New York 11971 SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL At the meeting of the Southold Town Conservation Advisory Council held March 25, 1996 the following recommendation was made: GF-18 Moved by Allan Connell, seconded by Robert Keith, it was RESOLVED to recommen(~ to the Southold Town Board of Trustees APPROVAL of the Grandfather Permit request of KENT POEY 51-4-5.1 to maintain existing wood bulkhead. The CAC recommends approval however, the Council questions whether the new work was done without a permit. Gentlemen: To supplement the application for a .Grandfather Permit to ~aintain the existing wood bulkhead, we submit the following. 1. Concerning the wood stairs shown on the current survey, by Joseph A. Ingegno. The wood stairs were installed prior to Aug- ust, 1968. As evidence thereof, we attach a print of a survey R. Van Tuyl dated March 13, 1968, amended December 19, 1938, of a parcel belonging to Margaret H. Lovejoy (sister to Cortlandt Poey). The Lovejoy parcel lies immediately to the east of the Poey parcel and the survey shows the stairs along the boundary. The adjacent parcels belonging to Cortlandt Poey and Margaret H. Lovejoy, in 1968, were acquired as a single parcel by their mother, Celia Poey, by deed dated October 1st, 1924, recorded October 10, 1924 in Liber 1114 of Deeds, Page 273.In 1968, Celia Poey subdivided her property into two parcels conveying the parcel to the west to Cortlandt Poey by deed dated April 12, 1968, recorded April 17, 1968 in Liber 6333, Page 226, and conveying the parcel to the east to Margaret H. Lovejoy by deed dated April 12, 1968, recorded April 17, 1968 in Liber 6333, Page 230. The survey by Van Tuyl of the Lovejoy property, in 1968, shows the stairs on the westerly line thereof. Thereafter, by two conveyances dated June 20th, 1968, recorded June 21, 1968 in Liber 6368 of Deeds, Page 146~ and February 5, 1973, recorded February 21, 1973 in Liber 7345 of Deeds, Page 22, the western most portion of the Lovejoy property, including the land upon which the stairs stand was conveyed to Cortlandt Poey and now is part of Tax Lot 1000-51-04-5.1 It is submitted that the foregoing establishes that the wood Board of Town Trustees March 12th, 1996 Page Two. stairs were in existence in 1968 at the time of the survey by R. Van Tuyl. 2. Construction of the Bulkhead. As further evidence that the bulkhead existed in 1968, we submit a copy of a contract dated August 7, 1968, which provided for construction and installa- tion of a bulkhead for a distance of 235 feet across the Poey and Lovejoy lots. CJM/jr Encs 3. The wood walls on the westerly side of the present Poey parcel. We are unable at this time to produce any evidence as to the date of construction of the wood walls. Cortlandt Poey died in January, 1994, at which time ownership of the parcel past to his son, Mr. Kent Poey. Although aware of the existence of the walls, the younger Mr. Poey has no information as to when or by whom the walls were installed.
