The following action was taken by the Board of Town Trustees during
their regular meeting held on December 12, 1991 regarding your
request to amend the above permit.
RESOLVED that the Town Trustees Approve the request of En-Consultants
on behalf of Robert Boger to amend permit number 3786 to state the
following:
2'.6" X 10 fixed walk attached to bulkhead return, 2' X 8' ramp,

Dear Mr. Haje:
The following action was taken by the Board of Town Trustees during
their regular meeting held on March 22, 1990 regarding the request to
amend the above mentioned permit.
RESOLVED that the Town Trustees approve the request of En-Consultants
on behalf of Robert Boger to amend permit number 3786 to state the
following: ~
To construct a 3' X 16' hinged ramp secured on the landward side
by (2) 4' X 4' posts. The ramp will rest on a 5' X 30' float
secured by (2) 8" diameter pilings. The property is located on
Willow Point Road, Southold.
Ail other terms and conditions in the original permit granted shall
remain.
The amended permit shall take effect upon receipt of payment of
the following fees:
5 X 30 = 150 sq.ft. X $2.00 per Sq.ft.= $300.00.

Dear Mr. Haje:
Pursuant to 15 CFR 930.58, the following data and information is necessary
to enable the Department of State to adequately assess the coastal zone effects
of this proposed project.
Thank you for the copy of your 2/28/90 letter to George Hammarth in which
you presented modified plans for the above-referenced project. The letter
essentially responded to my questions letter of 1/11/90, in which I requested
additional information. Because of the substantial change in the project plans
it will be necessary for you to submit a revised Federal Consistency Assessment
Form, newly signed and dated.
Pursuant to 15 CFR 930.60(a), the review of your consistency certification
will begin after we receive and determine that the necessary data and
information is adequate to assess coastal zone effects.
Any additional information which you believe will facilitate our
consistency review of this project would be appreciated.
A copy of this letter has been sent to the U.S. Army Corps of Engineers.

Dear Mr. Haje:
Pursuant to 15 CFR 930.58, the following data and information is necessary

Thank you for your December 12, 1989 letter regarding Mr. Boger's
application; this letter responds to yours.
1)
My letter of 9/13/89 was sent to you because I did not feel that your
8/30/89 correspondence fully addressed previously identified concerns.
I will restate these concerns: the two set, of photograpn~ we received
do not show that the shorefront is eroding and do no= demonstrate the
need for the retaining wall (or bulkhead). Please document this need.
2)
I question the need to dredge the area as proposed in the 8/26/89
revised plans. The area should be further reduced to 40' by 10'.
This will allow the two 5' x 20' floats to placed waterward of the
intertidal area as indicated in the plans dated 6/27/89. Boats could
be docked at the floats without encroaching substantially into the
narrow canal.
3)
Your last letter indicated that the Southold Trustees permit was
attached, but it didn't arrive with the letter. Please submit a copy
of this permit.
4)
Please submit another completed Federal Consistency Assessmen= Form,
signed and newly dated. It will not be necessary to submit a new
application and plans other than what will be needed =o respond to
this letter.

Dear Mr. Haje:
The following action was taken by the Board of Town Trustees
during their regular meeting held on September 28, 1989 regarding the
above matter:
WHEREAS, En Consultants on behalf of Robert. Boger applied to the
Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated July 18,
1989 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on September 28, 1989 at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and thesurrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
-not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED that En Consultants ON BEHALF OF Robert Boger BE AND
HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO:
Construct one 5' x 12' float, 40' bulkhead, 155' retaining wall,
dredge 20' x 40' area to 4' below MLW in front of float only, install
2 pilings, ( If more pilings are to be used, please advise .
Property located at Willow Point Rd., Southold, N.Y.
This permit will expire two years from the date it is signed if
work has not commenced by said date. Fees must be paid and permit
issued within six months of the date of this notification. Two
inspections are required and the Trustees are to be notified upon
completion of said project.
Please return to the Building Department for a determination on
the need for any other permits which may be required for this project.

Dear Mr. Naje:
Pursuant to 15 CFR 930.58, the following data and information is necessary
to enable the Department of State to adequately assess the coastal zone effects
of this proposed project.
Thank you for your letters of 8/28/89 and 8/30/89, ~n which you responded
in part to my request for information letter dated 8/1/89.
Beck=se the proposed retaining wail is to be constructed along or
below the line of spring high water, it is essentially a bulkhead
rather than a retaining wall. Please provide more evidence of an
erosion problem at this site. Why is a bulkhead needed along the
entire 155-foot length of shoreline?

It does not appear that it will be necessary to dredge the intertidal
area as proposed, if an open pile dock is constructed at the site
rather than a floating dock. constructing an open pile dock will
remove the need to dredge within the intertidal zone. Please revise
the project drawings to reflect this concern.

The recommendations made at your August 24, 1989
meeting are being made part of a revised proposal.
The number of addlulonal floats has been r~ uced ~

imately 20'. Depth of dredging remain at
4' below mean low water. Approximately
35 cubic yards of spoil will be removed
and placed behind the bulkhead.
East of the westerly 40' the material used
will be shorter so that it will be a retain-
ing wall. It will be located along the
eroded bluff to prevent further loss of
trees and upland.
A revised work plan showing these changes is attached.

Dear Mr. Haje:
Pursuant to 15 CFR 930.58, the following data and information is necessary
to enable the Department of State to adequately assess the coastal zone effects
of this proposed project.
The photos submitted with this application do not indicate that an
erosion problem exists at this site. Please provide information that
the property landward of the tidal marsh is eroding.
Please revise the submitted drawings tc show the line of spring high
water. Where does the proposed wall lie in relation to this line? A
retaining wall such as that described should be located above spring
high water, if it is indeed needed.
Despite the narrowness of the canal, it appears that the floating
docks could be placed about 10' waterward of their proposed location.
This change should remove the need to dredge at this site, which in
turn will minimize or prevent damage to the adjacent intertidal
marsh. In any case, there should be a 15' buffer between the area to
be dredged and the edge of the marsh. Please address these concerns
through revised drawings. In addition, please include soundings on
the revised plan drawing.
