The New York District, Co,t-ps of Engineers has received an application for a Department of the
Army permit pursuant to Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403).

A detailed description and plans of the applicant's activity are enclosed to assist in your review.
The decision whether to issue a permit will be based on an evaluation of the probable impact,
including cumulative impacts, of the completed activity on the public interest. That decision will reflect
the national concern for both protection and utilization of important resources. The benefits which have
accrued from the work must be balanced against its detriments. All factors which may be relevant to the
work will be considered including the cumulative effects thereof; among those are conservation,
economics, aesthetics, general environmental concerns, wetlands, historical properties, fish and wildlife
values, floodplain values, land use, navigation, shoreline erosion and accretion, recreation, water supply
and conservation, water quality, energy needs, safety, food and fiber production, mineral needs,
consideration of property ownership and, in general, the needs and welfare of the people.
The Corps of Engineers is soliciting comments from the public; Federal, state, and local agencies and
officials; Indian Tribes; and other interested parties in order to consider and evaluate the impacts of this
completed activity. Any comments received will be considered by the Corps of Engineers to determine
whether to issue, modify, condition or deny a permit for this work, and/or mandate removal of completed
work. To make this decision, comments are used to assess impacts on endangered species, historic
properties, water quality, general environmental effects, and the other public interest factors listed above.
Comments are used in preparation of an Environmental Assessment and/or an Environmental Impact
Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the
need for a public hearing and to determine the overall public interest of the completed activity.
ALL COMMENTS REGARDING THE PERMIT APPLICATION MUST BE PREPARED IN
WRITING AND MAILED TO REACH THIS OFFICE BEFORE THE EXPIRATION DATE OF THIS
NOTICE, otherwise, it will be presumed that there are no objections to the activity.

The following action was taken by the Board of Town Trustees
during its Regular Meeting held on December 17, 1997 regardinq
the above matter: '
WHEREAS, WtLLIAM PAPPAS, applied to the Southold Town
Trustees for a permit under the provisions of the We~tand
Ordinance of the Town of Southold, application dated September
16, 1997 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings
reco~m~endations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on December '17, 1997, at which time
all interested persons were given an opportunity to be heard,
and, - ~
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has detezmined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
WILLIAM PAPPAS for a split rail fence around property, a 7' X
i0' deck, a 3' X 17' ramp, a 6' X 20' float, 7- 8" piles, a
storage shed and 6" X 6" walmanized ties to border driveway on
waterfront property, with condition that ties be no higher than
1" above gravel. Located: 85 Beverly Road, Southold.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other DeRa~_tment or
Agency which may also have an'application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

RE: Pappas Application
You asked me to review a legal description to see if there are other claims to the
right to use Beverly Road (a road on which you are being asked to approve a
parking area).
The document entitled schedule A is only part of a deed. It tells me that at one
time rights to use Beverly Road were deeded out. I don't know the date of the
deed or whether there was a subsequent purchase of these rights by Pappas.
Therefore, I cannot say with certainty that others are entitled to use Beverly
Road. However, the document suggests that such other rights are a distinct
possibility. In light of this, I suggest you require the applicant to provide proof
that the easements suggested by Schedule A have been removed from the area
where he seeks approval.
