APPLICANT: William Pappas 81 Eagle Chase Woodbury, NY 11797 ACTIVITY: Maintain as completed a platform, a ramp, a float and pilings WATERWAY: Arshamomaque Pond, Great Peconic Bay LOCATION: Town of Southold, Suffolk County, New York A detailed description and plans of the applicant's activity are enclosed to assist in your review. The decision whether to issue a permit will be based on an evaluation of the probable impact, including cumulative impacts, of the completed activity on the public interest. That decision will reflect the national concern for both protection and utilization of important resources. The benefits which have accrued from the work must be balanced against its detriments. All factors which may be relevant to the work will be considered including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historical properties, fish and wildlife values, floodplain values, land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, consideration of property ownership and, in general, the needs and welfare of the people. The Corps of Engineers is soliciting comments from the public; Federal, state, and local agencies and officials; Indian Tribes; and other interested parties in order to consider and evaluate the impacts of this completed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this work, and/or mandate removal of completed work. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects, and the other public interest factors listed above. Comments are used in preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the completed activity. ALL COMMENTS REGARDING THE PERMIT APPLICATION MUST BE PREPARED IN WRITING AND MAILED TO REACH THIS OFFICE BEFORE THE EXPIRATION DATE OF THIS NOTICE, otherwise, it will be presumed that there are no objections to the activity. DEC ACE Dept. of State MEMORANDUM TO: Al Krupski FROM: Town Attorney DATE: October 30, 1997 RE: Pappas Application You asked me to review a legal description to see if there are other claims to the right to use Beverly Road (a road on which you are being asked to approve a parking area). The document entitled schedule A is only part of a deed. It tells me that at one time rights to use Beverly Road were deeded out. I don't know the date of the deed or whether there was a subsequent purchase of these rights by Pappas. Therefore, I cannot say with certainty that others are entitled to use Beverly Road. However, the document suggests that such other rights are a distinct possibility.
