The following took place at the September 11. 1995. Planning Board public
meeting:-
WHEREAS, the Planning Board is the body charged by law with requiring, reviewing
and approving site plans: and
WHEREAS, Article XXV, Section 250 of the Southold Town Zoning Code grants the
Planning Board the authority to require site plan approval when there is any change
of use or intensity of use which will affect the characteristics of the site in terms of
parking, access, drainage, open space or utilities; and
WHEREAS, the Planning Board had adopted an as-built site plan on June 21, 1991,
which showed two restaurants and two connected buildings with pre C.O.'s for
residential use. one unoccupied and the other used for office and restaurant
storage; and
WHEREAS. Club Wave has initiated the rental of more than fifteen (15) watercraft
such as wave runners, jet skis and banana boat rides in addition to its existing
restaurant and bar business; and
WHEREAS, a large trailer is now located on the site; and

referenced property with respect to each Departments Codes.
There are many violation on this property that over the years
have gotten worse and need t~ be corrected.
Please respond to this office within 60 days of the date of this
letter to start the process to correct the violations under the
Local Codes of the Board of Trustees.
If we do not receive an application to correct these violations
within 60 days, we will be forced to issue violations.

Dear Mr. Krupski:
The Suffolk County Department of Health Services (SCDHS; "Department") has received
your letter dated May 20. 1994, concerning the above-referenced project. The Department has
no objection to your designation as lead agency.
Based on a review of the subject coordination, the Department offers the following
comments. However. the Department wishes to reserve its right to provide mom detailed
information within the comment period(s) established for this action. Also, these comments
should not be construed as an implicit SCDHS approval or rejection of the project. All
applications are reviewed thoroughly with respect to Suffolk County Sanitary Code concerns by
appropriate departmental personnel when SCDHS applications are completed.
Constmction of the proposed outdoor bar will require review by SCDHS Office of Water
and Wastewater Management and the Bureau of Food Control for compliance with the SCSC.
The site plan should clearly indicate any outdoor seating and total number of seats in the
restaurant. The approved plans indicate a total of 48 seats. Any expansion which would increase
the seating capacity will require a variance from Article 6 as the existing facility exceeds Article
6 density requirements. The facility with 48 seats is exempt from Article 6 as the use was
established prior to January 1, 1981.
The applicant must comply with the requirements of the Suffolk County Sanitary Code and
relevant construction standards for water supply and sewage disposal. Design and flow

specifications, subsurface soil conditions, and complete site plan details are essential to the
review of this project. These considerations are reviewed completely at the time of SCDHS
application. SCDHS maintains jurisdiction over the final location of sewage disposal and water
supply systems. The applicant, therefore, should not undertake the construction of either system
without Health Department approval.

under the State Environmental Quality Review Act (SEQRA) for
an outdoor bar at Club Wave revealed a retail store for Club
Wave on your property.
The sale of mopeds at this store' is not a permitted use in the
Marine II District. A certificate of occupancy or a
certificate of determination is required from the Building
Department for this change of use.
The sale of marine related items is a permitted use in the
M-II zone. An amended site plan showing this new use and the
number of uses on the property will have to.be filed.

Robert Kirk of Club Wave appeared in court today on the double citation from
the Bay Constables. I decided to hold over prosecution, so that it would
continue to hang over his head while he is proceeding with the proper permit
procedure. We continued the matter to August 19. by which time I hope you
will have finished the permit process. At that point I would appreciate a
recommendation from you on further prosecution, fines, etc.

bulkheading and backfill with approximately 50 yards of sand. Place
approximately 100 c.y. of sand on beach seaward of bulkhead as beach
nourishment. Reconstruct a new 6~ x 150' timber dock.
The CAC recommends approval with the condition that alt exposed areas be
revegetated. The Council also suggests the Trustees check into t~e town
installing a bulkhead at the end of the road.

RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Waiver Request of RICHARD BURDEN 122-B-15.16 as
requested in the Wetland Application No. 1126.
The CAC had recommendations concerning the Waiver Request aspects of
the project and made them with the Wetland Application recommendation.
