The Department has no objection to your designation as lead agency. Based on a review of the subject coordination, the Department offers the following comments. However. the Department wishes to reserve its right to provide mom detailed information within the comment period(s) established for this action. Also, these comments should not be construed as an implicit SCDHS approval or rejection of the project. All applications are reviewed thoroughly with respect to Suffolk County Sanitary Code concerns by appropriate departmental personnel when SCDHS applications are completed. Constmction of the proposed outdoor bar will require review by SCDHS Office of Water and Wastewater Management and the Bureau of Food Control for compliance with the SCSC. The site plan should clearly indicate any outdoor seating and total number of seats in the restaurant. The approved plans indicate a total of 48 seats. Any expansion which would increase the seating capacity will require a variance from Article 6 as the existing facility exceeds Article 6 density requirements. The facility with 48 seats is exempt from Article 6 as the use was established prior to January 1, 1981. The applicant must comply with the requirements of the Suffolk County Sanitary Code and relevant construction standards for water supply and sewage disposal. Design and flow Letter to Albert J. Krups~ June 29~ 1994 Page 2 specifications, subsurface soil conditions, and complete site plan details are essential to the review of this project. These considerations are reviewed completely at the time of SCDHS application. SCDHS maintains jurisdiction over the final location of sewage disposal and water supply systems. Place approximately 100 c.y. of sand on beach seaward of bulkhead as beach nourishment. Reconstruct a new 6~ x 150' timber dock. The CAC recommends approval with the condition that alt exposed areas be revegetated. The Council also suggests the Trustees check into t~e town installing a bulkhead at the end of the road. RECOMMENDATION OF WAIVER REQUESTS WR-6 Moved by Bruce Loucka, seconded by Stephen Angell. it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Waiver Request of RICHARD BURDEN 122-B-15.16 as requested in the Wetland Application No. 1126.
