted.
