Dear Mr. Prois:
The following action was taken by the Board of Town Trustees
during its regular meeting held on February 25, 1998 regarding
the above matter:
WHEREAS, MARIA PROIS applied to the Southold Town Trustees for a
permit under the provisions of the Wetland Ordinance of the Town
of Southold, application dated January 15, 1998, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on February 25, 1998, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
/WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees grant a Wetland Permit to
construct a second story addition to existing dwelling with
gutters and leaders into dr~wells, an existing 8' X 10' deok
attached to house and a detached garage as shown. Also requests
a permit for existing 40' retaining wall with 3' and 6' returns
and a 39' retaining wall with 3' and 6' returns, a 3' X 15'
stair case as shown on updated survey dated Jan. 8, 1998.
Existing structures where built prior to 1971. A non-turf'buffer
must be maintained at the first t~er, said,
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct project will expire two yeDrs from the date
it is signed. Fees must be paid, if applicable, and permit
issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

Dear Members:
I received your notice informing me of an application by an adjacent property
owner to add an addition to their house and perform other work on their lot along
the Arshamomaque Pond shore, and offering me the opportunity to comment.
First of all, I'm very grateful to the board for their watchfulness and concern
about our environment. We feel extremely privileged to have lived for 10 years in
this beautiful, tranquil spot, and are vitally concerned for it's preservation, not just
for our own enjoyment, but generations to come.
I understand this application for a permit was triggered by a retaining wall at the
property (owned by Maria Prois at lot 51 and 52, section 52, block 5, lot 12). I
would be most interested in being kept informed of the board's inspection and
review process, in the hopes that whatever work may be contemplated by the
owners, and whatever work may already have been performed there,
complements and enhances the delicate balance of resources.

At the meeting of the Southold Town Conservation Advisory Council held Tuesday,
October 14, 2003, the following recommendation was made:
Moved by Drew Dillingham, seconded by Don Wilder, it was
RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of
the Amendment application of MARIA PROIS to Amend Permit #4862 to attach a 31 'X
15' deck to the existing 8'X 10' deck.
Located: 1405 Bayview Ave., Southold. SCTM#52-5-12
The CAC recommends Disapproval of the application because the applicant is in
violation of Permit #4862. The permit required drywells be installed and no drywells
were found on the property. The application should not be reviewed until the violation
has been satisfied.

This letter is to request permission to repair a damaged retaining wall and its associated
stair case (as described in the Southold Board of Town Trustees Permit No. 4862 dated
February 26, 1998, and the Peconic Surveyors survey dated January 8, 1998.) Portions of
the subject retaining wall, located on the premises of 1405 Bayview Ave., were washed
away by the northeaster storm system that hit Long Island this spring.
Photos of the damaged lower retaining wall and parts of the stair case are included for
your review. Although the rear portion of the retaining wall (see photos and attached
survey) is still in-tacked the lower portion was severely damaged with only the vertical
supports still in place.
It is requested therefore that permission be granted to reinforce the upper portion of the
retaining wall with vertical supports, and replace the lower retaining wall within the
existing footprint of the old wall.
